BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the Mayor of the City of Lubbock BE and is hereby authorized and directed to
execute for and on behalf of the City of Lubbock a Partial Paving Release concerning certain
paving units which were deleted from the 1993 Assessment Paving Program, and also to release
certain abutting properties for which no assessments were needed, attached hereto and which
shall be spread upon the minutes of the Council and as spread upon the minutes of this Council
shall constitute and be a part of this Resolution as if fully copied herein in detail.

WHEREAS, by Resolution passed by the City Council on April 13, 1995, determining
the necessity for making certain street and alley improvements as therein designated, which
Resolution was filed of record in Volume 4851, Pages 145-150 (inclusive) of the Official Real
Property Records of Lubbock County, Texas, reference to which record is made for all pertinent
purposes; and
WHEREAS, the City Council of the City of Lubbock finds and determines that the liens
and/or clouds against certain properties created by the filing of such Resolution should be
released against such abutting properties as are hereinafter described for the reasons hereinafter
stated; NOW THEREFORE:
KNOW ALL MEN BY THESE PRESENTS:
I.
The following described properties are hereby released and quitclaimed under Unit No.
A-461-34 because no assessments were made against such properties after the public hearing
thereon because of existing paving, to -wit:
ADDITION -- Whisperwood Subdivision
LOTS -- 30, 31, 32 and 33.
II.
The following described properties are hereby released and quitclaimed under Unit No.
A-461-35 because no assessments were made against such properties after the public hearing
thereon because of existing paving, to -wit:
ADDITION -- Whisperwood Subdivision
LOTS •- 41, 49-A-1, 49-A-2, 49-B-1, 49-B-2, 50-A-1,
50-13-1, 51-A-1, 51-13-1 and 52-A-1.
The following described property is hereby released and quitclaimed under Unit No.
A-461-36 because no assessment was made against such property after the public hearing thereon
because of existing paving, to -wit:

LOT -- 143.

The following described properties are hereby released and quitclaimed under Unit No.
2035-94 because no assessments were made against such properties after the public hearing
thereon because of existing paving, curb and gutter, to -wit:

LOTS -- A-1, 13, 14, 38, 39, 62, 63, 78, 79,108,
109, 144, 145, 172, 173, 200 and 201.
(B) ADDITION -- Farrar Estates Subdivision
LOTS -- 573, 574, 597, 598, 621, 622, 645, 646,
669, 670, 693, 694, 719 and 720.
(C) ADDITION -- Farrar Estates Subdivision

The following described properties are hereby released and quitclaimed under Unit No.
2035-94 because no assessments were made against such properties after the public hearing
thereon because of existing curb and gutter and prepaid paving, to -wit:

LOTS -- 48, 49, 50, 51, 52, 53, 54, 55, 56, 57,
58, 59, 60, 61, 62, 63 and 64.

The following described properties are hereby released and quitclaimed under Unit No.
2035-95 because no assessments were made against such properties after the public hearing
thereon because of existing curb and gutter and prepaid paving, to -wit:

2035-95 because no assessments were made against such properties after the public hearing
thereon because of existing curb and gutter and prepaid paving, to -wit:

LOTS -- 1, 15, 16, 30, 31, 45, 46, 60, 61 and 77.
XV.
The following described property is hereby released and quitclaimed under Unit No.
2035-95 because no assessment was made against the property after the public hearing thereon
because the proposed paving improvements are below the high-water mark of the lake in which
such paving improvements are located or to be located and because the property is owned by the
City of Lubbock, to -wit:
BEGINNING at a point which bears South a distance of 215.04 feet and East a
distance of 184.82 feet from the Northeast comer of Section 16, Block E-2,
Lubbock County, Texas;
THENCE North 89 degrees 59 minutes 17 seconds West along the North right-of-
way line of 98th Street a distance of 710.97 feet to a point of curvature;
THENCE Northwesterly along the North right-of-way line of 98th Street around a
curve to the right an arc distance of 327.63 feet to a point, said curve having a
radius of 899.93 feet and a central angle of 20 degrees 51 minutes 32 seconds;
THENCE North 69 degrees 07 minutes 45 seconds West along the North right-of-
way line of 98th Street a distance of 406.75 feet to a point of curvature;
THENCE Northwesterly along the North right-of-way line of 98th Street around a
curve to the left an arc distance of 207.55 feet to a point, said curve having a
radius of 1009.93 feet and a central angle of 11 degrees 46 minutes 30 seconds;

THENCE North 09 degrees 04 minutes 19 seconds East a distance of 10.00 feet to
a point;
THENCE Southeasterly around a curve to the right an arc distance of 209.61 feet
to a point; said curve having a radius of 1019.93 feet, and a central angle of 11
degrees 46 minutes 30 seconds;
THENCE South 69 degrees 07 minutes 45 seconds East a distance of 406.75 feet
to a point of curvature;
THENCE Southeasterly around a curve to the left an arc distance of 323.98 feet to
a point, said curve having a radius of 889.93 feet and a central angle of 20 degrees
51 minutes 32 seconds;
THENCE South 89 degrees 59 minutes 17 seconds East a distance of 710.97 feet
to a point;
THENCE South 00 degrees 00 minutes 43 seconds West a distance of 10.00 feet
to the POINT OF BEGINNING.
XVI.
The following described properties are hereby released and quitclaimed under Unit No.
2035-95 because no assessments were made against such properties after the public hearing
thereon because of existing curb and gutter and prepaid paving, to -wit:

LOTS -- 551, 552, 557, 558 and 560.
XVII.
The following described properties are hereby released and quitclaimed under Unit No.
2035-95 because no assessments were made against such properties after the public hearing
thereon because of existing curb and gutter and prepaid paving, to -wit:
ADDITION -- Lakeridge Country Club Estates Subdivision
LOTS -- 324, 325, 337, 338, 350, 351, 360, 361 and 373.
XVIII.
The following described property is hereby released and quitclaimed under Unit No.
2035-95 because no assessment was made against such property after the public hearing thereon
because of existing curb and gutter and prepaid paving, to -wit:
ADDITION -- Lakeridge Country Club Estates Subdivision
LOT -- 617.
XIX.
The following described properties are hereby released and quitclaimed under Unit No.
2035-95 because no assessments were made against such properties after the public hearing
thereon because of existing curb and gutter and prepaid paving, to -wit:
ADDITION -- Lakeridge Country Club Estates Subdivision
LOTS -- 793, 794 and 795.

The following described properties are hereby released and quitclaimed under Unit No.
2035-95 because no assessments were made against such properties after the public hearing
thereon because of existing curb and gutter and prepaid paving, to -wit:
ADDITION -- Lakeridge Country Club Estates Subdivision
LOTS -- 932, 933, 938 and 939.
X.I.
All of the properties to which this partial release is applicable as hereinabove described
are located within the corporate limits of the City of Lubbock, Lubbock County, Texas, and this
release is only applicable to the properties hereinabove specifically described. All interests
and/or liens not specifically herein released are hereby retained by the City of Lubbock.
