WHEREAS, the poor condition of the surface of the fOrtions of street
hereinafter mentioned a nd the accumul~tion or sur~ace water thereon
endangers public heal!h a nd safety. and the immedia te preservation of
public health and s a f Pty crea te an emergency•
THEREFORE, :BE IT ORDAINED BY THE C I TY OF LUBBOCK 1
That the follo\"11 ng portions o~ Avenue ~ in said Ca t7 be improved by
raising, grading, and :filling same. and by installing curbs and gutters
with all necessRry appurtenances,and b7 paving aame, the said portions
of streets so to be improved being as followaf ~to•witt

bound macadqm or caliche stone; the type and material to be determined at
the option of the City after preparation of plans and specifications and
receipt of bid or bids.

Public neoeaelty exists that aid improvements be made.

The firm of Rawley & Roberts, Engoneera, are directed to forthwith pre•
pare plana and specifications for said improvements, embracing the said
different and altern3tive materials and methods of contruction, a nd to
submit srume to the City Cammisaion.
IV.
The improvements in e~ch District or Unit shall be and constitute a
separate and distinct unit of improvement, and the improvements in each
Unit shall be paid by assessing agai net abutting property and the owners
thereof, not exceedir.g all of the cost o~ curb in front of the
respective parcels of property and not exceeding three-fourths of the
remaining Cost, and the remaining portions of the cust of the tmprov~enta
shall be paid by the City of Lubbock.
There being no aren between rails and tracks or within two feet on the
outside o! rails and tra cks of any railroad or street railroa d embra ced
in the said Units, no p rovision is mad4 for assessments against any
railroad or street railroad other than as against any othe r ~butting
property.

Assessments against abutting property and the owners thereof shall be
made in accordance with the provisions and reqUiTements Of the Law
and Charter in force in ti..s city, and subjec.t to restrictio1-:.s and
conditions thereby imposed and in no case until after notice and hea ring
as provided thereby.

The ~acta recited in the preamble hereto constitute and create an emer-
g ency requiring tha t the rules providing for ordinances to be read at
more than one meeting be suspended. and that th1Q6rdinance be passed as
an emergeney measure and such rules are accordingl7 suapended and th•
ordinance is passed as an emergency measure. and ebll be in tarce and effect
from and a~ter its passage.
