AN ORDINANCi, PROHIBITING THE RUNNING LT
LARGE OF ANIMALw WITHIN THE CITY LIMITS.
BE IT ORDAINED BY THE CITY COUNCIL OF TIC; CITY OF LUBBOCK:
Article 1. That any person who shall suffer or allow any
cattle, horses, mules, or hogs, belonging to him, her, or them,
to run at large within the corporate limits of this City, shall
be fined, upon conviction in any sum not less than one nor more
than five dollars -for each animal so running at large, and each
day shall constitute a separate offence.
Article 2. That it shall be the duty of the City I.=arshall
and policemen to take up or cause to be taken up any and all cat-
tle, horses, mules or hogs that may be found running at large
within this city, and cause same to be placed in the City Pound
or secure enclosure, to be provided for by the City, and kept
therein until the same are disposed of in the manner hereinafter
provided.
Article 3. That the Marshall shall immediately after taking
up such cattle, horses, mules, or hogs, proceed to post up written
notices at three different public places in this city one of which
shall be at the Court House describing therein the marks, brands, col-
or, age, sex, and class, if it be a hog, and giving motice that
same will be sold three days after the date of such notice unless
the owner thereof come forward and reclaim the same as hereinafter
provided.
article 4. That at any time before the sale of such cattle,
horsez, mules, or hogs, the owner thereof. may reclaim the same
by making diffidavit before the Mayor, or by giving other satis-
factory evidence of his ownership and, paying all costs and fees
which may have accrued by reason of such taking up, and feeding
such stock.
Article 5. That iff no owner shall demand any cattle, horses,
mules, or hogs taken up as provided in this Ordinance by the day
set for sale, the Marshall shall proceed to sell at public out-
cry to the highest bidder, at the place of keeping, for cash,
and shall forthwith pay the amount of such sale to the Treasurer,
retaining in his hands the amount of his fees.
Article 5. That the Marshall shc-ll keep a correct descrip-
tion of al-1 animals sold by him under this Ordinance, --nd the
price sold for, in a book to be kept by him for that purpose,
where it shall at all times be subject to examination. Such
description shall be as full as directed in -rticle 3 in this
Chapter.
Article 7. The owner of any stock that may be sold under
this Ordinance, mqy at any time within three months after such
sale, appear before the yor and make satisfactory proof of his
ow. ership, whereupon it shall be the duty of the I°ayor to give
such o ,ner a draft u on the City Ire surer for the amount for
which the stock was solo, less the costs accuring, as herein
provided for.
Article 8. That for each and every head of cattle, horses,
and mules taken up and advertised by the I,Iarshal under thi_- Ord-
inance, ana' which is not sold, the T.:arsh�_.l receive one dollar,
and for each hog, traenty-five cents, besides the cost of feeding
and keeping, which shall be fifty cents a day for each head of
cattle, horses, or mules, and fifteen cents a day for each hog;
and for each head sold of cattle, horses, and mules, he shall
receive an additional sum of one dollar, and for each hog,
twenty-five cents.
Article 9. That any person who shall wilfully release,
turn out, or in any manner take from the public pen, or from the
possession of the Marshal, any stock taken up under the provision
of this Chapter, shall be deemed guilty of middemeanor, and upon
conviction shall be fined in any not less than ten nor more than
fifty dollars.
Article 10. That this Ordinance shall take effect and be in
full force and effect on and after June fifteenth A.D.1909.
