ORDINANCE NO . 321
ORDINANCE GRANTING THE PECOS & NORTHERN TEXAS RAILROAD COMPANY A GORPORITION
AND ITS LESSEE THE PANHANDLE & SANTA FE RAILROAD COMPANY A CORPORATION AND THE
WHALEY MILL & ELEVATOR COMPANY A CORPORATION THEIR SUCCESSORS AND ASSIGNS THE RIGHT
AND PRIVILEGE OF LAYING CONSTRUCTING AND MAINTAINING A RAILROAD TRACK UP ON AND
ACROSS THIRD STREET BETWEEN AVENUE M AND AVENUE N IN LUBBOCK.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK TEXAS.
SECTION 1: That the Pecos & Northern Texas Railroad Company, a corporation,
and its lessee the Panhandle & Santa Fe Railroad Company, a corporation, and the
~aley Mill & Elevator C~pany, a corporation, their successors and assigns,
are hereby granted the privilege, right and pwoer of laying building, erecting
and maintaining an industrial railroad track with necessary turnouts, switches,
stands and other appliances connected therewith across and upon Third Street,
~etween Avenue M and Avenue N within the corporate limits of the City of Lubbock,
Texas, as follows : Running in a northernly and southerly direction across said
Third Street from the northward onto Block Twelve (12) of the Richmond Addition
to the town of Lubbock, Lubbock County, Texas.
Provided, however, that the said track shall be so erected and maintained
as to permit the crossing thereof by ordinary vehicles.
SECTION 2: This ordinance shall take effect and be in force from and after
its passage.
