RESOLUTION
WHEREAS, the resignation of Mayor David Langston on September 5, 1996, has created
a vacancy on the City Council of the City of Lubbock; and
WHEREAS, the City Charter of the City of Lubbock requires such vacancy to be filled by
a special election called for such purpose; and
WHEREAS, since the November uniform election date in even numbered years is not
available for a special election to fill a vacancy in municipal offices, the next available election date
complying with the requirements of the City Charter and Sections 41.001, 41.003 and 201.052 of
the Election Code is January 18, 1997; NOW THEREFORE:
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the Mayor pro tempore of the City of Lubbock is hereby authorized and directed
to execute an appropriate Order and Notice of Special Election for January 18, 1997, to fill the
vacancy in the position of Mayor.

SECOND AMENDED ORDER
OF
SPECIAL CITY ELECTION

I, ALEX "TY" COOKE, Mayor Pro Tempore of the City of Lubbock, Texas, by
virtue of the authority vested in me by law, and according to the Charter of the City of
Lubbock and the Texas Election Code, do hereby amend the Election Order issued by me
on the 1 st day of November, 1996, with regard to the Special City Election to be held
January 18, 1997, in the following respect:
Early voting by personal appearance shall commence on the 30th day of
December, 1996, and end on the 14th day of January, 1997. Said early voting shall be
conducted at the office of the City Secretary at 1625 13th Street, Room 206, on
weekdays, other than City holidays, during the regular hours of business of the office of
the City Secretary, which are from 8:00 A.M. to 5:00 P.M. and at branch offices for
personal appearance at South Plains Mall, 6002 Slide Road; Mahon Library, 1306 9th
Street; Godeke Library, 6601 Quaker Avenue; Groves Lift �uyr 5520 19th Street;
Patterson Library, 1836, Parkway Drive; and L-rxhbuck`jiew'ci, lstian-Church-Jennirigs
Hall, Ml 34th Street. The days of voting at the branch early voting locations shall be the
same as for the office of the City Secretary, except that South Plains Mall shall be open
for voting on New Year's Day. The hours of voting at the branch early voting locations
shall be from 9:00 A.M. to 6:00 P.M., except that 11 Fours Xit be 8:00 A.M.
to 5:00 P.M. In addition, the South Plains Mall location shall be open from 8 A.M. to 8
P.M. on the last two days of the early voting period. All branch early voting locations
shall be open on Saturdays during the early voting period.

ORDER AND NOTICE
OF
SPECIAL CITY ELECTION

I, Alex "Ty" Cooke, Mayor pro tempore of the City of Lubbock, Texas, by virtue
of the authority vested in me by law, and according to the Charter of the City of Lubbock,
the Texas Local Government Code, the Texas Election Code and a Resolution heretofore
duly enacted by the City Council of the City of Lubbock calling for a Special City
Election to be held in the City of Lubbock, Texas, on the 18th day of January, 1997, such
day being the third Saturday of said month and the first uniform election date available
for the purpose of electing the following named officer of the City of Lubbock due to the
resignation of Mayor David R. Langston on September 5, 1996.
MAYOR (UNEXPIRED TERM)
An electronic voting system shall be used for such election, including early
voting. Said Special City Election shall be held at the places in the City of Lubbock
hereinafter designated as voting precincts and in the voting places designated on Exhibit
A hereto. Said Exhibit A shall be made a part hereof for all intents and purposes. Polling
places shall be open from 7:00 A.M. to 7:00 P.M. and all electors shall vote in the
precinct of their residence unless such precinct shall be consolidated with another
precinct as provided herein in Exhibit A.
The persons named in Exhibit B hereto, which Exhibit B shall be a part hereof for
all intents and purposes, are hereby appointed Judges and Alternate Judges to conduct
said Special City Election on January 18, 1997. Each Presiding Judge so named is
authorized to appoint the number of clerks authorized by the Election Administrator,
which number shall be not less than two (2) clerks, nor more than six (6) clerks. The
Alternate Judges shall serve as Presiding Judges in the event that the regularly appointed
Presiding Judge is unable to serve. The Alternate Judge shall be appointed by the
Presiding Judge to serve as a clerk in the event that the election is conducted by the
regularly appointed Presiding Judge. The filing deadline for an application for a place on
the ballot shall be 5 p.m. of the 31 st day before election day (December 18, 1996).
Early voting by personal appearance shall continence on the 30th day of
December, 1996, and end on the 14th day of January, 1997. Said early voting shall be
conducted at the office of the City Secretary at 1625 13th Street, Room 206, on
weekdays, other than City holidays, during the regular hours of business of the office of
the City Secretary, which are from 8:00 A.M. to 5:00 P.M. and at branch offices for
personal appearance at South Plains Mall, 6002 Slide Road; United Supermarkets No.
503 (112 North University Ave.), 505 (401 Slide Road), 506 (1701 50th St.), 543 (8201
Quaker Ave.), 537 (2703 82nd St.) and 501 (2630 Parkway Dr.); and Lubbockview
Christian Church Jennings Hall (3301 34th St.). The hours and days of voting at the
branch early voting locations shall be the same as for the office of the City Secretary,
except that the South Plains Mall location shall be open from 8: 00 a.m. to 6:00 p.m.
The South Plains Mall location shall be open for voting by personal appearance
on the last Saturday and Sunday of the early voting period from 10:00 a.m. to 6:00 p.m.
on Saturday and 1:00 p.m. to 6:00 p.m. on Sunday. In addition, the South Plains Mall
shall be open for early voting by personal appearance the last two days of the early voting
period from 8:00 a.m. to 8:00 p.m.
The sealed ballot box procedure established by Subchapter C, Chapter 127, Texas
Election Code, shall be used for this Special City Election.
The City Secretary of the City of Lubbock is hereby ordered to cause publication
of this Special City Election by publication of this Order and Notice of Special City
Election in a newspaper of general circulation at least once no earlier than the 30th day or
later than the 1 Oth day before election day. In addition, a copy of this Order and Notice of
Special City Election shall be posted not later than the 21 st day before election day on the
bulletin board used for posting notices of meetings of the governing body and a notice of
consolidation shall be posted not less than 10 days before election day at any polling
places not consolidated at the last previous election which shall indicate the precinct's
consolidation and the location of the new polling place.
The City Secretary shall serve a duly certified copy of this Election Order and
Notice of Special City Election upon each of the Presiding Judges named in Exhibit B
hereto not later than the seventh day after the signing of this Election Order and Notice or
the 15th day before the election, whichever is later.
