HomeMy WebLinkAboutResolution - 2023-R0111 - Unified Development Code Public Hearing NoticeResolution No. 2023-RO111 Item No. 6.5 February 28, 2023 RESOLUTION WHEREAS, Chapter 211 of the Texas Local Government Code (the "Code") establishes municipal zoning authority; and WHEREAS, when the governing body of a municipality changes or adopts zoning regulations and district boundaries, the governing body shall hold a public hearing regarding the regulations and boundaries being changed; and WHEREAS, Sec. 211.007(d) of the Code authorizes the governing body of a home -rule municipality to prescribe, by the passage of two-thirds vote, the type of notice to be given for the time and place of the public hearing; and WHERAS, Sec. 211.007(d) of the Code authorizes a joint public hearing with the Planning and Zoning Commission (the "PZC") to consider changes to, or adoption of, zoning regulations and district boundaries; and WHEREAS, in May of 2019 the City of Lubbock (the "City") hired a consulting firm in order to create new zoning regulations throughout the City in the form of a Unified Development Code (the "UDC"); and WHEREAS, the City Council of the City of Lubbock (the "Council") finds it to be in the public interest to conduct a jointly held hearing with the PZC for the public hearing at which botli bodies will consider the adoption of the UDC. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the City is a home -rule municipality; and THAT the Council hereby, by at least a two-thirds vote, prescribes the type of notice to bo given for the time and place of the jointly held public hearing with the PZC to consider tha adoption of the UDC. City of Lubbock Planning and Zoning Commission and City Council meetings are available to all persons regardless of disability. Public Notice The Planning and Zoning Commission and City Council will consider adoption of a Unified Development Code (UDC). The proposed UDC comprehensively revises and updates the City of Lubbock's current zoning, subdivision, and sign regulations. These regulations provide rules for developing both residential and commercial property and include what uses are permitted, how large structures can be, and what type of signage businesses are allowed, in addition to other zoning and subdivision regulations. A copy of the UDC may be viewed at www.mvlubbock.us.'udc and is available for viewing at Citizens Tower, 1314 Avenue K, first floor, in the lobby of the Planning Department. An amended zoning map will also be considered for adoption by the Planning and Zoning Commission and City Council at the public hearing. Public Hearing Discuss and take action to repeal Chapters 30, 32, 38, and 40 of the City of Lubbock Code of Ordinances, save and except Sections 40.02.070 through 40.02.084, Lubbock Preston Smith International Airport Hazard Area Zoning Regulations, and Sections 30.02.001 through 30.02.004, Lake Alan Henry, and repeal the Design Standards for the Central Business Districts, as adopted by Ordinance 10173, the Design and Development Regulations South Overton National Residential Historic District as adopted by Ordinance 2011-00072 and amended by Ordinance 2012-00047, and consider an ordinance to approve and adopt Chapter 39 Unified Development Code as part of the City of Lubbock Code of Ordinances. In addition, discuss and take action to amend Sections 8.04.064 (c)(1), 8.04.064 (d)(1), 8.19.003, and 8.19.006(9) to be consistent with Chapter 39 Unified Development Code, and repeal any provisions of the City of Lubbock Code of Ordinances in direct conflict with any provision of the Unified Development Code. In addition, discuss and take action to repeal the City of Lubbock Zoning Map, as adopted on 07-19-1975, by Ordinance 7084 and as may be amended, and consider an ordinance to approve and adopt a Zoning Map utilizing the new Zoning Districts in Chapter 39 Unified Development Code.
