HomeMy WebLinkAboutOrdinance - 2019-O0021 - Repealing Ordinance No. 2018-O0115 - Extension Of A Moratorium For Billboards - 02/25/2019First Reading February 12, 2019 Item No. 9.7 ORDINANCE NO. 2019-00021 Second Reading February 25, 2019 Item No. 8.12 AN ORDINANCE REPEALING ORDINANCE NO. 2018-00115 OF THE CODE OF ORDINANCES OF THE CITY OF LUBBOCK, TEXAS, WITH REGARD TO AN EXTENSION OF A MORATORIUM AS SET FORTH IN ORDINANCE NO. 2018-00048 ON ACCEPTING, PROCESSING, OR ACTING UPON CERTAIN APPLICATIONS FOR ANY PERMITS FOR THE CONSTRUCTION OR MODIFICATION OF BILLBOARDS; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION. WHEREAS, the City Council of the City of Lubbock previously found a need in the interest of the general welfare, health, safety, and property development of the community of Lubbock to establish a one hundred eighty day moratorium regarding billboard permitting in the City of Lubbock through Ordinance No. 2018-00048; and WHEREAS, to allow for additional time for consideration of ongoing zoning needs, the City Council of the City of Lubbock extended said moratorium for one hundred eighty days through Ordinance No. 2018-00115; and WHEREAS, the Planning and Zoning Commission of the City of Lubbock and city staff have considered ongoing property development within the city and necessary zoning requirements and safeguards for said development and have made recommendations to the City Council of the City of Lubbock; and WHEREAS, due to the aforementioned recommendations, it is no longer necessary to keep a moratorium regarding billboard permits in the City of Lubbock in place; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT Ordinance No. 2018-00115 is hereby repealed in its entirety. SECTION 2. THAT should any paragraph, section, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of the Ordinance shall not be affected thereby. SECTION 3. THAT the City Secretary of the City of Lubbock, Texas, is hereby authorized and directed to cause publication of the descriptive caption of this Ordinance as an alternative means of publication provided by law.
