DOGS AND BITCHES. f" BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: Article 1. That there is hereby levied on each and every dog and bitch running at large upon any public street or public ground in this City on annual tax of one dollar on each dog and two dollars upon each bitch, which tax is due on or before the first day of January of each year or whenever such animals are found upon any public street or public ground in the City, and the tax, when paid shall be good for only one calendar year in which it is paid, and it is made the duty of every one owning a dog or bitch running at large upon any public street or public ground to pay the Tax Collector and get a metal tag or collar with number. Any person owning or keep - a dog or bitch who fails to comply with the provisions of this Article shall be guilty of misdemeanor and upon conviction shall be fined in any sum not exceeding five dollars for each offense, provided such animals shall be construed to be running at large whenever found upon any public Street or public ground, but neither this Article nor any part of this Ordinance shall apply to the dogs attending countrymen or farmers temporarily in the City. Article 2. It shall be the duty of the Tax Collector and Assessor, to -wit: City Secretary, to furnish each person a metal tag or collar on which is stamped a special number for each dog or bitch on which he is paying tax and also figures showing the year for which the tax is paid, which metal tag shall be securely attached to a collar around the neck of the dog or bitch paid for and shall be kept so attached during the year for which the tax is paid. Article 3. It shall be unlawful for any dogs of bitches to run at large at any time within limits of the City of Lubbock unless the tax is paid upon such dog or bitch and the payment indicated by the metal tag or collar as prescribed in Article 2 of this Ordinance. Article 4. All dogs or bitches found running at large within the limits fo the City of Lubbock without the proper tax paid tag on, shall be captured and impounded by the pound keeper, the Marshal, or any policeman of the City and if any dog or bitch so impounded, if not claimed or redeemed within forty- eight hours after its capture and impounding, then such dog or bitch shall be killed. Article 5. When any bitch shall or may become proud or in heat, it shall be the duty of the owner of said bitch to keep or confine her in some suitable pen or building, and upon failure to do so, he shall be deemed guilty of a misdemeanor and shall be fined not less than one dollar nor more than twenty-five dollars. Article 6. It shall be the privilege of the owner of a dog or bitch captured or impounded under the provisions of this Ordinance to redeem such animal at any time within forty-eight hours after its capture, and receive possession, of same upon payment of one dollar and fifty cents for each dog or bitch so redeemed together with whatever tax may be due. The Sec- retary shall keep in a book a Record of liscenses and redemption fines paid as follows: When paid, owners name, number given, and description of such animals. He shall pay one-half of all money collected into the City Treasury and retain one-half as his fees. Article 7. This Ordinance shall be in full force and effect from and after the fifteenth day of June, 1909. Passed and approved this the 13th day of April, A.D. 1909. F.E. Wheelock, Mayor ATTEST: W.M.
