WHEREAS, the City of Lubbock, Texas, a Home Rule Municipality located in Lubbock County, Texas, has determined and does hereby determine that the public needs, safety and welfare demand and create a public necessity for the acquisition of additional land for municipal public use and purposes, to -wit: for a testing facility site in conjunction with the treated effluent discharge line on FM 400, and the City Council of said City finds it in the public interest and for public purposes and municipal purposes as set forth in the preamble hereof, to -wit: NOW THEREFORE: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the fee simple title to following described parcel of land located in Lubbock County, Texas, be acquired for public purposes and municipal purposes as set forth in the preamble hereof, to -wit: METES AND BOUNDS DESCRIPTION of a 0.500 acre tract of land located in Section 64, Block S, Lubbock County, Texas, being further described as follows: BEGINNING at a 1/2" iron rod with cap set for the Northeast corner of this tract, which bears S. 89148'43" W., a distance of 1053.03 feet from the Southeast corner of Section 1, J.R. Robinson Survey; THENCE S. 00011' 17" E., a distance of 147.58 feet to a 1/2" iron rod with cap set for the Southeast corner of this tract; THENCE S. 8904843" W., a distance of 152.72 feet to a 1/2" iron rod with cap set in the East right-of-way line of F.M. 400 for the Southwest corner of this tract; THENCE Northeasterly, along the East right-of-way line of F.M. 400, around a curve to the left, said curve has radius of 2924.80 feet, a central angle of 02053'48", and a chord bearing of N. 03119'00" E., a distance of 147.86 feet to a 1/2" iron rod with cap set for the Northwest corner of this tract; THENCE N. 89048'43" E., a distance of 143.69 feet to the POINT OF BEGINNING. SECTION 2. THAT the owners of above -described parcel of land being Weldon B. Dillard and wife Wanda Peggy Dillard BE offered through the Right -of -Way Department of the City of Lubbock the amount of $1,000.00 which is the amount appraised as the value and total damages for the fee simple title, including all legal obligations attached thereto, for the use and benefit of the City of Lubbock, for the purposes herein stated, and unless accepted forthwith, the City Attorney of said City of Lubbock is hereby authorized and instructed to institute condemnation (eminent domain) proceedings to acquire the fee simple title to any or all such parcels as hereinabove described for public purposes and municipal purposes.
