HomeMy WebLinkAboutResolution - 6182 - Interlocal Agreement - City Of Lamar, Colorado - 02_11_1999Resolution No. 6182 Item No. 17 February 11, 1999 RESOLUTION BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the Mayor of the City of Lubbock BE and is hereby authorized and directed to execute for and on behalf of the City of Lubbock an Interlocal Agreement by and between the City of Lubbock and the City of Lamar, Colorado. Said Agreement is attached hereto and incorporated in this Resolution as if fully set forth herein and shall be included in the minutes of the Council. Sins; Ass"s it Attorney ALS: cp/lnlerlocal-LamarCO. res.doc ccdocs/February 3, 1999 qa Resolution No. 6182 Item No. 17 February 11, 1999 INTERSTATE COOPERATIVE AGREEMENT BY AND BETWEEN THE CITY OF LUBBOCK, TEXAS AND THE CITY OF LAMAR, COLORADO This Agreement entered into this 11th day of February , 1998, by and between the CITY OF Ll OCK, a Texas Home Rule Municipal Corporatiori (hereinafter called " City of Lubbock") and the CITY OF LAMAR, a Colorado Home Rule Municipal Corporation, (hereinafter called "City of Lamar"). WHEREAS, the establishment of the Southwest to Northwest International Trade Corridor (hereinafter called "the Corridor") has the potential of being an important and viable transportation link by and between Mexico, Canada, and the United States; and WHEREAS, the establishment of the Corridor through the Panhandel Plains and Colorado region could promote economic development for the cities and counties of this area; and WHEREAS, it is necessary to employ an engineering firm to conduct a study (hereinafter called " the Study") to survey the feasibility of establishing the Corridor; and WHEREAS, the parties desire to investigate the feasibility of establishing the Corridor and are willing to fund the Study and any associated administrative expenses. NOW THEREFORE, it is agreed between the parties hereto that: I. SCOPE OF SERVICE A. City of Lamar Responsibilities: City of Lamar agrees to pay $5,231.26, which is its proportional share of the expenses by population for the Study. City of Lamar agrees that said funds may be used for the funding of the Study and any or all operational costs or administrative expenses incurred by the City of Lubbock in implementing and administering the Study and incurred in the lobbying for or the promotion of the Corridor. B. City of Lubbock Responsibilities: City of Lubbock shall provide administrative services associated with the Study including any expenses related to the promotion and lobbying for the Corridor. The City of Lubbock shall also fund its proportional share of funding the Study and other related expenses. II. GENERAL CONDITIONS A. Term The term of this agreement shall be one (1) year from the date of execution. The parties agree that this Agreement may be renewed or extended as may be necessary. B. Hold Harmless The parties shall be responsible for their own respective claims, actions, suits, charges and judgments whatsoever that arise out of their respective performance or nonperformance of the subject matter called for under this Agreement. C. Amendments City of Lubbock or City of Lamar may amend this agreement at any time, provided that such amendments make specific reference to this Agreement, and are executed in writing, signed by a duly -authorized representative of both a4 organizations and approved by the City of Lubbock Council or City of Lamar Council if required by law. Such amendment shall not invalidate this Agreement, nor relieve nor release City of Lubbock or City of Lamar from its obligations under this Agreement. D. Revenues All revenues received by the City of Lubbock pursuant to this Agreement shall be placed in a special project fund in the City of Lubbock's general multi -purpose account. The City of Lubbock agrees to conduct an annual audit on the funds received pursuant to this Agreement. The status of funding shall be made available for City of Lamar's review. E. Compliance The City of Lubbock and City of Lamar agree to comply with all applicable federal, state and local laws and regulations governing the funds provided under this Agreement. UAN GEHLHAUSEN, MAYOR ATTEST: Betty auch, City Clerk APPROVED AS TO FORM: Thomas Shinn, City Attorney Resolution No. 6182 Item No. 17 February 11, 1999 ADDENDUM TO INTERSTATE COOPERATIVE AGREEMENT BY AND BETWEEN THE CITY OF LUBBOCK, TEXAS AND THE CITY OF LAMAR, COLORADO THIS ADDENDUM entered into this I Ith day of January, 1999, by and between the City of Lubbock, a Texas home rule municipal corporation (hereinafter called City of Lubbock) and the City of Lamar, a Colorado home rule municipal corporation (hereinafter called City of Lamar)_ WITNESSETH: WHEREAS, parties hereto are simultaneously entering into an agreement entitled INTERSTATE COOPERATIVE AGREEMENT BY AND BETWEEN THE CITY OF LUBBOCK, TEXAS AND THE CITY OF LAMAR, COLORADO, which agreement provides for a feasibility study to be performed to investigate the potential of establishing a transportation corridor between Mexico, Canada, and the United States, to the mutual benefit of both parties hereto, and WHEREAS, parties desire to more specifically define the aim and intent of said Interstate Cooperative Agreement; NOW, THEREFORE, in consideration of said concurrent agreement and the premises, the parties hereto do now agree as follows: 1. That said concurrent INTERSTATE COOPERATIVE AGREEMENT, above referenced, is hereby amended by the addition of the following paragraph II F, to -wit: F. Focus of efforts It being the intent of parties hereto that U. S. Highway 287, running through both of the respective parties hereto, shall be the designated vehicular transportation structure of the Corridor, all efforts and performance of the Study shall be toward the establishment of U. S. Highway 287 as the primary route and highway of the Corridor. 2, Except as hereinabove amended by addition, all provisions of said INTERSTATE COOPERATIVE AGREEMENT BY AND BETWEEN THE CITY OF LUBBOCK, TEXAS AND THE CITY OF LAMAR, COLORADO are hereby ratified and confirmed, in their entirety.
