AN ORDINANCE ABANDONING AND CLOSING PORTIONS OF A WATER � o
LINE EASEMENT LOCATED IN TRACTS C-1 & C-2, WEST CHASE SUBDIVISION � o
ADDITION TO THE CITY OF LUBBOCK, LUBBOCK COUNTY, TEXAS, WHICH IS �
MORE PARTICULARLY DESCRIBED IN THE BODY OF THIS ORDINANCE; �
DIRECTING THE CITY ENGINEER TO MARK THE OFFICIAL MAPS OF THE CITY TO �
REFLECT SAID ABANDONMENT AND CLOSING; PROVIDING A SAVINGS �
CLAUSE; AND PROVIDING FOR PUBLICATION.

WHEREAS, the City Council finds that the easement hereinafter described in the body �
of this Ordinance IS no longer needed for easement purposes and for public use; and it would �
be in the public interest to close, vacate and abandon the same for easement purposes and for -
public use; NOW THEREFORE: —
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT the easement as hereinafter described shall BE and the same IS
hereby closed, vacated and abandoned for easement purposes and for public use, such easement
being more particularly described in the attached Exhibit "A."
SECTION 2. THAT the City Engineer is hereby authorized and directed to mark the
offcial maps of the City of Lubbock to reflect said abandonment and closing, showing the
number of this Ordinance and the date of its final passage.
SECTION 3. THAT should any section, paragraph, sentence, phrase, clause or word
of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this
Ordinance shall not be affected thereby.
SECTION 4. THAT the City Secretary of the City of Lubbock is hereby authorized
and directed to cause publication of the descriptive caption of this Ordinance as an alternative
method provided by law.

METES AND BOUNDS DESCRIPTION OF 0.0316 ACRE
Being a tract of land containing 0.0316 acre (1,378 square feet), located in the B&B Survey,
Section 11, Block 2, Abstract 11, in Lubbock County, Texas; Said 0.0316 acre tract being out of
Tract C-1, of Tract C-1 and C-2 of the West Chase Addition, a subdivision of record in Lubbock
County Clerk's File Number (L.C.C.F. No.) 2010003602, same being recorded in the name of
Wal-Mart Real Estate Business Trust, in L.C.C.F. No. 20100036025; Said 0.0316 acre tract
being more particularly described by metes and bounds as follows (all bearings are referenced
to the recorded subdivision plat of said West Chase Subdivision):
COMMENCING, at a 1/2-inch capped iron rod found at the northeast corner of said Tract C-1,
same being the northwest comer of Tract D of West Chase Addition, a subdivision of record in
Cabinet 6, Slide 189A, of the Lubbock County Plat Records (L.C.P.R.), on the south Right -of -
Way (R.O.W.) line of State Loop 289 (width varies), from which an "X" cut in concrete found at
the northeast comer of said Tract D, same being the northwest corner of Tract G of said West
Chase Addition, bears South 78° 15' 36" East, a distance of 313.56 feet;
THENCE, through and across said Tract C-1, the following six (6) courses:
1. South 03° 10' 34" East, a distance of 414.07 feet to an angle point;
2. South 45° 04' 48" East, a distance of 5.08 feet to the most northerly corner and
POINT OF BEGINNING of the herein described tract;
3. South 45° 04' 48" East, a distance of 141.29 feet to an angle point;
4. South 670 28' 21" West, a distance of 10.83 feet to a point for the most southerly
corner of the herein described tract;
5. North 450 04' 48" West, a distance of 134.36 feet to an angle point;
