HomeMy WebLinkAboutResolution - 2002-R0069 - Local Transportation Project Advance Funding Agreement - 50Th St. & Loop - 03_28_2002Resolution No. 2002-R0069 February 28, 2002 Item No. 22 RESOLUTION BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the Mayor of the City of Lubbock is hereby authorized and directed to execute for and on behalf of the City of Lubbock an Amendment 91 to the Local Transportation Project Advance Funding Agreement for Surface Transportation Urban Mobility Rehabilitation (#CSJ: 0905-06-046) for 50t' Street between Loop 289 and Slide Road between the City and the Texas Department of Transportation, a copy of which Amendment 91 is attached hereto and which shall be spread upon the minutes of this Council and as spread upon the minutes of this Council shall constitute and be a part hereof as if fully copied herein in detail. County: Lubbock CSJ: 0905-06-046 Project No: STP 99(510) UM Location: Loop 289 to Slide Road ADVANCE FUNDING AGREEMENT AMENDMENT#1 THIS AMENDMENT IS MADE BY AND BETWEEN the State of Texas, acting through the Texas Department of Transportation, hereinafter called the State, and the City of Lubbock, Texas, a Texas City, acting by and through its duly authorized officials, hereinafter called the Local Government. WITNESSETH WHEREAS, the State and the Local Government executed a contract on 30`h day of October, 2001 to effectuate their agreement to Widening of 501h Street in Lubbock from Loop 289 to Slide Road; and, WHEREAS, it has become necessary to amend that contract; NOW THEREFORE, in consideration of the premises and of the mutual covenants and agreements of the parties hereto, the State and the Local Government do agree as follows: AGREEMENT Article 1. Description of Amended Items The removal of state participation for E&C Indirect Cost of $67,173.91 and the addition of local participation for E&C Indirect Cost of $67,173.91, resulting in a change in the total local participation from $840,620.54 to $907,794.45. (See Attachment) All other provisions of the original contract are unchanged and remain in full force and effect. Article 2. Signatory Warranty The signatories to this amendment warrant that each has the authority to enter into this agreement on behalf of the organization they represent. IN WITNESS WHEREOF, THE STATE AND THE LOCAL GOVERNMENT have executed duplicate counterparts to effectuate this agreement. Based on the funding Category 41), the City's participation is 20% of the cost of this particular improvement and the other 80% will be paid for with federal funds. The City's estimated construction. participation of this additional work is $907,794.45, including construction items, and engineering and contingencies. City's Participation (20%) = $907,794.45 It is understood that the proposed improvements will be done by the State and the City will transmit to the State with the return of this Agreement, executed by the City, a warrant or check in the amount of $907,794.45 made payable to the "Texas Department of Transportation" to be used solely for the cost of improvements as requested by the City. It is further understood that the State will include only those items for the improvements as requested and required by the City. This is a construction estimate only, final participation amounts will be based on actual charges to the project. Page 15 of 15
