HomeMy WebLinkAboutOrdinance - 2023-O0017 - Abandon And Close ROW In Lots 43-49, Section 16, Block E-2 - 03/07/2023"C-,,+yo� Reading Second Reading -N First _ N February 28, 2023 March 7, 2023 — m Item No. 5.6 Item No. 6.16 Ma �w ORDINANCE NO. 2023-00017 Y N l AN ORDINANCE ABANDONING AND CLOSING A PORTION OF STREET o RIGHT-OF-WAY (TROY AVENUE) LOCATED BETWEEN LOTS 43 THROUGH 49, o SECTION 16, BLOCK E-2, THE FALLS AT SUNCREST ADDITION TO THE CITY OF LUBBOCK, LUBBOCK COUNTY, TEXAS, WHICH IS MORE PARTICULARLY DESCRIBED IN THE BODY OF THIS ORDINANCE; DIRECTING THE CITY -'F ENGINEER TO MARK THE OFFICIAL MAPS OF THE CITY TO REFLECT SAID ABANDONMENT AND CLOSING; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION. WHEREAS, the City Council finds that the right-of-way hereinafter described in the body of this Ordinance is no longer needed for right-of-way purposes and for public use; and - it would be in the public interest to close, vacate and abandon the same for right-of-way purposes and for public use; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the right-of-way as hereinafter described shall BE and the same is hereby closed, vacated and abandoned for right-of-way purposes and for public use, such right-of-way being more particularly described in the attached Exhibit "A". SECTION 2. THAT the City Engineer is hereby authorized and directed to mark the official maps of the City of Lubbock to reflect said abandonment and closing, showing the number of this Ordinance and the date of its final passage. SECTION 3. THAT should any section, paragraph, sentence, phrase, clause or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary of the City of Lubbock is hereby authorized and directed to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law. BEGINNING at a 1/2" iron rod found with a cap inscribed "4460" in the east line of Lot 49 of said The Falls at Suncrest for the southwest corner of this tract. THENCE N. 430 11' 22" W., along said east line of said Lot 49, a distance of 77.44 feet to a 1/2" iron rod found with a cap inscribed "4460" at the beginning of a curve to the right for a corner of this tract. THENCE along said curve on the east line of Lots 48 and 49, at an arc distance of 51.84 feet pass a 1/2" iron rod found with a cap inscribed "4460" at the northeast corner of said Lot 49 same being the southeast corner of said Lot 48, a total arc distance of 103.67 feet having a radius of 132.00 feet, a chord bearing of N. 201 41' 22" W. and a chord distance of 101.03 feet to a 1/2" iron rod found at the end of said curve for a corner of this tract. THENCE N. 010 48' 38" E., along said east line of Lot 48, a distance of 70.05 feet to a 1/2" iron rod found with a cap inscribed "4460" at the northeast corner of said Lot 48 same being the southeast corner of Lot 46-A for a corner of this tract. THENCE N. 010 48' 38" E., along the east line of Lot 46-A, a distance of 154.00 feet to the beginning of a cul-de-sac curve to the right for a corner of this tract. THENCE along said curve having a radius of 43.00 feet, a chord bearing of S. 490 13' 49" E. and a chord distance of 66.87 feet, an arc distance of 193.57 feet to an "X" found at the end of said curve for an ell corner of this tract. THENCE S. 010 48' 38" W., along the west line of Lot 43 and 44, a distance of 182.00 feet to a 1/2" iron rod found at the beginning of a curve to the left for a corner of this tract. THENCE along said curve along the west line of Lot 43 having a radius of 80.00 feet, a chord bearing of S. 20° 41' 22" E. and a chord distance of 61.23 feet, an arc distance of 62.83 feet to a 1/2" iron rod found with a cap inscribed "HRA" at the end of said curve for a corner of this tract. THENCE S. 430 11' 22" E., along the west line of Lot 43, a distance of 77.44 feet to a 1/2" iron rod with cap inscribed "OJD ENG" set for the southeast corner of this tract.
