ORDINANCE NO. 305 -·
An Ordinance providing for and determining to improve portions of certain streets,
avenues and highways in the city of Lubbock, and declaring an emergency:
WHEREAS, the poor condition of the surface of the streets and highways
herein mentioned and the accumulation of surface water thereon endangers public
health and safety, and the immediate preservation of public health and safety create
an emergency.
THEREFORE, BE IT ORDAINED BY THE CITY OF LUBBOCK:
That the following portions of streets, avenues, and highways in the
City of Lubbock, Texas, be improved by raising, grading, and filling same, by
installing curbs and gutters with all necessary appurtenances, and by paving same,
and by constructing and providing necessary system for drainage and storm sewers,
the same streets, avenues, and highways so to be improve~ being as follows, to-wit;
AVENUE I, from its intersection with the South property line of 9th
Street to its intersection with the North Property line of 6th Street,
known and designated as Unit No. 26;
13TH STREET from its intersection with the West property line of
Avenue Q, to its intersection with the West property line of AvenueT,
known and designated as Unit No. 34.
AVENUE T, from its intersection with the South property line of
Broadway Street to its intersection with the North property line of
13th Street, known and designated as Unit No. 35.
9TH STREET, from its intersection with the East property line of
Avenue M, to its intersection with the West property line of AvenueK,
known and designated as Unit No. 37.
AVENUE N, from its intersection with the South property line of
Broadway Street to its intersection with the North property line of
13th Street, known and designated as Unit No. 38.
same to be paved with one of the following materials or types of pavement, to-wit:
(a) Verticle Fibre Brick.
(b)

upon natural foundation or concrete base, the pype and material to be determined at
the option of the city after preparation of plans and specifications and receipt
of bid or bids.

Public necessity exists that said improvements be made.
III.
The firm of Hawley & Roberts, Engineers, are directed to forthwith
prepare plans and specifications for said improvements, embracing the sabt
different and alternative materials and methods of construction, and to submit to
he City Commission.

LV.
The improvements in each District or Unit shall be and constitute a
separate and distinct unit of improvement, and the improvements in each Unit shall
be paid for by assessing against abutting property and the owners thereof not
exceeding all of the cost of curb in front of the respective parcels of property,
and not exceeding three-fourths of the remaining cost, and the r eaaining portion
of the cist of the improvements shall be paid for by the City of Lubbock, provided
that the cost of constructing storm sewers in any such Unit shall be paid by the
city in addition to the other sums to be paid by it.
There being no area between rails and tracks or within two feet on
the outside of the rails and tracks of any railway or street railway embraced in
the same Units, no provision is made for assessments against any railway or street
railway other than as against any other abutting property.

Assessments against abutting property and the owners thereof shall be
made in accordance with the provisions and requirements of the Law and Charter in
force in this city, and subject to restrictions and conditions thereby imposed, and
in no case until after notice and hearing as provided thereby.
VI.
By the provision herein for the construction of system of drainage and
storm sewers is not meant the actual construction of storm sewers in each Unit,
but the construction of an adequate.system of storm sewers and drains for the proper
drainage of all Units, and the plans and specifications for such storm sewers shall
provide for the construction thereof and continuation thereof outside and beyond
the said Units to provide for the proper disposal of storm and surface water.
The facts recited in the preamb~e hereto constitute and create an
emergency requiring that the rules providing for ordinances to be read at more than
one meeting be suspended, and that this ordinance be passed as an emergency measure,
and such rules are accordingly suspended and this ordinance is passed as an emergenc
measure, and shall be in force and effect from and after its passage.
