Home My WebLink AboutResolution - 2023-R0351 - 4% Non-Competitive Housing Credit; South Plains And Homestead Apartments - 07/11/2023Resolution No. 2023-R0351 Item No. 6.2 July 11. 2023 RESOLUTION WHEREAS, the Texas Department of Housing and Community Affairs has established a Low Income Housing Tax Credit Program (the "Program") under the Texas Government Code Chapter 2306, Subchapter DD (the "Code"); and WHEREAS, the purpose of the Code is to govern the administration of the Program in order to, among other things, encourage development of affordable rental housing; and WHEREAS, SPHS Lubbock Preservation, LP (the "Applicant") has informed the City of Lubbock (the "City") of its intent to file an application for the Program in accordance with Section 2306.67071(a)(1) of the Code for its developments to be named South Plains Apartments at 5520 58th Street, Lubbock, TX and The Homestead Apartments at 5401 56th Street, Lubbock, TX; and WHEREAS, the City is required to hold a public hearing at which public comment may be made on the application, in accordance with Section 2306.67071(b); and NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK, TEXAS: Section 1. THAT notice has been provided to the City Council of the City of Lubbock (the "Council") as required by 2306.67071(a)(1). Section 2. THAT the Council has had sufficient opportunity to obtain a response from the Applicant regarding any questions or concerns about the proposed developments. Section 3. THAT the Council has held a hearing required under Section 2306.67071(b). Section 4. THAT after due consideration of the information provided by the Applicant and public comment, the Council does not object to the proposed application.
