RESOLUTION
WHEREAS, the Lubbock Housing Authority provides housing and supportive
services to families in the City of Lubbock with very low incomes; and
WHEREAS, without the housing provided by the Lubbock Housing Authority,
many of the above -described families would be living in over crowded, dilapidated
structures or could be homeless; and
WHEREAS, the Lubbock Housing Authority runs several programs focused on
breaking the cycle of poverty; and
WHEREAS, the City Council of the City of Lubbock recognizes that the above -
described services provided by the Lubbock Housing Authority provide a benefit to the
citizens of the City of Lubbock; and
WHEREAS, the City of Lubbock and the Lubbock Housing Authority enter into a
Cooperation Agreement dated August 24, 1995, for the Lubbock Housing Authority to
pay payment in lieu of taxes to the City of Lubbock ("the Agreement"); and
WHEREAS, the City Council of the City of Lubbock finds that forgiving the
amount currently owed by the Lubbock Housing Authority and for the FY 2002-2003 in
the Agreement is a public benefit to the City of Lubbock and serves a public purpose; and
WHEREAS, Lubbock Housing Authority owns certain steel it is willing to
transfer to the City in consideration for the waiver; and
WHEREAS, the City of Lubbock desires to use the forgiven amount owed under
the Agreement as match in its HOME Program.
NOW THEREFORE:
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the City Council of the City of Lubbock hereby forgives the Payment in
Lieu of Taxes payment currently due from Lubbock Housing Authority for the transfer of
the above -described steel owned by Lubbock Housing Authority to the City and that the
City Council of the City of Lubbock hereby designates the forgiven amount due under the
Agreement as match of its HOME Program.

Dear Mr. Tarbox:
Thank you for the opportunity to address the Housing Authority Board on the Payment in Lieu of
Taxes (PILOT) issue. I appreciate being able to answer questions regarding this matter. As
mentioned during the presentation, the City' of Lubbock values low cost housing in our
community and wishes to continue to work cooperatively with the Lubbock Housing Authority in
order to meet this very worthwhile goal.
Pursuant to your request, included in this correspondence is a copy of the latest results of the
PILOT Fees Survey conducted by the Community Development Department. The numbers
distributed at the Board meeting were the numbers given to the City Council in early May, 2002.
This copy contains additional information following the May, 2002 City Council meeting. With
this in mind, I am providing a copy of the additional information to the Council. Likewise, I am
including the spreadsheet with a detailed listing of who we contacted. I hope this proves
beneficial to you.
At the May 9, 2002, City Council work session, Council indicated their willingness to forgive the
past debt. To this end, staff will be preparing an agenda item, for the August 29, 2002, Council
meeting at which point Council will take formal action on the request to waive the $132,000.
Additionally, the request to waive the $32,000 fee due for the next fiscal year will be considered
at that same time as well. Please be prepared to attend this meeting. I have asked Nancy Haney
to contact your office when the meeting time is announced. As mentioned during my
presentation to the LHA Board, budget discussion filled the council meetings agenda on the 2°d
meeting in July and I` meeting in August. This item is being placed on the agenda as quickly as
possible based on the City of Lubbock's budgeting agenda.
If Council chooses not to waive the fee, staff will request that any PILOT money collected be
used by the City in a manner that will benefit Housing Authority residents with City projects in
the respective area. I regret any misunderstanding that might have resulted in the past from this
suggestion. Staff never intended the Housing Authority to use their funds in a manner that did
not meet HUD regulations. We were simply attempting to find a way to ensure that the City use
the funds in a manner that would benefit Housing Authority residents. Again, this is our
recommendation if the Council elects not to waive the fees.
On a similar note, if this helps the council in their determination of whether to grant the waiver,
we are prepared to accept the value of the steel fencing as partial payment of the fees. We would
accept the steel only if the steel is removed from the existing property (Greenfair) and delivered
to the City ready for use. This would equal a value of $102,200. If the Housing Authority does
not have the resources to prepare the steel for our use, the City will be forced to decline the
acceptance of the steel due to the $96,700 cost for the City to prepare the steel for use. Given
this scenario, we could purchase the actual steel for a lot less so it would not be a wise decision
for us to accept the steel under these conditions. I hope this answers any questions regarding the
process we are undertaking to consider the possible waiver of LHA PILOT fees. We certainly
understand your rationale regarding your request to waive the fees and look forward to working
with you in the future.

Pavment In Lieu Of Tax (PILOT Payment) Survey
A survey of Public Housing Authorities (PHA) in the state of Texas was conducted in
order to determine if these cities levied a payment in lieu of tax (PILOT). In order to
obtain a better response rate, a telephone survey of the PHA was used. The survey
determined the following results:
• 284 cities were contacted during the survey. 141 PHA responded to the survey
giving a 50% response rate. Of the 141 PHA that did respond the results are: 83
(59%) levied a PILOT tax on their housing authorities. 45 (32%) had a tax, but it
was withheld through agreement with the city. The remaining 13 (9%) PHA did
not make a PILOT payment but did not have a waiver from the city. There does
not appear to be a correlation between city size and PILOT payment, as the results
seem to be distributed evenly throughout the cities.
• The most common method of determining PILOT payment is by the use of HUD
Form 52267. This method is used by taking total rents collected, subtracting the
utility expenses of the PHA, and then taking ten percent of the total. This method
is used by 75% of all cities that levied a PILOT payment. 16% of PHA that levy
a PILOT payment used another method of determining the payment, 7% used the
value of the property, and less than 2% used a fixed rate.
• Department of Housing and Urban Development regulations (at 24 CFR 941.201
and 941.610) state that the locality and the Public Housing Authority (PHA) are to
enter into a standard cooperation agreement in which the city agrees to exempt the
PHA from all real and personal property taxes in exchange for the locality
accepting PILOT payments. The amount of these payments is to be determined

by agreement and be between zero and the amount of property tax normally
levied.
• According to the Cooperation Agreement between the City of Lubbock and the
Lubbock Housing Authority (LHA), PILOT payments are to be determined using
HUD Form 52267 and are due unless waived by the city. Resolution 5320 dated
July 25, 1996 stated that the LHA could defer payment of PILOT for fiscal year
1995. While this agreement allowed the LHA to defer payment for three years, it
still required LHA to make PILOT payments.
• Two cities had unique alternatives to the PILOT payment. The Brenham Housing
Authority employed a full time detective for the city who was on call when a
crime was committed on housing authority property. This task however,
accounted for only 20% of his time, and the remaining time he worked as a
regular city detective. Additionally, the housing authority employed off duty
police officers as ground maintenance thus providing the officers with an extra
income and further deterring crime on housing authority property. The Mathis
Housing Authority and the City of Mathis partnered by combining PILOT and
Community Development Block Grant (CDBG) funds for a public purpose such
as park construction and improvements around the housing authority.
