RESOLUTION
WHEREAS, the City of Lubbock, Texas, a Home Rule Municipality located in
Lubbock County, Texas, has determined and does hereby determine that the public
needs, safety and welfare demand and create a public necessity for the acquisition of
additional land for municipal public use and purposes, to -wit: for realignment of
Avenue O and Avenue P at 3' Street in conjunction with the Marsha Sharp
Freeway and the City Council of said City finds it in the public interest and for public
purposes and municipal purposes to proceed with the acquisition of lands as needed for
such purposes as aforesaid; NOW THEREFORE:
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT the fee simple title to the tracts of land further described
in Exhibit "A" and Exhibit "B" attached hereto, be acquired for public purposes and
municipal purposes as set forth in the preamble hereof.
SECTION 2. THAT the owner of said tracts, being Barclays Financial
Management, Inc., BE offered through the Right -of -Way Department of the City of
Lubbock the amount of $9,000.00 which is the amount appraised as the value and total
damages for the fee simple title and acquisition of said real estate purposes herein
stated, and unless accepted forthwith, the City Attorney of said City of Lubbock is
hereby authorized and instructed to institute condemnation (eminent domain)
proceedings to acquire the fee simple title.

Addition_ a replat of Block One (1), Block Four (4) and South 65.3 feet of Block Two (2),
Richmonv Addition, the North 100 feet of Block Two (2), Richmond Addition and a portion of
Block Three (3), Richmond Addition to the City of Lubbock., Lubbock County, Texas and
conveyed to Barclays Financial Management, Inc. and recorded in Volume 6438, Page 165 of the
Real Property Records of Lubbock County, Texas, which said 0_02 acres (981 Sq. Ft.) of land is
more particularly described as follows:
BEGE\--N-ING at a railroad spike, found in the existing East right-of-way line of Avenue "P" and
in the existing South right-of-way line of 3'd Street for the No,, �hwest corner of said Block 3'
Richmond Addition and for the Northwest and beginning corner of this parcel-,
(1) THENCE South 87°3646" East, along the existing South right-of-way line of 3rd Street
and the North line of said Block 3, Richmond Addition, 34.40 feet to an "X" on rail, found for
the Northeast corner of this parcel;
(2) THENCE South 02°30'10" West, 42.97 feet to a '/z" iron rod with cap, set in the
proposed West right-of-way line of said Avenue "O" for the Southeast corner of this parcel;
(3) THENCE Northwesterly along the arc of a curve to the right and along the proposed
West right-of-way line of Avenue "O", an arc distance of 45.96 feet to a '/z" iron rod with cap, set
in the existing East right-of-way line -of Avenue "P" and the West line of said Block 3, Richmond
Addition, for the Southwest corner of this parcel, said curve has a radius of 262.50 feet, a central
angle -of 10'01'54", and a chord that bears North 45°58'32" West with a distance of 45.90 feet;

and the West line of said Block 3, Richmond Addition, 12.47 feet to the P.O.B., of which
