ORDINANCE NO. 256 ORDINANCE REPEALING AN ORDINANCE ENTITLED AN ORDINANCE ORDERING IMPROVE- MEN~ OF CERl'AIN STREETS AND AVENUES IN THIS CITY SPECIFYING THE TYPES OF IMPROVEMEN'IS TO BE HAD DIRECTING THE ENGINEER3 '10 PREPARE AND PRESENT PLANS AND SPECIFICATIONS FOR SUCH IMPROVEMENTS APPORTIONING THE Cll3T OF SUCH IMPROVEMENTS AGAINST THE PROPERTY OWNERS AND FinNG TBE TIME OF PAYMENT AND RATE OF INTEREST AND FIXING SAID DEBT A LIEN AGAINST THE AWl".l''NG PROPERTY PROVIDING WAT THE VALUE OF THE ABUT!'ING PROPERTY PS IMPROVED SHALL BE OONSIDERED IN N3SESSING COOT, PROVIDING FURTHER THAT THE ACTIONS SHALL BE IN CONFORMITY WITH CHAPTER 11 OF TITLE 22, REVISED STAWTFS OF 1911, AND DECLARING AN EMERGENCY ACOOUNT OF IMMEDIATE NECESSITY FOR PAVING AND RESCINDING AND ANNULLING AU. WHEREAS, the City Commission of the City of Lubbock did on the day of 1924, pass and adopt ordinance known as Ordinance No. 250, and ~h is styl- ed and entitles; '' AN ORDINANCE ORDERING IMPROVEMEN'l'S OF CERTAIN STREETS AND AVENUES IN THIS CITY SPECIFnNG THE TYPES OF IMPROVEMENTS TO BE HAD DIREm'ING THE ENGINEERS TO PREPARE AND PRESENT PLANS AND SPECIFICATIONS FOR SUCH IMPROVEMEN"IS APPORTIONING THE COST OF SUCH IMPROVEMENTS AGAINST THE PROPERTY OWNERS AND FIXING THE TIME OF PAYMENT AND RATE OF INTEREST AND FIXING SAID DEBT A LIEN AGAINST THE ABUTTING PROPERTY PROVIDING THAT THE VALUE OF mE ABUTTING PROPERTY .AS IMPROVED SHAll. BE CONSIDERED IN ASSESSING OOS1S PROVIDING FURTHER THAT THE ACTIOOS SHALL BE IN <X>NFORMITY WITH CHAPTER 11 OF TITLE 22, REVISED STATUTES OF 1911, AND DECLARING AN EMERGENCY ACOOUNT OF D1MEDIATE NECESSITY FOR PAVING: and WHEREAS, pursuant to such ordinance plans and specifications for improvements on the streets mentioned in such ordinance were prepared and filed by Ha~ley and Roberts, City Engineers, and same were approved, and bids for the making and construction of such improvements were advertised for, and bids received and after consideration further bids were received, and it was determined to award contra ct therefor; and, WHEREAS, it is deemed advisable to provide for the improvement of some streets that were not included in said proceedings, and also to provide f or the improvements to be divided into units or districts; and to ace~ lish that purpose and for other reasons, it is deemed necessary to repea l and rescind and a nnul said ordinance and all of said proceedings with reference to said improvements; and other proceedings looking to the improvement of the streets and alleys necessary to be improved cannot properly be taken and had until such ordinance and other proceedings ha ve been repealed, annulled, and rescinded; and, · WHEREAS, the immediate preserva tion of public health and safety requires tha t this ordinance be passed as an emergency measure, since streets in their present condition endanger public health and safety, and such facts constitute and create an emergency. THEREFORE BE IT ORDAINED BY 'lHE CITY OF LUBBOCK, TEXAS, THAT l· The said Ordinance No. 250 and all other actions and proceedings of the·City pursuant thereto and in connection with the improvements mentioned and provided in the said ordinance be, and the same, are, here~ repealed, rescinded, and annulled, 11. The facts and matters recited in the preamble hereto constitute and create an emergency and create an emergency and an urqent public necessity requiring that the rules providing for ordinance to be submitted at several meetings be suspended, and requiring that this ordinance be passed as and take effect as an emergency measure, and that it be passed and enacted at the meeting of its introduction, and such rules are accordingly suspended, and this ordinance is passed and enacted as an emergency measure, and shall take effect and he in force immediately from and after its passage.
