RESOLUTION AND ORDER
WHEREAS, the Franklin Water Service Company has heretofore filed a Notice of
Proposed Rate Change (the "Application") with the City of Lubbock on or about August
1, 2001, for the customers and areas described therein; and
WHEREAS, in excess of ten percent (10%) of the rate payers of Franklin Water
Service Company affected by the Application complained of the rate change; and
WHEREAS, pursuant to Chapter 13 of the Texas Water Code, the City Council of
the City of Lubbock, as the rate making body, has held a hearing to determine the rates of
Franklin Water Service Company;
WHEREAS, at the hearing the City Council of the City of Lubbock heard
evidence regarding the requested rate change and after careful consideration of same,
now finds that the rates requested by Franklin Water Service Company are just and
reasonable;
NOW THEREFORE BE IT RESOLVED AND ORDERED BY THE CITY COUNCIL
OF THE CITY OF LUBBOCK:
THAT pursuant to Chapter 13 of the Texas Water Code, the Franklin Water
Service Company shall be entitled to place into effect such proposed rate change as
specified in the Notice of Proposed Rate Change attached hereto as Exhibit "A", effective
either September 1, 2001 or the date the proposed rate was first charged by Franklin
Water Service Company to its ratepayers, whichever was the later to occur.
FURTHER, BE IT ALSO RESOLVED AND ORDERED that Franklin Water
Service Company reimburse the City of Lubbock the amount of Two Thousand Six
Hundred Ninety -Seven and 501100 Dollars ($2,697.50) for costs and expenses incurred
by the City of Lubbock in engaging rate consultants to advise and represent the City of
Lubbock in its rate making proceeding.
FURTHER, BE IT ALSO RESOLVED AND ORDERED that Franklin Water
Service Company be entitled to recover from the affected rate payers Two Thousand Six
Hundred Ninety -Seven and 501100 Dollars ($2,697.50), together with interest at the rate
of four per cent (4%) through its monthly rate billing, beginning in March of 2002 and
ending twenty-four (24) months therefrom.

Has submitted a rate change application with the City of Lubbock. The proposed rates listed on the next
page will apply to service received after the effective date provided below. if the City receives protests to
the proposed rate increase from 10 percent of the ratepayers or from any affected municipality within 60
days of the proposed effective date, a public hearing will be scheduled to determine if the proposed rates

# Consider a resolution approving the Community Development Service Board's
recommendation for the reallocation of 2001 CDBG grant funds and all related
documents.
BACKGROUND/DISCUSSION:
On February 13, 2002 The Community Development Services Board met to
discuss the reallocation $75,000 in unspent 2001 CDBG funds. The CDSB
reviewed project applications from Spring 2001 that were either not funded or
under -funded, as well as considered new projects recommended by staff. After
much discussion, the Board voted unanimously to approve the following funding
recommendations:
Parkway Guadalupe Neighborhood Centers Renovation
North University Fagade
Community Recreation Survey
SUMMARY/RECOMMENDATION:
Community Development Staff supports the Boards recommendations.
