HomeMy WebLinkAboutOrdinance - 171-1918 - Installation And Use Of Water Meters And Electric Meters - 01/15/1918ORDINANCE No. 171 AN ORDINANCE regulating the installation and use of water meters and electric meters in the City of Lubbock, Texas, prescribing rules for the installation and use thereof, requiring a deposit with the City by the user, prohibiting using water or electric current without such meter, or meters, and declaring an emergency. BE IT ORDAINED BY THE COMMISSION of THE CITY OF LUBBOCK: Section 1. That each and every consumer of water or of electric current from the City of Lubbock, shall, before using such water or such current apply to and receive from the City of Lubbock a meter, or meters, to measure the amount consumed by such person. Section 2. No person shall be furnished any meter by the said City of Lubbock, without having first made with the City Secretary a cash deposit to secure the payment of hie monthly bill and reasonable use of such meter, based on the following schedule: For each water meter 47.50 For each current meter 5.00 Section 3. Such deposit shall be held by the City of Lubbock and upon failure of such consumer to prey his monthly bill by the loth of the month following the accrual of such bill, the City of Lubbock may deduct from such deposit the amount of such accrued water or current, bill to date of application of deposit to such payment, and remove the meter from connection with the premises of such consumer, wh❑ shall not further use water or electric current from City's plant, or plants, without having made request for and received from the City, placing his deposit therewith as formerly, another meter. Section 4. Such meters shall be placed at the places on or near the premises of such consumer as shall be designated by the employee of the City Charged with the duty of installing same. Section 5. The use of the words "person" and "consumer" herein shall be held to include, the owner, lessee or other person occupying said premises, and includes individuals, associations of persons, whether corporate or incorporate, and every kind and character of consumer of such water or electric current. Section 6. The City Secretary shall issue to each such person obtaining a meter a receipt for the deposit so made, which shall specify the date, kind and number of meter and premises where used, and shall keep a record of such deposits and receipts issued; any person desiring to cease connection with water, or electric current, may surrender the receipt herein mentioned, or produce satisfactory evidence of its loss, unnegotiated to subsequent owner of the premises, and procure a return of that portion of his deposit not consumed by rentals. Section 7. Any person now using water, or electric current, from the City of Lubbock, not now metered, shall, within 30 days from this date make application to the City Secretary for the installation of such meter desired and required by the Ordinance malting the required deposit as mentioned in Section 2, and a failure so to do shall work a forfeiture of present connections with the City`s W res and mains, and after such time shall not use water or electric current from the City, except as otherwise herein provided. Section 8. The fact that the City is now extending its water mains and light and power lines creates an emergency, so that this ordinance shall pass and become effective at once, as is provided to Section 16 and 17 of Article IX of the City Charter, and it shall be effective from and after its passage.
