AN ORDINMfCE providing for the application bt, and licensing of Master Pwnlbers. fixing the fees theref~. and issuance of ' a license; defining tb..e dut!es of Master Plumbers; providing for filing of applioantions for permits, fees therefor; for bonds a:nd their oondi t 10n&J prescribing the materials to . be used in all plumbing done 1n this City and the manner of its installation and inspectiam; requiring a permit to have been issued upon a proper application and payment of fees before any such installation shall be begun in th.e City of Lubbock; for inspection before same shall be used; repeal- ing all $rdtnanees and parts of Vrdinanees in conflict herewith; and declaring an emergency account of insanitary plumbing being a danger to public health; and fiXing penalties for violations of any part hereof. Be it Ordained by the City Council (Commission) of the City of Lubbock. ~exas: Section 1. When used in this Ordinance - The term "Person" or "Master Plumber" includes part-· nerships, aooociations, and corporations, as well as individuals. The term "Master, or Employing Plumbern is defined by Ordtnance No. • .of this City, and is hereby adopted. Seotian. 2. Application for License. All Master or ~ploying Plumbers holding certificates of qualification is~ed by the Examining and Supervising Board of Plumbers of this City, as def6ned in Ordinance No. , as provided by such ~rdinanoe, de- siring to do contract work in this City, shall present their respective certificates of qualification. to the Inspector of Plumbing, or his deputy. and shall fill out an application for lioense to contract plumbing in this City, on forms to be pre- scribed by the Inspector of £lumbing. and pay a license fee of $25.oo per annum, provided, all license shal.l be for th.e calender year, and paid pro rata for the unexpired part thereof. When the application has been properly fillled out and approved, and the applicant has duly complied with the other re- quirements of the ordinances of th.e City, a license shall issue to said applicant as a Master Plumber to do c ontraot work in this City, signed tae by the Plumbing Inspector, and subject to the conditions afterwards t181n.ed. Section 3. All Master Plumbers licensed to oe:rry on a plumb- ing business. shall, before the liceDS.e herein provided for it issued, and before any work is done, makeand deliver a bond 1n the sum of $3,000.oo, to the use and benefit of the City of Lubbock, ~exas, conditioaecl for the faithfu.l jierformanoe of the duties of Master Plumber, and all laws and ordinances relating thereto, and especially as provided in Section 4 hereof, 'Which. shall be made by a surety corporation, authoized to do business in this Stat•· Section 4. Duties of Ma ster or Employing Plumber:-{a) All work upon any sanitary sewer, or in connection therewith, or work done upon any of the mains, pipes of connections to the water works. shall be done iP. good and workmanlike manner t and in aooordanoe w with the rules ~nd regulations now or hereafter in existence. inol ud1ng this · rd1nance. f b). The City of Lubbock shall be fa.lly indem- nified and held whole and harmless from any cost, injury or dam- age on account of any injury or damge done to any person or property in the prosecution of said work, or as a consequence . l of the doinh of said work, or that may arise out of, or be ocoassioned by the performance thereof. ( o) The said licensee carrying on any suoh plumbing bus- iness shall :pJiev~o~e replace, in a good and workmanlik$ manner, and restore any portion of any street or alley which may be opened for the purpose of making any connection with any gas, sewer, water, or pipe or main, and shall refill all sttCh openings or excavation to as good condition in all streets and alle.ys as before such opening or excavation was made; Providied, that if said openiDg or excavation is not refilled and restwed as herein provided, and such work approved by the City Engineer, it shall be the duty of suCh license to eo promptly refill and restore the same upon a written notice from the City Engineer or Pl~bing Inspector, and provided, also, that in case of the failure of the said licensee on receiving such notice to so refill and restor-e, as directe·d, within three days from the receipt th er eot, the said failure shall be reported by the Vfficer giving ~oh notice to the City Commission, Which may direct the <1fficer to so restore the same as Jr ovided in the notice, and the certificate of restoration Shall show the ex- penses incurred therein chargeable to the licensee, which shall be conclusive evidence of the reasonable coat against him. C d) If auoh lie ens ee shall, in any way, injure any sanitary or storm sewer, meter, meter box, or any pipe, or any equipment belong!~ to the Cit:y of Lubbock in making m.y con- nections ar disconnections, or in doins any work whatsoever, or shall fail to make 8Uoh connection or disoonneotion in aooord· ance with the the rules, regulations an4. ordi.Il8l'loee of the City, the injury or damage shall be paid by the licensee upon the determination of the Commission of ~Ch injury or damage. {e) Said l1oensee shall do all plumbing in houses or public buildings \vhere same is to be connected with either city sewers or city water works, pipes or connections, so that the same Shall conform to the rules, rega.latiom and ordi.nano-es ·of the Oi t7 of Lubbock; Provided, that if such licensee shall fail, neglect or refuse to so install or oonstru.ct such plumbing work or con- nections, the owner of sueh house or building who may be injured thereby shall hsve a right of aotioh against Sllcb licensee for any injury or damage sustained, Provided further, that such work must befirst inspected and disapproTed by the !npseotor of Plumb- ing, and if he refuse to issue his certificate of approval of the work, he shall notify the lioenseee in writing to change or rectify the same eo that it will comply with the rules, reg- ulations and ordinances of the City, am if the licensee fail, refuse or negleotto so do within three days after the receipt of said notice, then the owner of such building may have the work changed, completed or rectifted as to comply at the ex- pense of the licensee. (f) It shall be unlawfUl for any Master Plumber to &o any plumbi~ in the City of Lubbock, unless and until such Master Plumber, Whether or no licensed, shall have procured and deposited with the City the bond herein&ba:ve pro;vided for, ( g} In the event the surety Company withdraw from such bona, it a ball be unlawful for the Jl&ster Patmber, principal therein. to continue any plumbill8 work in the City, then or thereafter to be done, until he Shall have i•esented and approved a sufficient bond conditions as above prar.ided. Section 5. Approval of Bon4; The bond herein provided for shall be submitted to the Board of Commissioners, and s~eot to its approval, and of regular prescribed form. section 6. Registration of Licensee; Every Master Plumber shall fUrnish to the Officer issuing said license the full name 3. and local address of eaCh person constituting suah licensee, and such facts shall be duly registered by the Officer, and any ohange therein shall be noted upon information furnished by the licensee. Whose duty it is ~o report same. Section 7. Revocation; Any license issued to any Master Plumber hereunder my be revoked by the City Commiseton of the City at any time, upon abarges filed against Bl.oh llaster Plumber, by any person, or its own motion; ~dh oharges by other person to be under oath, and the Oommiesi~ shall fix a time for hearing thereof and notify the licensee of the time ani place of the hearing, together with a copy of the oharges. If, upon hearing, the Commission shall be of the opinion that such license should be revoked, such order may be entered. and the unearned license fee returned. Section a. L~cense not transferable; Eaoh license and each permit i~sued shall be personal to the licensee umed therein, and sball not be transferred, nor the name of the licensee to be used, either directly or indireatlJ, by any· other person for the· purpose of obtaining a license or permit, or doing any plumbing work in this City. Section 9. a. All application blanks for permits for sewer connections, for tnetalling, and for construction with regard to all plumbing shall be furnished under the supervision of t)le Inspector of Plumbing, which mnst be filled out by the applicant and When so completed, subject to the approval of such Inspector, or rejection, Which ahall be endorsed thereon, all of which shall be accomplaished before any permits for any of such work may be issued• b. Any plumber, or firm or corporation engaged in euoh work, desiring to open any street or alleye to make any connectian with the City sewer, sh&ll make application for e per- mit for such opening, and reoe1ve the same before the work ooa- mences, which parmi t shall specify 1he exact places and the work to be done, and the applioation ahall contain a promise to oompl~ with Seotio.n 4, subd. c, of this ~rd1nanoe. b. Any plumber, firm or corporation, engaged in plumbing wo~lt in the City desiring to construct or install any fixture, or fixtures, in any bu1lding, or to connection any suoh which may have been disconnected, shall first obtains par- mit therefor, upon application to the Inspector upon form pre- scribed by him. d. The sum of One Dollar for one fixture, or roughing in for one fixture, and Seventy-five cents for eaah additional fixture, or roughing each in, shall be paid as a permit and inspection fee for the fixtures proposed to ~ placed in the work described in the application for permit, Which sum, or sums. shall be pail by the Master Plumber to whom the permit is issued at the time of application therefor. By the term f1xture" as used herein is meant each water aloeet, sink, bath tub basin or section of basin in battery, drinking fountain, soaA fountain, urina1. laundry tray, or section of laundry tray, sand trap, oatoh basin, and all other receptacles that may be ~ classed as plumbing fixtures. ThV permit and inspection fee shall apply to all floar and cellar drains (connecting with the sanitary sewer) septic tanks and sewers, fees to be tbe same as. for pl~bing fixtures. A fe~ of One dollar shall be paid for out- aide closet and connection, Which covers inspection. e. A special permit may be issued where additions [ fixtures are to be made whiCh oannot be practicably constructed in aooordance with all the provts iop of these regulations, provided, tbat 5oth1ng Shall be held ~o repeal any express pro- vision of this rdinsoee regarding plumbing. Section 11. Inspecti on and ~est. a. Application in w-rit 1ng for inspection must be made to the !nspeotor when work ia ready for inspec t ion at le-asy four hcmrs before such · inepection is desired. All plumbing work shall be inspected bN the Inspector or his assistant, as follows; b. No soil, drain or vent pipe shall be covered or concealed from view until after the work has been tested, inspeote and appro-ved by the Plumbing Inspector, Whioh includes connections With the sewer; openings or trenches mnst not be filled until the sewer and connections have&e been approved, if any part ia covered before su.oh time, 1 t shall be unoove·red at the expense •~-•a•-iaspee~•~-~Bie~~iPee*iee of the Master Plumber, under direction of the Inspector. o. Before the oitJ W"ter shall be turned onto the premises •••&, or the sewer connections used, the owner of the premises shall present tG th• Water and Sewer Departments of this Oity the final inspection certifi~ate, certifying that all the plumbing on such premises has been :fbund to be in compliance with the rules, rega.lations and ordinanaes of this Ci tJ; and any per a on turning on moh water, or using any sewer connectHm, without sttoh final certificate having been 1sB11e4 and presented, shall be guilty of a misdemeanot' and punished as provided elsewhere in this Ordinance. " Section 12. Fixtures; a. Material, All reoeptaoles used £or water closets, urinals or otherwise, far the disposal of human excreta, shall be o·onstructed of materials impervious to moisture and that Will not corrode, such as vitrified earthenware, hard natural atone, cast iron, white porcelian, and enameled on inside. b. Flushing Rims, All water closets and pedestal urinals s~all be provided with flushing rim constructed so as to flush the entire interi~ surface of the bowl thereof with water as after in this ordinance provided. c. ~en Jlumb!Dg All plumbing fixtures shall be installed or set free and open frpm enclosing woodwork, a:uch aa panelled doors, wainscoting, flour bins, drawers end aupboards for cooking utensils, eto., provided, however, that wooden drain boards may be used at end of sinks , and where pract ieal, all wastes and supply pipes shall run to wall. 5. d. Water S~pplt to Fixtures; Every water closet or,/ and urinal bowl shall be indir eotly flushed through a nushing tank or approved flush-ometer valve of at least three gallons capacity far water closet, and ODe gallon 1br uri.DUs; the tank shall be proparly supplied with water &n4 the flush pipe to the water closet and least one and oneOquarter i~hes in diameter, flush pipe for urinala shall be at least one inch tn diamete~. •• Flushing Tanks, Groups for P'irtures; A sroup of urtnals on the same floor subject to constant use, as in schools and fao- tories, may be supplied with one aa.tomatio flushing tank •f a capacity e~al to one g&llon to each urinal; autnoatie fluah mttst be simultaneous and of such force as to cleanse each individual fixtures; intermitten o~ autmoatic flushing devices Shall be flushed at regular intervals not to exceed tien minutes between intervals during tbt hours that such fixture is used. The bakks of stall to the length of three and one half feet must be kept constantly moist with a proportionate supply of water while in use. · Section 13. Mater1a11 a. Water Service, Suppl7 Pipes and P'i ttings -All water pipes used fer supplying plumbing fixtures end water system shall be wrought iron galvanized -merchant steel galvanized -brass pipe-iron pipe size and weight or lead pipe of weight known as "Extra Strong". All fittings used 1n water supply system shall be galvaniz-ed malleable fittings- galvanized cast iron fittings or brass water fittings. Threaded pipe used in watse and vent construction shall be ~f grade known to the trade as "Genuine Wrought Jiron " and to be galv ized inside aDd out. All fittings used in wrought iron waste co truct1an must be cast tron galvanized, recessed, threaded dra age fittings, known as "Durham" pattern. Fittings used in ven lines in wrought iron construction may be standard malleable galvanized threaded fitttogs up to two inch and above two inch may be standarcl cast iron galvanized threadhed fi ttiJ18S • d. Lead pipe used for waste, vent o~ flush pipe must not be of light er weight than that known to the trade as "Extra Light n e. Where cast iron soil pipe vents are called for, vents for kitchen etnks, bason and bath tubs, in provate residence of one and two stroy, m&y be vented with galvanised steel pipe reamed fllll pipe size, and galvanized m&lleable iron fittings; sizes of these vents per single fixture as follows one and one half inch far kitchen sinks, and. one and one quarter inoh for. bath tubs and basins. f. sewer pipe must be of the best grade of vitrified salt glaze tile, and all fittings of the same material. g. Water Service and Supply -Water a•rvice line of any building shatl not be of less than three - quarter 1Doh and shall be laid not lese than twelve inches below the g~ound surface, and where laid in street or alley, not less than twenty-two inches below the surface of the ground. Water pipe run under building mast to eight. inches under ground up to point of riser and shall not be suspended to timbers or exposed to cold air. b. The service supply to each one story building where there is a bath room and kitchen, and used as a residence, mast be prQvided with separate stop ·and waste cocks, one to control the bath room fixtures, one to oontrol kitchen fixtures and to to control hot water pipes. Stop and waste cocks mnst be installe d in such manner as to control fi.xtur or fixture separately as herein mentioned, with key tbrough floor; sill co.oka and yard hydrants shall be aontrolled by separate atop and waste cocks in order that rard service and house service can be separately controlled. d. Each building shall be served with an individual house sewer from main to house. Sewer shall not be lese then two feet deep at the gutter, where house sewer runs intostreet. If the grade of sewer is such as not to permit a depth of two feet below ground surface, it shall be lai.d with extra heavy cast iron pipe with the joints made as herein provided for soil pipe, and an extra heavy cast iron increaser must be used where the ea~t tron pipe receives the spigot to tile sewer of house drain. b. Bach Ya& bath tub shall be provided with a lead four inoh by eight inch or larger "Extra Heavy" drum trap. The outlet from ~ traps must be wiped wnto the trap in a posit- ion that waste outlet shall be water sealed and two and one- half inches; inlet and outlet must not be less than one and cne-h half inches 1n diameter. b. Drum traps for seitz bath and bath tubs where waster connects with lead bend and installed within 24 inohes of where waster intersects lead bend need not be revented. and drum traps shall not be located more than 24 inches from outlet of tub. Traps for kitchen sinks must be extra heavy lead or cast braes traps with seal not lese than one and one half inches and a discharge capacity equal to one and onehalf inches pipe provided with trap screw and cleanout. f. Traps for· urinals must be cast iron or cast braes traps with seal not lees than one and one half inches and a discharge capacity equal to two inCh pipe, provided with olean out or trap screw, or so constructed as to afford aaaess in case of stoppage, g. Traps for lavatories, sinks, urinals or other fixtures which oonneot with screw ptpe (as provided herein) must be aast brass and of New York or Loa Angelos Pattern. h. Traps for wash trays shall be drum traps of no ematler dimensions that four inches by eight inches, Extra ~eavy lead and one traps may be used for battery of three trays. Outlet shall not be lese tha~ two inches diameter. 1. Bars and soda fountain waste must be not smaller than 3 inches in diameter, and waste through a cast iron basin not small er than 18 inches by 18 inches. Basins must be provided with a removable cover. and to be vented as other ftxturee herein pro- vided. Basins may be located in rear of room or bu1 lding and waste line continued to location of bar or fountain where waste terminates in waste guttert other receptacle. Iastes must be provided with cast iron tra with at least four inah seal. When t this kind of construction used the waste line between oatoh basin and trap at fountain must be vented (at any point on the line). j. Waste pipe from kitchen sinks in any hotel, restaurant, ~oaading house ~r other public oooking plaoes must be run into grease tr&JlS made of cast iron. k. One sink to have lO inoh by 10 inCh trap with 2 1noh "**•. Two to four sinks to have 18 inch by 18 inch traps, with 3 inch waste. Trap and waste sizes to inoresse with number of sinks connected to it with eleanaut on sewer side of trap, and at end of lines. All sinks to have a oleanout flush with floor Each fixture must be connected with proper aise lead pipe wiped to Extra Heavy brass ferrule, and soldered to braes tail pieces from fixtures. No lead pipe to be less that one and one half inches; no traps *ball be used under f:lxt'Ql"es. 1. The discharge from any fixture must not pass through more thaa one trap before reaching house drain; traps placed below the floor Shall have a brass trap screw for cleani:ng, in plain view, all4 fltUih with the floor and must be accessible: all traps shall be rigidl7 supported and set true with respeot to their water level and shall be so located as to protect their waste seal. n. No trap which depends upon concealed interest partitions for its seal, or whiCh has an inter ior partition that, in case of defect, would allow the passage of sewer air, shall be used. o. .All closets, urinals or slop s.inks with trap combined shall have visible trap seal~ p. Garage and wash raok drains shall discharge into cast iron san4 traps provided with removable receptacle inside of trap to remove mud and other refuse washed into same. Section 23. Septic tanks and connections: a. Section 24, •aste from Acid Sinks. Section 25. Prohibited Material and Connections;-a. Pan or short hopper closets, latrine, or range olese, or closets having an unventilated space, or mas: e walls are not flushed at each discharge shall not be used. No •ter closet shaJ.l be supplied directly from the water supply pipes, exoept with valves made for same and approved by Plumbine Inspector. No steam exhaust alla!l- sediment from boiler or drain tubes from atop and waste cocks, or rain water pipes or cellar drains shall be connected d.i,ytf:,, with the san1 tary sewer. 7 b. No slip joint shall ~e made on any waste line, or revent line on sewer side of trap. Combination lead bends and ferrules s shall not be used, nor combination solder nipples, nor shall solder unions be used. Earthenware closet bowls with vent horn shall not be used; nor any double hub fitting or inverted caulked joint permitted on any soil waste line, nor shall any fitting known as offset f1tt1~ be used on ~ch waste line. The 1nstalle- tion or maintenance of wooden wash trays or sinks 1s prohibited in any building or part of building designed or used far human habitation, but may be used in any bu ilding where euoh tray s are in daily use such as publio ~i•eee laundires and dye houses. No fixture shall be installed without water oonnectiona. No san- itary tees shall be used as waste or soil fitting on horizontal p ipe unless side opening is smaller ~an the main body of fittings. c. Trough ur1na1s or gutters will not be permitted, but urinals must be of the intividual type. d. Long hopper water olosets cannot be used inside any building used for. human habitation, but may be used as yard olos•ta. e. rn no case shall a water pipe from any fixture be con- nected with any water closet trap, vent or revent connections for same. f. Welding hub opening to cast tron fitting will not be al- lowed. No lead waste or vent shall be exposed on outside of building below the second floor. Sectton 26. All persons are prohibited from connecting pipes whereby high pressure steam boilers may be supplied with water direct from City Maine; &11 Btloh boilers shal.l be provided with a tank or other receptaole of sufficient capacity to hold at least six hours supply of water in case of a pipe district being shut off to repair mains, fire hydrants or make oonnecttons or extensions, and the City shall not be responsible fa~ lack of water far steam boilers for &ny purposes. Section 27. a. Soil or waste pipes placed in any building for future use shall be ventilated, tested and subjected to the same rules in every respect as if intended for immediate use and all openings caulked or soldered. b. Old house plumbing can be connected with the sewer only When it is found on examination by the Plumbing Inspector to con- form in all respects to the requirements governing new plumbing. Sectio.n 28. The Plumbing Inspector shall have the power, and it shall be his dttty to, condemn any work heretofor·e or hereafter installed when, in his opinion, suCh work is insanitary and dan- gerous to the hee.l th of the comnmni ty where such work mey be. Section 29. No person, firm or corporation shall install or connect any hot wa~er heater for heating water by the use of gas, natural or artificial, unless the same be provided with a metal hood to which shall be o o }neoted a suitable ventilating pipe not less than the size/of the heater opening and said pipe shall extend to a ohimney Llue or to the open air in such way as to carry off all escaping gases or-fumes from such heater; provided, all sa:ch ventilating pipes when placed on the inside of partitions or enclosed in any manner so that said pipes are in contact with wood shall be tnll~ covered and protected with asbestos, or incased in tile pip lining to fillly protect and insure against fire; in case such ventilating pipe shall ex- tend to open air, it shall be provided with a cap or cowl eo as to prevent back draft; no heater shall be placed in a eloaet. Section 30. This Ordiname shall repeal all Ordinanaes and parts of Ordinances inlirect conflict herewith, or repugnant hereto, but shall be considered cumulative of all regulations Where there is no change herein by necessary implication. Section 31. Any person violating, or causing to be violated, any term or proVision of this Ordinance shall be guilty of a misdemeanor, and, upon conTict ion, Ellall be punished by a fine of not less than ~en Dollars nor more than ~o hundred Dollars; and in addition thereto, the City Commission may declare the license by any such person forfeited and may revoke the same. Section 32.
