RESOLUTION
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK
THAT the Mayor of the City of Lubbock BE and is hereby authorized and
directed to execute for and on behalf of the City of Lubbock, by and between the City of
Lubbock and the Texas Municipal League intergovernmental Risk Pool, an Addendum
#2 to the Worker's Compensation Interlocal Agreement, and related documents. Said
addendum is attached hereto and incorporated in this resolution as if fully set forth herein
and shall be included in the minutes of the City Council.
Passed by the City Council this 27th day of April 2000.

ADDENDUM #2 TO
WORKERS' COMPENSATION INTERLOCAL AGREEMENT

In consideration of the mutual promises herein contained, this Addendum amends the Workers'
Compensation Interlocal Agreement ("Agreement") dated March 25, 1999, and Addendum # 1
thereto, as follows:
1. Item number 2. of Addendum #1 is deleted and replaced by the following:
"The cost to the City for the renewal of this Agreement for the term beginning April 15,
2000 and ending October 1, 2000 will be the greater of:
a. $158,305, as a minimum cost, based on five (5) monthly payments of
$28,783 and one (1) payment of $14,391.50 beginning April 15, 2000, or,
b. 120% of paid claims for losses occurring from April 15, 2000 through September 30,
2000, until all claims are final, subject to a maximum cost of $555,094."
Both the minimum cost and maximum cost above shall be subject to final payroll audit at the
end of the term in accordance with paragraph 3 of section 5 of the Agreement.
2. The Texas Municipal League Intergovernmental Risk Pool and the City of Lubbock hereby
release, acquit and forever discharge each other and the other's officials, employees, and
agents, of and from any and all liability, claims, demands, damages, attorney fees, and costs,
whether statutorily provided or otherwise, expenses, services, actions, causes of action, or
suit in equity, for whatsoever kind or nature, which the Texas Municipal League
Intergovernmental Risk Pool or the City of Lubbock may now have or hereafter have, for
activities prior to April 15, 2000, relating to the taking of proposals and award of contract
for workers' compensation coverage.
3. It is further agreed that the amendments above supersede any and all conflicting provisions
contained in the Pool's responses to questions posed by the City of Lubbock in the letter
dated December 22, 1998 to the City from the Pool, attached as Exhibit "A" to Addendum
#1.

# Consider a Resolution to amend a contract between Texas Municipal League
Intergovernmental Risk Pool (TML-IRP) and the City of Lubbock to
provide Workers' Compensation Benefits.
BACKGROUND/DISCUSSION:
TML-IRP offers statutory workers' compensation benefits under a joint self-
insurance pool named the Texas Municipal League Workers' Compensation Joint
Insurance Fund. The City contracted with TML-IRP for a period beginning April 15,
1999 and ending April 15, 2000 with the option to renew from April 15, 2000 through
September 30, 2000 at the same prorated cost as the first year. TML has informed the
City that they cannot continue the coverage at a pro -rated premium as originally agreed,
however TML-IRP will continue the workers' compensation benefits at an increase in
costs.
In an effort to reflect the cost of coverage, and still be below the next closest proposer,
TML will provide workers' compensation benefits from April 15, 2000 through
September 30, 2000 on a sliding scale with a minimum cost of $158,305.00 and a
maximum cost of $555,094.00, subject to payroll audit.

SUMMARY/RECOMMENDATION:
Staff recommends signing Addendum #2 to the Workers' Compensation
Interlocal Agreement with TML-IRP to provide workers' compensation benefits
through September 30, 2000.
