HomeMy WebLinkAboutOrdinance - 233-1923 - Auditing And Allowing Estimate No. 11 Waterworks And Sewer Extension. - 19/22/1923ORDINANCE NO. 233 AN ORDINANCE AUDITING AND ALLOWING ESTIMATE NO. 11 FILED BY JANES CONTRACTING COMPANY, CONTRAC'roR OOVERlNG MA1ERIAL FURNISHED AND LABoR PERFORMED IN THE OONSTRUCTION OF ADDITIONAL WATERWORl:S AND SEWER EXTENSIONS UNDER CONTRACT WITH SAID CITY OF LUBBOCK# TExAS: AUTHORIZING 'lliE DELIVERY TO SAID OONTRAC'IOR OF "CI OF LUBBOCK WATERWORJ:S & SEWER EXTENSION WARRANTS, SERIE S 2 0F 1923" IN PAYMENT THEREFOR: AND DECLARING AN EMERGENCY. WHEREAS, the City of Lubbock, Texas, heretofore, -namely, on the 3rd day of November, 1922, entered into a contract with Janes Con- tracting company, Contractor, for the construction of certain waterworks and sewer extensions in and for said City, in accordance with the plans and specification~ heretofore adopted by said City and on file in the office of the City Secretary, which contract is of record in the Minutes of the City Commission of said City; and, WHEREAS, said contract provided for the construction of additional waterworks and sewer extensions, agreed upon by both parties; and, v~REAS, said Contractor has presented a written account, or estimate, covering the material vnich has been furnished and the labor which has been performed by it to date in the construction of additional waterworks and sewer extensions, under said contra ct, which said estimate is in words and figure s cs fo llows: Honorable Mayor & City Commission, Lubbock, Texas. Gentlemen: September ---:--' 1923. Ruby, City Manager AND, WHEREAS, said material and labor covered by said estimate have been inspected by the City Commission of said City and found to be in accordance with the specifications adopted by said City, and to be well worth the sum of $43,001.43, the amount provided in said estimate, and said City Comndssion has accepted the material and labor covered by said es- timate for and in behalf of said City of Lubbock, Texas; and, WHEREAS, the said estimate herein set out has be·en duly audited by said City Commission and found to be correct: NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF LUBBOC~, TEXAS: That said estimate covering said material and labor, aggregating the sum of $43,001.43, which has been presented py Janes Contracting Company, Contractor, be and the same is hereby allowed and ordered paid. That, in accordance with said contract between the City of Lubbock and said Contractor, there shall be executed and delivered to said Contractor "City of Lubbock waterworks & Sewer Extensions Warrants, Seried 2 of 1923", evidencing the indebtedness of said City to said Contractor in the sum of $35,000.00, said warrants being in denomination of One Thousand Dollars ($1,000.00) each, numbered from 1 to 3S, inclusive, dated September lst., 1923, and bearing interest at the rate of six per centum, (6~) per annum authorized to be issued by Ordinance No. 230 adopted by this City COmmission on the 3rd day of August, 1923, and recorded in Book 3, page 141 et seq., of the Minutes of said Commission. That said City of Lubbock, Texas, has received full value and con- sideration for said warrants. lhe fact that the material has been furnished and the labor performed and payment is due to the Contractor, creates an emergency and an imperative public necessity that the rules requiring ordinances to be read at more than one meeting of the City Commission be suspended, and it is so ordained, and this ordinance shall take effect and be in force from and after its passage and approval.
