AN ORDINANCE REGULATING THE CONSTRUCTION AND MAINTENANCE OF PRIVIES, CLOSETS, ETC. Be it Ordained by the City Council of the City of Lubbock: Section 1. All closets and privies for the deposit of human excrement and which are not connected with sewerage or cess pools may be built of wood or other suitable material and shall be fitted with a hinged door at the back thereof and not less than one and one half feet in height for the ppr- pose of removing drawers or boxes and the cleaning of such closets or privies, and all such closets or privies shall be well and substantially made and tightly inclosed to prevent the escape therefrom of the flying about of any of the contents or the effluvia therefrom. Section 2. It shall be unlawful for the owner of any lot or premises within the Corporate Limits of the City to have or to use any place as a privy or necessary house on such lots or premises within three feet of the adjoining lot belonging to or occupied by another. And every privy or necessary house now eredted or sitting contrary to the foregoing provision shall be immediately removed by the owner or the occupant of the lot or premises on which the privy is situated: and every person violating the provision of this Section shall be guilty of misdemeanor and upon conviction shall be fined not less than one nor more than twenty-five dollars. Section 3. All cess pools whith water closet connections shall be con- structed under the supervision of the Sanitary Committee of the City Council and it shall be unlawful for any person to construct any such closet with a cess pool on -any premises within the City Limits without having a permit from the City Council to do so: Any person, frim, or corporation so con- structing any cess pool with water closet connection in violation of the terms of this Section shall be deemed guilty of misdemeanor and upon con- viction thereof shall be fined in any sum not less than one nor more than one hundred dollars and each day that such closet or cess pool shall be maintained shall constitute a separate offense and no permit shall be grant- ed for the construction of any cess pool or pit except what is known as aseptic sewerage is used. Section 4. It shall be the duty of every person owning a closet, privy, or necessary house to place and to use and to keep the same in such manner that it will not be offensive to the public or any person residing in that vicinity and have same placed near an alley or street where it will be con- veniently reached by the City Scavenger and for violation of any section of this Ordinance in which no specific penalty is mentioned, the offender upon conviction shall be fined in any sum not less than one nor more than one hundred dollars.
