HomeMy WebLinkAboutResolution - 2002-R0219 - Ratification General Warranty Deed - Market Lubbock Economic Development - 06_13_2002Resolution No. 2002-RO219 June 13, 2002 Item No. 28 RESOLUTION BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the Mayor of the City of Lubbock BE and is hereby authorized and directed to execute for and on behalf of the City of Lubbock a Ratification of General Warranty Deed, and any other related documents, ratifying that certain General Warranty Deed, dated June 6, 2002 , conveying that certain 38.98 acre tract to Market Lubbock Economic Development Corporation, a Texas not -for -profit corporation. Said Ratification of General Warranty Deed is attached hereto and incorporated in this Resolution as if fully set forth herein and shall be included in the minutes of the Council. Box 2000 y���Q/ Lubbock, Texas 79457 V111, 7701?AGE294 -^ RATIFICATION OF GENERAL WARRANTY DEED 2,'3'6( ';� KNOW ALL MEN BY THESE PRESENTS THAT, WHEREAS, on the 6th day of June, 2002, the City of Lubbock executed and delivered that certain General Warranty Deed to Market Lubbock Economic Development Corporation, d/b/a Market Lubbock Inc., a Texas not -for -profit organization, conveying the lands described on Exhibit "A", attached hereto (the "General Warranty Deed"); WHEREAS, the Mayor of the City of Lubbock, was duly authorized to execute the General Warranty Deed by Resolution No. 2002-R0214, passed by the City Council of the City of Lubbock on May 23, 2002; WHEREAS, nothwithstanding the authority of the Mayor of the City of Lubbock to execute the General Warranty Deed, the City of Lubbock now desires to ratify the General Warranty Deed to remove any uncertainty regarding such matter. NOW, THEREFORE, in consideration of the sum of One and No/100 Dollar ($1.00) and other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the City of Lubbock does hereby ratify, adopt and confirm the General Warranty Deed, in all of its terms and provisions, and acknowledges the validity, effect, and enforceability of the General Warranty Deed.
