Be it ordained by the City Council(commis s ion~ of the City of Lubbock. Texas. Section 1. No person shall build, use, or const~ct ~~ toilet or privy on any property which does not abut an alley, and no such structure shall be used, built or constructed except on an alley. All toilets, or privies, not abutting an alley shall be removed within lfo days after this Ordinance takes effect. Section 2. Cess-Pools, constructed in accordance with the de s igns and specifications of the State Board of Health of Texas. may be constructed and used on property not adjacent to an alley, subject to being abated at any time when the use or Op€rative thereof becomes a niisance. Section 3. Any person violating any portion of this ordinance shall upon conviction. be punished by a fine of nott exceedi~ two hundred dollars, and in addition thereto the City of Lubbock may enjoin the use of the offending structure and compel its removal. 4 l _ ____. Section 4. All ordinances and parts of Ordinances in conflict herewith are repealed. Section 5. The fact that some prop erty with the City cannot be safely and adequately served for sani- tation under present regulations. creates an emer.gency and public necessity that the rule of the Charter requiring an Ordinance to be read at two several meet- ings be suspended and this Ordinance passed at the meetiQg of its introduction and it is so ordered.
