HomeMy WebLinkAboutResolution - 2002-R0030 - Resolution Accepting And Approving Budget Submitted By LPD - 01_23_2002Resolution No. 2002-R0030 January 23, 2002 Item No. 36 RESOLUTION WHEREAS, Article 59.06 of the Texas Code of Criminal Procedure provides for the disposition of forfeited property seized by law enforcement officers in the performance of their duties; and WHEREAS, Article 59.06(d) of such Code provides that proceeds awarded to a law enforcement agency may be spent by the agency after a detailed budget for the expenditure of the proceeds has been submitted to the governing body of the municipality for that agency; NOW THEREFORE: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK, TEXAS: THAT the Council hereby accepts and approves the budget submitted by the Lubbock Police Department for the expenditure of proceeds awarded to the Department and the South Plains Regional Narcotics Task Force in accordance with Article 59.06 of the Texas Code of Criminal Procedure. Texas Code of Criminal Procedure article 59.06, Section d, which reads in part; a special fund in the municipal treasury if distributed to a municipal law enforcement agency, to be used solely for law enforcement purposes, such as salaries and overtime pay for officers, officer training, specialized investigative equipment and supplies, and items used by officers in direct law enforcement duties; ... a commissioners court or governing body of a municipality may not use the existence of an award to offset or decrease total salaries, expenses, and allowances that the agency or the attorney receives from the commissioners court or governing body at or after the time the proceeds are awarded ... The budget for the funds forfeited to the Lubbock Police Department and the South Plains Regional Narcotics Task Force is outlined below: Lubbock Police Department Special Investigations Fund $131,467 Expenses include computer equipment, software, lab equipment, SWAT equipment, training and travel expenses and building renovation. mcm disk #4/a:Forfeited Fund Budget for Special Ops 2002 1 South Plains Regional Narcotics Task Force Program Income $250,588 Expenses include cash match for Task Force grant, office and investigative equipment for Task Force officers. The Texas Narcotics Control program controls generated program income and expenditures for the grant. Confidential Informant Fund $60,091 Used for the purchase of information and evidence. The following two accounts have been added to meet the requirements that recently became effective. The monies were formerly kept in the same account as the Special Investigations Fund. The Federal Government now requires that money from asset sharing will be separated and accounted for according to the source. Department of Treasury Asset Sharing $7,455 Expenses include computer equipment, software, lab equipment, SWAT equipment, training and travel expenses and building renovation.
