AN ORDINANCE ABANDONING AND CLOSING A DRAINAGE EASEMENT

LOCATED IN SECTION 34, BLOCK AK, AS RECORDED IN COUNTY CLERK FILE
NUMBER (CCFN) 2019039183 OF THE OFFICIAL PUBLIC RECORDS OF LUBBOCK
COUNTY, TEXAS, WHICH IS MORE PARTICULARLY DESCRIBED IN THE BODY OF
THIS ORDINANCE; DIRECTING THE CITY ENGINEER TO MARK THE OFFICIAL
MAPS OF THE CITY TO REFLECT SAID ABANDONMENT AND CLOSING;
PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION.
WHEREAS, the City Council finds that the easement hereinafter described in the body
of this Ordinance is no longer needed for easement purposes and for public use; and it would
be in the public interest to close, vacate and abandon the same for easement purposes and for
public use; NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:

SECTION 1. THAT the easement as hereinafter described shall BE and the same is
hereby closed, vacated and abandoned for easement purposes and for public use, such
easements being more particularly described in the attached Exhibit "A".
SECTION 2. THAT the City Engineer is hereby authorized and directed to mark the
official maps of the City of Lubbock to reflect said abandonment and closing, showing the
number of this Ordinance and the date of its final passage.
SECTION 3. THAT should any section, paragraph, sentence, phrase, clause or word
of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this
Ordinance shall not be affected thereby.
SECTION 4. THAT the City Secretary of the City of Lubbock is hereby authorized
and directed to cause publication of the descriptive caption of this Ordinance as an alternative
method provided by law.
AND IT IS SO ORDERED.

A closure, vacation and abandonment of that certain Drainage Easement, 50 feet in width,
previously granted to the City of Lubbock, Lubbock County, Texas, recorded in County Clerk's
File Number 2019039183 of the Official Public Records of Lubbock County, Texas, and located
in Section 34, Block AK, Georgetown RR Co. Survey, Abstract No. 850, Lubbock County,
Texas, and being situated within that certain 160.0137 acre tract of land conveyed to Escondido
Lubbock, LLC, described in a Special Warranty Deed recorded in County Clerk's File Number
2018012543 of the Official Public Records of Lubbock County, Texas, said drainage easement
contains 1.844 acres (previously called 80,338.7 sq. feet) of land being further described by
metes and bounds as follows:
BEGINNING at a point in the east right-of-way line of Xenia Avenue and the east plat limits of
Escondido Ranch, Lots 1 through 60 and Tract "A", an addition to the City of Lubbock, Lubbock
County, Texas, according to the map, plat and/or dedication deed recorded in County Clerk's
File Number 2019039180 of the Official Public Records of Lubbock County, Texas, for the
northwest corner of this easement and having coordinates of Northing: 7,262,363.30 and Easting:
906,441.82, Texas Coordinate System of 1983 (2011), Texas North Central Zone, whence the
northwest corner of said Section 34 bears N. 88° 08' 18" W. a distance of 1616.14 feet and N.
01 ° 51' 42" E. a distance of 1663.44 feet, said section corner having coordinates of Northing:
7,264,077.97 and Easting: 904,881.05, Texas Coordinate System of 1983 (2011), Texas North
Central Zone;
THENCE S. 880 08' 18" E. a distance of 261.97 feet to a point of curvature and a corner of this
easement;
THENCE Southeasterly, along a curve to the right, an arc distance of 1185.95 feet, said curve
having a radius of 755.00 feet, a delta angle of 90° 00' 00", a chord distance of 1067.73 feet and
a chord bearing of S. 43° 08' 18" E., to a point of tangency and a corner of this easement;
THENCE S. 010 51' 42" W., at a distance of 174.40 feet pass the northern right-of-way line of
58th Street, as dedicated in a Street Dedication Deed recorded in County Clerk's File Number
2020056904 of the Official Public Records of Lubbock County, Texas, continuing for a total
distance of 198.20 feet to a point of intersection in the north line of a Drainage Easement, as
described in a dedication deed recorded in County Clerk's File Number 2019039191 of the
Official Public Records of Lubbock County, Texas, for the southeast corner of this easement,
having coordinates ofNorthing: 7,261,377.81 and Easting 907,427.05, Texas Coordinate System
of 1983 (2011), Texas North Central Zone;
THENCE N. 88° 08' 02" W., along the north line of said Drainage Easement, a distance of 50.00
feet to a point of intersection for the most southerly southwest comer of this easement;
THENCE N. 010 51' 42" E., at a distance of 23.50 feet pass the northern right-of-way line of
said 58th Street, continuing for a total distance of 198.20 feet to a point of curvature and a comer
of this easement;
THENCE Northwesterly, along a curve to the left, an arc distance of 1107.41 feet, said curve
having a radius of 705.00 feet, a delta angle of 90° 00' 00", a chord distance of 997.02 feet and
a chord bearing of N. 43° 08' 18" W., to a point of tangency and a corner of this easement;

to the POINT OF BEGINNING. Bearings and coordinates are relative to the Texas Coordinate
System of 1983 (2011), Texas North Central Zone, as determined by a point of origin located at
Northing: 7,264,077.97 and Easting: 904,881.05. The convergence angle to True North is (-)01°
53' 54" and the combined scale factor is 0.99975647. Distances are at surface, in U.S. survey
feet. All corners are monumented with a 1/2" iron rod with a cap marked "AMD ENG" either
