Smith P.C. at 1220 Ave KResolution No. 2023-R0245 Item No. 5.6 May 23, 2023 RESOLUTION WHEREAS, pursuant to Article IV, Section 5 of the Amended and Restated Bylaws of the Market Lubbock Economic Development Corporation (the "Corporation"), the City Council of the City of Lubbock (the "City Council"), as the Corporation's authorizing unit, has the authority to approve all programs and expenditures of the Corporation; and WHEREAS, the City Council finds that it is in the best interest of the public to approve the program or expenditure, as proposed to the City Council by the Corporation, as set forth in Exhibit "A" attached hereto and incorporated herein by reference; NOW THEREFORE: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the Downtown Fayade Grant program or expenditure of the Corporation, in the amount set forth in Exhibit "A" attached hereto and incorporated herein by reference, to be provided to Davis W. Smith, PC, is hereby approved pursuant to Section 5 of the Amended and Restated Bylaws of the Corporation. SMITH, P.C., AT 1220 AVENUE K DOWNTOWN FACADE GRANT THE STATE OF TEXAS COUNTY OF LUBBOCK At a regular meeting of the Board of Directors of MARKET LUBBOCK ECONOMIC DEVELOPMENT CORPORATION, INC., a Texas nonprofit corporation (MLI), on Tuesday, April 25, 2023, held in conformity with the bylaws, after due notice as therein provided, a quorum being present and acting, the following resolution was unanimously adopted: WHEREAS, MLI presented to members of the Board the proposal of a possible Economic Development Grant and Contract to Davis W. Smith, owner of the property at 1220 Avenue K and making improvements to his property, which is in the Downtown TIF. The Law Firm of Davis W. Smith was founded in 1994 and they are solely dedicated to handling only Personal Injury Cases and have successfully worked on and settled over 15,000 Cases. They are a Local Law Firm and take pride in being available to their clients. Davis W. Smith is a Texas Native who attended Baylor University and graduated with a Degree in Business. At Baylor, he was a member of Beta Alpha Psi Accounting Honor Fraternity, Beta Gamma Sigma Business Honor Fraternity, Winner of the Wall Street Journal Award for Outstanding Academic Achievement and numerous other organizations associated with Academic Excellence. He attended Texas Tech School of Law and was Licensed to Practice Law in November 1994. Davis W. Smith also served in the United States Marines prior to attending Baylor and won numerous awards and was nominated for the Marine of the Year. The scope of facade work will include exterior painting, new lighting, signage, and woodwork totaling $21,950 in facade expenses. The terms and conditions of such Economic Development Grant and Contract, other than the normal terms and conditions applicable to all such Economic Development Grant and Contracts by the Corporation, are described generally as follows, to wit: Grant Davis W. Smith, P.C. a Downtown Fagade Grant for $10,975 at 1220 Avenue K, which is in the Downtown TIF, once proof of payment has been submitted. WHEREAS, The Board of Directors of MLI finds that an Economic Development Grant and Contract offering the incentive for providing assistance for renovations to their property, meet and comply with the qualifications and purposes of the Corporation for the granting of such Economic Development Grants and Contracts. Upon Motion by Director, Mr. Blake Womble, and Seconded by Director, Mr. James Conwright. IT WAS RESOLVED that MLI offer and, if accepted by Recipient, enter into an Economic Grant and Contract with Davis W. Smith, P.C., for improvements to the property at 1220 Avenue K, Lubbock, Texas.
