RESOLUTION
WHEREAS, an 33,786 square foot tract of land out of Lot 1, Gilbert Addition to the
of Lubbock, Lubbock County, Texas, is hereby determined to be surplus to the needs of the
of Lubbock and can be sold, due to its size and shape, without bid procedures or publication
'uttm owners for its fair market value pursuant to Section 272.001 of Vemon's Texas Codes

WHEREAS, said land has an appraised fair market value of $67,572.00, and abutting
DON E. McMl U , has offered to purchase said land, and this City Council has hereby
ned that it would be in the public interest to sell said land to said abutting owner at said fair
value; NOW THEREFORE:
IT RESOLVED BY THE MY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT said We as hereinabove set forth in the preamble hereof is hereby
approved.
SECTION 2. THAT the Mayor of the City of Lubbock is hereby authorized and directed
to execute a Special Warranty Deed from the City of Lubbock unto the said DON E.
McINTURFF, as Grantee, for a consideration of $67,572.00 in cash paid to the City of Lubbock
by said Grantee, a copy of which Deed is attached hereto and shall be spread upon the minutes of
this Council, and as so spread upon said minutes shall constitute and be part hereof as if fully
copied herein in detail.

SPECIAL WARRANTY DEED
KNOW ALL MEN BY THESE PRESENTS:
THAT the CITY OF LUBBOCK, acting through its Mayor hereunto d authorized,
herein called "GRANTOR", for and in consideration of sum of TEN AND NO1100 ($10.00)
DOLLARS, and other good and valuable consideration to GRANTOR in hand paid by DON E.
McINTURFF, herein called "GRANTEE", in cash, the receipt and sufficiency of which is hereby
acknowledged and confessed, and for the payment of which no right or lien, express or implied, is
retained:
Has GRANTED, SOLD and CONVEYED, and by these presents does GRANT, SELL
and CONVEY unto the said GRANTEE all that certain tract and parcel of land lying and being
situated in Lubbock County, Texas, as follows:
METES AND BOUNDS DESCRIPTION of a portion of Lot 1, Gilbert
Addition to the City of Lubbock, Lubbock County, Texas, according to the
map, plat and/or Dedication Deed thereof recorded in Volume 3433, Page
206, and a portion of that tract conveyed to William T. Stadley and Delmar
W. Stone in Volume 3281, Page 63 of the Real Property Records of
Lubbock County, Texas, located in Section 27, Block E-2, Lubbock,
Lubbock County, Texas, being further described as follows:
BEGINNING at a'h" iron rod with cap set in the West right-of-way line of
Slide Road which bears S. 00°03'50" E., a distance of 1045.71 feet and S.
89157'30" W., a distance of 60.00 feet from the Northeast comer of
Section 27, Block E-2, Lubbock, Lubbock County, Texas;
THENCE Southwesterly around a curve to the right, said curve having a
radius of 30.00 feet, a central angle of 90*01'20", tangent lengths of 30.01
feet and a chord distance of 42.43 feet to a '/2" iron rod with cap set for a
point of tangency,
THENCE S. 89057'30" W., a distance of 69.97 feet to a'/" iron rod with
cap set for a point of intersection;
THENCE S. 87051'30" W., a distance of 150.10 feet to a'A" iron rod with
cap set for a point of intersection;
THENCE S. 89057'30" W., a distance of 64.51 feet pass a 'A" iron rod
with cap set in the West line of Lot 1, Gilbert Addition, continuing for a
total distance of 473.69 feet to a 'h" iron rod with cap set for a point of
curvature;
THENCE Northwesterly around a curve to the right, said curve having a
radius of 477.30 feet, a central angle of 23°54'03", tangent lengths of
101.02 feet, and a chord distance of 197.66 feet to a 'A" iron rod with cap
set in the North line of said Stadley/Stone Tract;
THENCE N. 89057'30" E., along the North line of said Stadley/Stone
Tract, a distance of 602.55 feet pass the Northeast comer of said
Stadley/Stone Tract and the Northwest comer of Lot 1, Gilbert Addition,
continuing along the North line of said Lot 1, Gilbert Addition aW the
South line of that tract conveyed to Don E. Mclnturff in Volume 1336,
Page 274 of the Deed Records of Lubbock County, Texas, for a total
distance of 917.05 feet to a point in the West right-of-way line of Slide
Road for the Northeast corner of said Lot 1;
THENCE S. 00°03'50" E., along the West right-of-way line of Slide Road,
a distance of 5.42 feet to the POINT OF BEGINNING.
TO HAVE AND TO HOLD the above described premises, together with all and singular,
the rights and appurtenances thereto in anywise belonging to the said GRANTEE, his heirs and
assigns forever, and the said GRANTOR does hereby bind itself its successors and assigns to
WARRANT and FOREVER DEFEND all and singular the said premises unto the said
GRANTEE, his heirs and assigns, against every person whomsoever lawfully claiming, or to claim
the same, or any part thereof by, through, and under GRANTOR.
