RESOLUTION
WHEREAS, the City of Lubbock, Texas, a Home Rule Municipality located in
Lubbock County, Texas, has detennined and does hereby determine that the public needs,
safety and welfare demand and create a public necessity for the acquisition of additional
land for municipal public use and purposes, to -wit: for the East-West Freeway Railroad
Relocation Project, and the City Council of said City finds it in the public interest and for
public purposes and municipal purposes as set forth in the preamble hereof, to -wit:
NOW THEREFORE:
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LU13BOCK:
SECTION 1. THAT the fee simple title of the surface estate to the following
described parcel of land located in Lubbock County, Texas, be acquired for public
purposes and municipal purposes as set forth in the preamble hereof, to -wit:

SECTION 2. THAT the above -described parcel of land whose acquisition is
herein authorized is more particularly described as "Exhibit A" attached to this
Resolution and incorporated herein as part of this Resolution.
SECTION 3. THAT any and all offers previously made by the City of Lubbock
for the above described property are hereby rescinded and revoked.
SECTION 4. THAT the owners of the above -described parcel of land being Janie Rebecca
Wilbanks, A/KJA Janie R. Wilbanks, F/K/A Janie R. Bradford, and OSA Wilbanks, Jr.
BE offered through the Right -of -Way Department of the City of Lubbock the amount of
$23,900 indicated for this parcel, which is the amount appraised as the value and total
damages for the fee simple title and acquisition of the surface estate of said real estate,
for the use and benefit of the City of Lubbock, Texas, for the purposes herein stated, and
unless accepted forthwith, the City Attorney of said City of Lubbock, or its authorized
representatives, are hereby authorized and instructed to institute condemnation (eminent
domain) proceedings to acquire the fee simple title of the surface estate to any or all such
parcels as hereinabove described for public purposes and municipal purposes.

Being 3.52 hectares (8.71 acres) of land out of the West 1/2 of the Northeast quarter of
Section 6, Brooks and Burleson Survey, Block D-6, less -however, 1.63 acres conveyed to
the South Plains and Santa Fe Railway Company by deed from J.L. Sullivant and wife Rosa
Sullivant, dated March 13, 1925, recorded in Volume 99, Page 459, Deed Records of
Lubbock County, Texas, and less and except from the West '/z of the Northeast quarter of
said Section 6 and to be taken from the North end thereof, a strip of land amounting to
approximately 0.602 acres and being '/2 of the acreage conveyed to the State of Texas by
deed from the grantors herein, dated September 28, 1933 and recorded in Volume 181,
Page 215, Deed Records of Lubbock County, Texas, said West '/2 of the Northeast quarter
was conveyed by deed dated May 20, 1946 by C.R. Moore and wife Myrtle Moore to Osa
Wilbanks and wife Janie Rebecca Wilbanks and recorded in Volume 327, Page 335 of the
Deed Records of Lubbock County, Texas, which said 3.52 hectares (8.71 acres) is more
particularly described as follows;
BEGINNING at a '/2" Iron Rod with Cap, set in the South line of a tract of land described
in Volume 2595, Page 287 and in the proposed East Railroad Right -of -Way line, for the
Northeast and beginning corner of this parcel, whence the Northeast corner of Section 6,
Block D-6, bears North 02'24'07" East, 83.467 meters (273.84 feet) and South 87038'23"
East, 751.702 meters (2466.21 feet);
(1) THENCE South 02°32'58" West, along the proposed East Railroad Right -of -Way
line, a distance of 451.995 meters (1482.92 feet), to a '/z" Iron Rod with Cap, set in the
proposed East Railroad Right -of -Way line, for a corner of this parcel,

(2) THENCE Southeasterly, along the arc of a curve to the left and the proposed East
Railroad Right -of -Way line, an arc distance of 319.937 meters (1049.66 feet) to a '/2" Iron
Rod with Cap, set in the proposed Northerly Railroad Right -of -Way line, for a corner of
this parcel, said curve has a radius of 275.823 meters ( 904.93 feet ) and a chord that bears
South 30°40'48" East, 302.298 meters (991.79 feet);
(3) THENCE South 63°54'35" East, along the proposed Northerly Railroad Right -of -
Way line, a distance of 31.379 meters (102.95 feet), to a '/2" Iron Rod with Cap, set in the
existing North R.O.W. line of the West Texas and Lubbock Railroad and in the proposed
Northerly Railroad Right -of -Way line , for a corner of this parcel,
(4) THENCE North 69°45'58" West, along the existing North R.O.W. line of the West
Texas and Lubbock Railroad, a distance of 257.941 meters (846.26 feet), to a'/z" Iron Rod,
found for the Southwest comer of this parcel;
(5) THENCE North 02°33' 13" East, along the West line of the Northeast quarter of
said Section 6, Block D-6, a distance of 294.529 meters ( 966.30 feet ), to a 1/2" Iron Rod
with Cap, set in the proposed West Railroad Right -of -Way line for a comer of this parcel;
(6) THENCE Northeasterly, along the arc of a curve to the left and the proposed West
Railroad Right -of -Way line, an arc distance of 55.977 meters (183.65 feet), to a '/Z" Iron
Rod with Cap, set in the proposed West Railroad Right -of -Way line, for a corner of this
parcel, said curve has a radius of 275.823 meters (904.93 feet) and a chord that bears North
13051'21" East, 55.879 meters (183.33 feet);
(7) THENCE North 08' 15'42" Fast, along the proposed West Railroad Right -of -Way
line, a distance of 99.158 meters (325.32 feet), to a'/z" Iron Rod with Cap, set in the
proposed West Railroad Right -of -Way line, for a corner of this parcel;
(8) THENCE North 02°32'58" East, a distance of 190942 meters (626.45 feet), to a
'/z" Iron Rod with Cap, set in the South line of a tract of land described in Volume 2595,
Page 287, Deed Records of Lubbock County, Texas and in the proposed West Railroad
Right -of -Way line, for the Northwest corner of this parcel;
