HomeMy WebLinkAboutOrdinance - 311-1925 - Auditing And Allowing Final Estimate Filed By The National Incinerator Company - 07/14/1925n ORDINANCE NO. 311 AN ORDINANCE AUDITING AND ALLOWING FINAL ESTIMATE FILED BY THE NATIONAL INCINERATOR COMPANY, CONTRACTOR, COVERING MATERIAL FURNISHED AND LABOR PERFORMED IN THE CONSTRUCTION OF AN INCINERATOR PLANT IN AND FOR SAID CITY OF LUBBOCK, TEXAS, A ACCORDING TO CONTRACT WITH SAID CITY: AUTHORIZING THE DELIVERY TO SAID CONTRACTOR OF "CITY OF LUBBOCK INCINERATOR PLANT WARRANTS, SERIES, 1925", IN PAYMENT THEREFOR: AND DECLARING AN EMERGENCY. WHEREAS, The City of Lubbock, Texas, heretofore, namely, on the 3rd day of March, 1925, entered into a contract with the National Incinerator Company, Contractor for furnishing of material and labor in the construction of an incinerator plant in and for said City, in accordance with specifications heretof re adopted by said City and on file in the office of the City Secretary, and in accordance with said contract, which contract is of record in the Minutes of the City Commission of said City; and WHEREAS, said Contractor has heretofore presented a written account, or estimate, covering material furnished and labor performed in the amount of $11,551.00 which estimate was audited and allowed and warrants in the amount of $9,818.00 executed and delivered to said Contractor in payment of said estimate to that amount; and, WHEREAS, said Contractor has completed the construction of said incinerator plant and has presented Final Estimate, which is in words and figures as follows: AND, WHEREAS, said material and labor have been inspected by the City Commission of said City and found to be in accordance with the specifications adopted by said City, and to be well worth the sum of $ , the amount provided in said estimate, and in behalf of said City of Lubbock, Texas; and, WHEREAS, said estimate has been duly audited by said City Commission and found to be correct; and, WHEREAS, this Commission has been fully satisfied that the said Contractor has paid all claims for labor and material accruing against it under said contract with the City of Lubbock, Texas, and upon investigation this Commission has found that there are no accounts due against said Contractor for material furnished or labor performed in the construction of said incinerator plant; THEREFORE, BE I~ ORDAINED BY THE CITY OF LUBBOCK, TEXAS: That said estimate covering said material and labor, aggregating the sum of $ ____ , which has been presented by the National Incinerator Company, Contractor, be and the same is hereby allowed and ordered paid. That, in accordance with said contract between the City of Lubbock and said Contractor, there shall be executed and delivered to said Contractor "CITY OF LUBBOCK INCINERATOR PLANT WARRANTS, SERIES 1925" evidencing the indebtednes of said City to said Contractor in the sum of $21,000.00, being warrants numbers twenty one (21) to forty four (44), inclusive, in denomination of $500.00 each, dated Mayo lst, 1925, and bearing interest at the rate of six per centum (6%) per annum, authorized to be issued by Ordinance No. 294 of th4:* City Commission, adop~ed on the 29th day of April,l925, and recorded in Book 3, Page 397 et seq., of the Minutes of this Commission. 0 ( I I. The fact that the material has been furnished and the labor performed and payment is due the Contracbor, ere tes an emergency and an imperattve public necessity that the rule requiring ordinances to be read at more than one meeting of the City Commission be suspended, and it is so ordained, and this ordinance shall take effect and be in force from and after its passage and approval.
