HomeMy WebLinkAboutOrdinance - 231-1923 - Requiring All Persons Hauling Trash, ETC For Pay. - 08/23/1923ORDINANCE NO. 231 Ordinance requiring all persons h a uling trash, waste, refuse, junk and other similar d i scarded substances from the City of Lubbock for pay to, before engaging in said business, procure a license therefor, and executing bond, fixing conditions of said bond, providing penalties for violation; replacing all ordinances and parts of ordinances in conflict herewith, and declaring an ernergenoy, account of lack of proper regulation. Be it ordained by the City Commission (Council) of the City of Lubbock, Texa : Section 1. No person shall haul any trash, waste, junk, refuse, or discarde substances from the City of Lubbock for pay, except such persons which ha:v:e previously secured from the City a pe~it to engage in such business, and executed a bond payable to the city in the sum of $100.00, with two or more sureties to be approved by the City Secretary, conditioned that such person will transport the same in a sanitary manner from the place of its origin to the dump-grounds, or place provided by the city, and deposit same at a place, and in the manner designated by the City Health officer, and that such person will not injure any of the property of the City. Such applicant shall pay an annual license fee in the sum of $2.50. Section 2. That such person shall report to the City Secretary, in writing, on the first day of each month, showing the number of loads and parts of loads of such substance he has hauled to the dumP-grounds, and the days he hauled s ame, and such person shall place on the vehicle, used in such business, a number corresponding to his permit number, and shall not remove the same. Section 3. Any person, violatinq any provision of this ordinance, upon conviction, shall be punished by a fine of not less than $5.00 nor more than $50.00, and a second conviction under the ordinance shall revoke his per.mit~ Section 4. All ordinances, and parts of ordinances, in conflict herewith are expressly repealed. Section 5. The fact that the dump-grounds of the city are indiscriminately used, and used without system or regulation, endangering the property of the City creates an emergency and public necessity that the rule of charter requiring an o dinance to be read at two several meetings be, and the same is, hereby suspended, anc this ordinance shall be passed at the meeting of its introduction, and effective, as provided by law.
