RESOLUTION
WHEREAS, the resignation of Councilman Gary Phillips, Councilman,
Place 5, occurred on the 27th day of February, 1992, as a result of said
Councilman announcing his candidacy for Mayor; and
WHEREAS, such resignation occurred by operation of law in accordance
with Article 11, Section 11, of the Constitution of the State of Texas; and
WHEREAS, such resignation has created a vacancy on the City Council
of the City of Lubbock; and
WHEREAS, Article 9, Section 3, of the Charter of the City of Lubbock
requires that such vacancy be filled by special election; and
WHEREAS, the next available election date complying with the Texas
Constitution, Article 11, Section 11 and 41.001 of the Texas Election Code
is the first Saturday in May (May 2, 1992); and
WHEREAS, under Section 3.004(b) the governing body of the City of
Lubbock is required to order a special election to fill said vacancy; and
WHEREAS, an order and notice of special election is attached to this
resolution as Exhibit A and made a part hereof for all intents and
purposes; NOW THEREFORE:
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the City Council hereby authorizes a special election to be held
on May 2, 1992, for the purposes of filling the vacancy created by the
resignation of Councilman Phillips for the unexpired term remaining for the
position of Council Member, Place 5.
BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the Mayor is hereby authorized and directed to execute an order
and notice of special election setting a special election to fill the
vacancy in the position of Council Member, Place 5, for Saturday, May 2,
1992.

I, B. C. "Peck" McMINN, Mayor of the City of Lubbock, Texas, by virtue
of a resolution adopted by the City Council of the City of Lubbock and the
authority vested in me by law, and in accordance with the Charter provisions
and the Texas Election Code, do hereby order that a Special Election be held
in the City of Lubbock, Texas, on the 2nd day of May, 1992, said date being
the first Saturday in May, for the purpose of electing the following officer
of the City of Lubbock due to the resignation of Councilman, Place 5, on
February 27, 1992:
COUNCIL MEMBER, PLACE 5 (unexpired term)
Said election shall be held at the places in the City of Lubbock
hereinafter designated as voting precincts and voting places on Exhibit A
attached hereto and made a part hereof for all intents and purposes. Polling
places shall be open from 7:00 A.M. to 7:00 P.M., and all electors shall vote
in the precinct of their residence unless otherwise provided herein. An
electronic voting system shall be used for this Special City Election.
The persons set forth in Exhibit B, which is attached hereto and made a
part hereof for all intents and purposes, are hereby appointed Judges and
Alternate Judges to hold said Special City Election on May 2, 1992. Each
Presiding Judge so named is authorized to appoint not less than two clerks and
as many additional clerks as are required, but not exceeding a total of six
clerks, for the proper conduct of the election. The Alternate Judges shall
serve as Presiding Judges in the event that the regularly appointed Presiding
Judge is unable to serve, and the Alternate Judge shall be appointed by the
Presiding Judge to serve as one of the clerks in the event that the election
is conducted by the regularly appointed Presiding Judge.
Early voting shall be conducted at the office of the City Secretary on'
weekdays during the regular hours of business of the office of the City
Secretary, which are from 8:00 A.M. to 5:00 P.M., and at a branch early voting
place at the South Plains Mall, 6002 Slide Road on weekdays from 10:00 A.M. to
6:00 P.M. Both early voting locations shall be open for voting on the last
Saturday of the early voting period from 10:00 A.M. to 6:00 P.M.
ELECTION NOTICE
The City Secretary is hereby ordered and directed to cause notice of
this Special City Election to be given by the alternative method of publishing
this Order and Notice of Special City Election in English and Spanish at least
one time, not earlier than the thirtieth or later than the tenth day before
the election day. Said notice shall be published in a newspaper of general
circulation within the City of Lubbock. Following such publication, the City
Secretary shall file with the County Clerk a copy of the notice as published,
together with the name of the newspaper or newspapers and the dates of
publication.
The City Secretary shall serve a duly certified copy of this Election
Order and Notice of Special City Election on each of the Presiding Judges and
Alternate Judges named in Exhibit B. Such service shall be made by United
States mail or by personal delivery within twenty (20) days after the date of
execution of this Order and Notice of Special Election.
In addition, the City Secretary shall give and post such Notice as may
be required by Section 4.003(b)(e) of the Texas Election Code.

ELECTION ORDER
I, B.C. McMINN, Mayor of the City of Lubbock, Texas, by virtue of the
authority vested in me by law, and according to the Charter of the City of
Lubbock and the Texas Election Code, do hereby order that an election be held
in the City of Lubbock, Texas, on the 2nd day of May, 1992, such day being the
first Saturday of said month, for the purpose of electing the following
officers of the City of Lubbock, Texas:
MAYOR (AT LARGE) (TWO YEAR TERM)
COUNCIL MEMBER DISTRICT NO. 2 (FOUR YEAR TERM)
COUNCIL MEMBER DISTRICT NO. 4 (FOUR YEAR TERM)
COUNCIL MEMBER DISTRICT NO. 6 (FOUR YEAR TERM)
MUNICIPAL JUDGE DIVISION 1
(AT LARGE) (TWO YEAR TERM)
Said election shall be held at the places in the City of Lubbock
hereinafter designated as voting precincts and voting places on Exhibit A
attached hereto and made a part hereof for all intents and purposes. Voting
places shall be open from 7:00 A.M. to 7:00 P.M. and all voters shall vote in
the district of their residence and in the precinct of their residence unless
such precinct shall be consolidated with another precinct for voting as
provided by ordinance or as provided herein by Exhibit A. An electronic
voting system shall be used for this general city election. Said election
shall be conducted as a joint election with Lubbock Independent School
District.
The persons set forth in Exhibit B attached hereto and made a part
hereof for all intents and purposes are hereby appointed Judges and Alternate
Judges to hold said general city election on May 2, 1992. Each presiding
judge so named is authorized to appoint the number of clerks authorized by the
Election Administrator, which number shall not be less than two clerks nor
more than six clerks. The alternate judges shall serve as presiding judges in
the event that the regularly appointed presiding judge is unable to serve.
The alternate judge shall be appointed by the presiding judge to serve as one
of the clerks in the event that the election is conducted by the regularly
appointed presiding judge.
Early voting shall be conducted at the office of the City Secretary on
weekdays during the regular hours of business of the office of the City
Secretary, which are from 8:00 A.M. to 5:00 P.M. and at a branch early voting
place at the South Plains Mall, 6002 Slide Road on weekdays from 10:00 A.M. to
6:00 P.M. Both early voting locations shall be open for voting on the last
Saturday of the early voting period from 10:00 A.M. to 6:00 P.M.
ELECTION NOTICE
The City Secretary of the City of Lubbock is hereby ordered to cause
publication of this Order and Notice of General City Election at least one
time in a daily newspaper published in the City of Lubbock not more than
thirty (30) days nor less than ten (10) days prior to the General City
Election as required by law. The City Secretary shall serve a duly certified
copy of this Election Order and Notice upon each of the presiding judges named
in Exhibit B hereto not later than the seventh day after the signing of this
Election Order and Notice of General City Election or the 15th day before the
General City Election, whichever is later.
