THIS IS THE FIRST AMENDMENT TO THE AGREEMENT No. 16180 dated and entered into the 16th day of November 2021 by and between the City of Lubbock ("City") and HDR Engineering, Inc. ("Engineer"), a Nebraska Corporation, for providing professional services for the design and bid of Erskine Street ("Project'). WITNESSETH: WHEREAS, the City desires to add additional servicves to the scope of the work to be performed by the Engineer on the Project. The new scope shall include project management, construction administration, and record drawings services. The details of work to be performed is set forth in "Exhibit A-l" attached to and incorporated herein. The term of the Agreement shall be extended an additional two (2) years to complete the services herein. WHEREAS, all other portions of the original Agreement shall remain in place and are not altered by this amendment. NOW, THEREFORE, the City and the Engineer agree to the terms of this FIRST AMENDMENT: IN WITNESS HEREOF, the parties have executed this Agreement as of this 7th day of March 2023. By: Justin W d, P.E., Vice President Page 2 of 2 EXHIBIT A-1 Engineering Scope of Services Erskine Street Reconstruction Frankford Ave. to City Limits City of Lubbock PROJECT UNDERSTANDING The City has requested HDR to provide construction phase services for the Erskine St. Reconstruction — Frankford Ave. to City Limits. This scope of services includes the following: • Project Management • Construction Administration • Record Drawings HDR shall perform the following Additional Services: Construction Phase Services 1.1. Project Management 1.1.1 Project Communication: Attend progress/coordination meetings with the City and/or Contractor during the Construction phase of the project (24 Virtual meetings, 4 in - person) 1.1.2 Project Administration: Prepare project correspondence and invoice documents 2.1. Construction Administration 2.1.1 Pre -Construction Meeting. Attend Pre -Construction Meeting prior to commencement of Work at the Site (in -person) 2.1.2 Review contractor pay applications. Review will be cursory review of monthly pay items and order of magnitude quantities as they relate to work performed. 2.1.3 Change Orders. Recommend Change Orders to City, as appropriate. Review and make recommendations related to Change Orders submitted or proposed by the Contractor. Task includes preparing plan sheet revisions. 2.1.4 Shop Drawings. Review shop drawings for conformance with the information given in the Contract Documents and compatibility with the design concept of the completed project as a functioning whole as indicated in the Contract Documents. Such review or other action will not extend to means, methods, techniques, equipment choice and usage, sequences, schedules, or procedures of construction or to related safety precautions and programs. 2.1.5 Respond to RFIs. Issue clarifications and interpretations of the Contract Documents to City as appropriate to the orderly completion of Contractor's work. Such clarifications and interpretations will be consistent with the intent of the Contract Documents. Field Orders authorizing variations from the requirements of the Contract Documents will be made by City. 2.1.6 Site Visits. Up to 4 Site Visits upon request 2.1.7 Construction progress meetings. Participate in monthly (24 ea) progress meeting in a virtual setting. 2.1.8 Final walkthrough (in person) 3.1. Record Drawings. Consultant will prepare a record drawing showing significant changes reported by the contractor or made to the design by the Consultant. Record drawings are not guaranteed to be as -build but will be based on information made available to the consultant. Limitation of Responsibilities. CONSULTANT shall not control or have charge of, and shall not be responsible for, construction means, methods, techniques, sequences, procedures of construction, health or safety programs or precautions connected with the work and shall not manage, supervise, control or have charge of construction. CONSULTANT shall not be responsible for the acts or omissions of construction contractor(s) or other parties on the project. The CITY agrees to contractually require its construction contractor(s) to include both the CITY and CONSULTANT as additional insureds on the construction contractor(s') general liability insurance. Exclusions Services not specifically identified in the Scope of Services above shall be considered out of scope work. Such services include, but are not limited to, the following: • Construction staking • Design of any offsite drainage improvements beyond the improvements identified inthe scope • Existing water or sanitary sewer relocations • Proposed water or sanitary sewer installations • Landscape design • Irrigation design • Construction management services • Design of structural retaining walls • Preparation for and attendance at public meetings • Assist the City as an expert witness in litigation about the project or in hearings before approving and regulatory agencies • Redesign to reflect project scope changes requested by the City, required to address changed conditions or change in direction previously approved by the City, mandated by changing governmental laws, or necessitated by the City's acceptance of substitutions proposed by the contractor SCHEDULE HDR is authorized to commence work on the project upon execution of this amendment. Services will be provided through March 16th, 2025.
