HomeMy WebLinkAboutResolution - 4748 - Interlocal Service Agreement - TTU - Thenet 56Kbps Digital Data Service - 02_23_1995Resolution No. 4748 February 23, 1995 Item #5 RESOLUTION BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the Mayor of the City of Lubbock BE and is hereby authorized and directed to execute for and on behalf of the City of Lubbock an Interlocal Service Agreement with Texas Tech University to provide the City with access to THEnet for 56Kbps Digital Data Service via a Cisco Systems router, attached herewith, which shall be spread upon the minutes of the Council and as spread upon the minutes of this Council shall constitute and be a part of this Resolution as if fully copied herein in detail. This Agreement entered into on this 23rd day of February , 1995, is between the CITY OF LUBBOCK (City) and TEXAS TECH UNIVERSITY, pursuant to Chapter 791, Government Code. 2. In this Agreement, Texas Tech University will provide the City with access to THEnet for 56Kbps Digital Data Service via a Cisco Systems router. THEnet access must be for non-commercial purposes and is for the sole use of the City, City of Lubbock employees, and City services. Access to THEnet may not be granted or sold to any other entity, organization, or individual. 3. This Agreement will begin on the date of execution and will be in effect until August 31, 1995. 4. The City will provide all equipment local to their site required for proper operation and be responsible for maintaining such equipment in working order. 5. The City is responsible for obtaining a 56Kbps Digital Data Service circuit from Southwestern Bell beginning at the City point -of -presence and ending at the Porter - Sherwood Central Office. 6. Texas Tech University will not be responsible for problems associated with network outages nor be liable for any damages resulting from such. 7. The City agrees to pay Texas Tech University a one-time installation charge of $950.00, which is due upon the effective date of this Agreement. 8. The City agrees to pay Texas Tech University a monthly THEnet access fee of $100.00, which is due on the first day of each month. 9. The City agrees to pay Texas Tech University a monthly telecommunications circuit charge of $66.50, which is due on the first day of each month for a 56Kbps digital circuit from the Porter -Sherwood Central Office to Texas Tech University. 10. All payments shall be made from current revenues available to the paying party. 11. This Agreement may be modified by written mutual consent only. 12. Additional one-year periods of access may be granted upon mutual consent of the parties. 13. This Agreement may be terminated by either party with ninety (90) days written notification sent to the follows: Texas Tech University Computing Network Services P. O.
