HomeMy WebLinkAboutOrdinance - 198-1921 - Require The Destruction Of Weeds And Other Noxous Growth - 03/22/1921oxnirums No. lq.e AN Ordinance to require the destruction of Weeds and other noxious growth on, eud the removal of brush, Wire, cans and other debris from, all property within the limits of this City; providing for notice to the owner or person in charge of premises with such accumulations thereon to destroy or remove the same; fixing a punishment for f ei lure to so destroy or remove ; further providing, if not so removed or destroyed Within a certain time that a hearing be had by the City Commission to determine if the said property, by the destruction or removal of such growth, brush, wire, cans or other debris, would be benefitted or increased in value thereby, and, if it is found to be so, that the City Commission order such premises to be cleaned, and if not cleaned within zfivw days from such order that the. City cause same to be com-olied with and the costs of such compliance be assessed against the said properj7. and collected as other taxes for the current year, that the expenditure so incurred by the City bear interest and be a lien thereon; and declaring an emergency; Be it Ordained by the City Council of the City ., .. of Lubbock, Texas; Section 1. No owner of, or person in charge of, any property within this City shall permit weeds or other noxious growth thereon, nor allow the accumulation of brash, Wire, cans or other debris on such premisea, nor permit any of the same to remain thereon. Section 2. That it shall be the duty of the City Health Officer of this City, when it shall appear to him, or he shall be advised on credible authority, to file With the City Secretary, in writing, a state— ment showing the location of such property, the character of accumulations mentioned in Section 1 hereof, and the apparent owner or person in charge; and immediately the City ,secretary shall, in writing, dotify such owner, or the owner, or person in charge of such property of the fact of such complaint being filed in his Office, fixing a day not less than Ten (10) mo r more than Tmmty (20) days from such date at which time the City Commission will hear the evidence as to whether or not such accumulation on such premises are included in Section 1 of this Ordinance, and if the destruction or removal of such will be of pecuniary benefit, to -such property, and if so, to assess the cost of such destruction or removal as a tax against the said property to be paid as other taxes. Section 3. Upon the day appointed for a hearing in Section 2, the City Shall be represented by its City Attorney, and the owner or person in charge may be represented by counsel, whereupon the City Commission shall determine if the accumulations come within the purview of Section 1 hereof, if the removal or desetructim would be of financial benefit to such property, and the extent of such benefit, if any, and if so found, then to pass an order or judgment that the same be cleaned within five days from the date of said order, that if same not be complied with at the expiration, of such time, and that the City cause same to be Gleaned as that the costs of such cleaning be assessed, as other taxes, against the property and be entered on the tax rolls of the current year and be a lien thereon, that such costs bear ten per centum interest from the date of such entry on the rolls. Section 4. Any owner or person in charge of any such property, upon prosecution, found to be guilty of violating Section 1 of this Urdinance shall be punished by a fine of not lees than (* ") dollars nor more than (w•oo dollars, Section 5. The fact that the accumulations mentioned in Section 1 of this Ordinance are a menace to health and likely to cause or spread fires, creates an emergency and public necessity that the provision of the Chatter requiring Ordinances to be read at two several meetings before passage be suspended, and this 4rdinanee is passed by an unanimous vote on the meeting of its introduction.
