HomeMy WebLinkAboutResolution - 2023-R0372 - UDC Amendments - 07/25/2023Resolution 2023-R0372 Item No. 6.7 July 25, 2023 RESOLUTION WHEREAS, Chapter 211 of the 1'exas Local Government Code (the "Code") establi municipal zoning authority; and WHEREAS, when the governing body of a municipality changes or adopts zoni regulations and district boundaries, the governing body shall hold a public hearing regarding t regulations and boundaries being changed; and WHEREAS, Sec. 211.007(d) of the Code authorizes the governing body of a home-rul municipality to prescribe, by the passage of two-thirds vote, the type of notice to be given for th time and place of the public hearing; and WHERAS, Sec. 211.007(d) of the Code authorizes a joint public hearing with the Planr and Zoning Commission (the "PZC") to consider changes to, or adoption of, zoning regulati and district boundaries; and WHEREAS, on March 22, 2023, the City Council of the City of Lubbock (the "Council and the PZC held a joint hearing to consider the adoption of the Unified Development Code (tl "UDC") and a new zoning map; and WHEREAS, thereafter at a special meeting of the PZC on April 13, 2023, the UDC recommended for approval via final report to the Council; and WHEREAS, the Council adopted the UDC on May 9, 2023 via Ordinance No. 2023-0005 to take effect October 1, 2023; and WHEREAS, effective date, and amendments; and the Council anticipated a need for amendments to the UDC before set forth herein is the notice schedule for the hearing to consider WHEREAS, the Council finds it to be in the public interest to conduct a jointly held hearin� with the PZC for the public hearing at which both bodies will consider amendments to the UDC. BE IT RESOLVED BY 'CH� CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the City is a home-rule municipality; and THAT the Council hereby, by at least a two-thirds vote, prescribes the type of notice to be given for the time and place of the jointly held public hearing with the PZC to conside� amendments to the UDC. The content of said notice, Exhibit "A", and the notice schedule, Exhibi� "B" are attached hereto and incorporated in this resolution as if fully set forth herein and shall be included in the minutes of the City Council. Public Notice The Planning and Zoning Commission and City Council will consider amending the Unified Development Code (UDC), Zoning Map, and Documentation to be submitted with Plat Applications. The adopted UDC comprehensively revised and updated the City of Lubbock's current zoning, subdivision, and sign regulations. These regulations provide rules for developing both residential and commercial property and include what uses are permitted, how large structures can be, and what type of signage businesses are allowed, in addition to other zoning and subdivision regulations. The adopted UDC and proposed amendments may be viewed at www.mvlubbock.us/udc and are available for viewing at Citizens Tower, 1314 Avenue K, first floor, in the lobby of the Planning Department.
