RESOLUTION
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the Mayor of the City of Lubbock BE and is hereby authorized and
directed to execute for and on behalf of the City of Lubbock an Amendment to
the December 6, 1990, Agreement for Engineering Services for renovation of
the City of Lubbock Water Treatment Plant by and between the City of Lubbock
and HDR Engineering, Inc., which Amendment is attached herewith, which shall
be spread upon the minutes of the Council and as spread upon the minutes of
this Council shall constitute and be a part of this Resolution as if fully
copied herein in detail.

AMENDMENT
WHEREAS, the City of Lubbock, Texas,
have heretofore entered into an Agreement
December 6, 1990; and
and HDR Engineering, Inc.,
for Engineering Services upon
WHEREAS, the parties to said Agreement now desire to amend said
Agreement to include additional services and compensation as provided by
Attachments A-1, B-1 and C-1 attached hereto; NOW THEREFORE:
WITNESSETH:
THAT the parties hereto agree that the Agreement for Engineering
Services executed by and between the City of Lubbock and HDR
Engineering, Inc., upon December 6, 1990, shall be amended to include
this Amendment and the Attachments hereto; and
THAT all references in the original Agreement for Engineering
Services to "Attachment A" and "Attachment B" shall be read as including
"Attachment A and A-1" and "Attachment B and B-1" and "Attachment C and
C-1".
IN WITNESS WHEREOF, the parties have executed this Amendment upon
this 11th day of July , 1991.

TO
AGREEMENT FOR ENGINEERING SERVICES
OWNER: City of Lubbock, Texas
PROJECT: Engineering services required to administer
the construction contract during the
construction phase of improvements to the
Lubbock Water Treatment Plant
Description of Scope of Services
The Scope of Services for this municipal water treatment plant construction
administration project is as follows. Work shall not proceed until OWNER has
authorized ENGINEER in writing to proceed.
A. Construction Phase - Administration of the Construction Contract
During the Construction Phase ENGINEER shall:
1. Consult with and advise OWNER as set forth herein and as provided in
the ENGINEER'S General Conditions and Supplementary General
Conditions of the Contract for Construction included in the Contract
Documents for the PROJECT. The extent and limitations of the duties,
responsibilities and authority of ENGINEER as assigned in said
Contract Documents shall not be modified, except as OWNER and
ENGINEER may otherwise agree in writing. All of the OWNER'S
instructions to Contractor will be issued through ENGINEER who will
have authority to act on behalf of OWNER to the extent provided in
said Contract Documents except as otherwise provided in writing.
2. Make visits to the site at intervals appropriate to the stage of
construction, or otherwise agreed to by ENGINEER in writing, to
observe the progress and quality of the Work and to determine in
general if the Work is proceeding in accordance with the Contract
Documents. However, ENGINEER shall not be required to make
exhaustive or continuous on -site inspections to check the quality or
quantity of the Work. On the basis of such on -site observations,
ENGINEER shall keep the OWNER informed of the progress and quality
of the Work, and shall endeavor to alert the OWNER to defects and
deficiencies in the Work of the Contractor. ENGINEER shall not have
control or charge of and shall not be responsible for construction
means, methods, techniques, sequences, procedures of construction or
for safety programs and precautions in connection with the Work.
ENGINEER shall not be responsible for the acts or omissions of the
Contractor, Subcontractors or any other persons performing any of
the Work, or for failure of any of them to carry out the Work in
accordance with the Contract Documents.
3. Make recommendations to OWNER Concerning the disapproval or
rejection of Contractors' Work while it is in progress if ENGINEER
believes that such Work will not produce a completed PROJECT that
reflected in the Contract Documents. ENGINEER shall have access to
the Work at all times wherever it is in preparation or progress.
4. Review or take other appropriate action with respect to shop
drawings, samples and other data which Contractor is required to
submit, but only for conformance with the design concept of the
PROJECT and compliance with the information given in the Contract
Documents. Such reviews or other action shall not include means,
methods, techniques, sequences, or procedures of construction or
safety programs and precautions incident thereto.
5. Evaluate and determine the acceptability of substitute materials and
equipment proposed by Contractor. Make recommendations to OWNER
concerning acceptance or denial of Contractor's proposal(s).
6. Have authority, as OWNER's representative, to require special
inspection or testing of the Work, and receive and review all
certifications of inspections, testings and approvals required by
laws, rules, regulations, ordinances, codes, orders or the Contract
Documents to determine generally that their content complies with
the requirements of, and the results certified indicate compliance
with, the Contract Documents.
7. Act as initial interpreter of the requirements of the Contract
Documents, judge the acceptability of the Work and make decisions on
all claims of OWNER and Contractor relating to the acceptability of
the Work or the interpretation of the requirements of the Contract
Documents pertaining to the execution and progress of the Work.
ENGINEER shall not be liable for the results of any such
interpretations or decisions rendered in good faith.
8. Within ten (10) day following receipt in ENGINEER's office,
determine the amount owing to Contractor based on ENGINEER's
observations at the site and the data comprising the Application for
Payment, and recommend to OWNER in writing payments to Contractor in
such amounts. Such recommendations of payment will constitute a
representation to OWNER that the Work has progressed to the point
indicated and that, to the best of ENGINEER's knowledge, information
and belief, quality of the Work is in accordance with the Contract
Documents. The foregoing representations are subject to an
evaluation of the Work for conformance with the Contract Documents
upon Substantial Completion, to results of subsequent tests and
inspections, to minor deviations from the Contract Documents
correctable prior to completion and to specific qualifications
expressed by ENGINEER. The issuance of a recommendation will
further constitute a representation that the Contractor is entitled
to payment in the amount certified.
9. Receive and review maintenance and operating instructions,
schedules, guarantees, bonds, certificates of inspection and tests
and approvals of equipment which are to be provided by Contractor in
accordance with the Contract Documents. Determine that their
content complies with the requirements of the Contract Documents and
transmit them to OWNER with written comments.

10. Conduct a construction inspection to determine if the Work is
substantially complete and conduct a construction inspection to
determine if the completed Work is acceptable so that ENGINEER may
recommend, in writing, final payment to Contractor and may give
written notice to OWNER and Contractor that the Work is acceptable
subject to any conditions therein expressed.
a. Make follow up construction inspections, if required, for
items found to be incomplete or nonconforming. If
subsequent construction inspections are necessary, they
will be done as Additional Services, including salary,
time, travel, and living expenses.
Resident Project Representation
1. ENGINEER will furnish a full-time Resident Project Representative
and other assistant Resident Project Representatives as determined
by the ENGINEER but not exceeding maximum hours and costs identified
in this Amendment. The ENGINEER will submit the qualifications of
the Resident Project Representative to the OWNER for review and
approval prior to the startup of these services on the project.
Full-time Resident Project Representation is generally defined as
having a representative on -site when Work is in progress.
2. The Resident Project Representative will observe the Contractor's
work and perform the services listed below. The Resident Project
Representative shall not have responsibility for the superintendence
of construction site conditions, construction means, methods,
procedures or techniques, safety, safe practices or unsafe practices
or conditions, operation of equipment, or personnel other than
employees of the ENGINEER. This service will in no way relieve the
Contractor of complete supervision of the work of the Contractor's
obligation for complete compliance with the drawings and
specifications. The Contractor shall have sole responsibility for
safety and for maintaining safe practices and avoiding unsafe
practices or conditions.
3. Such Project Representatives shall be selected, employed, and
directed by ENGINEER, and ENGINEER shall be compensated as mutually
agreed upon between the OWNER and ENGINEER as set forth in this
Agreement.
4. Resident Project Representative is ENGINEER's Agent and shall act as
directed by and under the supervision of ENGINEER. He shall confer
with ENGINEER regarding his actions. His dealing in matters
pertaining to the on -site work will in general be only with ENGINEER
and Contractor. His dealings with subcontractors will only be
through or with the full knowledge of Contractor or his
superintendent. He shall generally communicate with OWNER only
through or as directed by ENGINEER.

5. Duties and Responsibilities
a. Schedules Review the progress schedule, schedule of Shop
Drawing submissions, schedule of values and other schedules
prepared by Contractor and consult with ENGINEER concerning
their acceptability.
b. Conferences Attend preconstruction conferences. Arrange a
schedule of progress meetings and other job conferences as
required in construction with ENGINEER and notify in advance
those expected to attend. Attend meetings and maintain, prepare
and circulate copies of minutes thereof.
C. Liaison Serve as ENGINEER's liaison with Contractor, working
principally through Contractor's superintendent and assist him
in understanding the intent of the Contract Documents. Assist
ENGINEER in serving as OWNER's Liaison with Contractor when
Contractor's operations affect OWNER's on -site operations.
1) As requested by ENGINEER, assist in obtaining from OWNER
additional details or information, when required at the
job site for proper execution of the Work.
2) In the interest of preserving the proper channels of
communication, advise ENGINEER of any direct communication
between OWNER and Contractor.
d. Shop Drawings and Samples
1) Receive and record date of receipt of shop drawings and
samples which have been reviewed by ENGINEER.
2) Receive samples which are furnished at the site by
Contractor's or ENGINEER's review, and notify ENGINEER of
their availability for examination.
3) Advise ENGINEER and Contractor or his superintendent
immediately of the commencement of any Work requiring a
Shop Drawing or sample submission if the submission has
not been accepted by ENGINEER.
e. Review of Work. Rejection of Defective Work. Inspection. and
Tests
1) Conduct on -site observations of the Work in progress to
assist ENGINEER in determining that the Project is
proceeding in accordance with the Contract Documents and
the completed Work will conform to the Contract Documents.
2) Report to ENGINEER whenever he believes that any Work is
unsatisfactory, faulty or defective or does not conform to
the Contract Documents, or has been damaged, or does not
met the requirements of any inspections, test or approvals
required to be made and advise ENGINEER when he believes
Work should be corrected or rejected or should be
uncovered for observation, or requires Special testing or
inspection.
3) Verify that tests, equipment and systems startups and
operating and maintenance instructions are conducted as
required by the Contract Documents and in presence of the
required personnel, and that Contractor maintains adequate

records thereof observe, record and report to ENGINEER
appropriate details relative to the test procedures and
startups.
4) Accompany OWNER and visiting inspectors representing
public or other agencies having jurisdiction over the
Project, record the outcome of these inspections and
report to ENGINEER.
f. Interpretation of Contract Documents
Transmit to Contractor clarification and interpretation of the
Contract Documents as issued by ENGINEER.
g. Modifications
Consider and evaluate Contractor's suggestions for
modifications in Drawings and Specifications and report them
with recommendations to ENGINEER.
h. Records
1) Maintain at the job site orderly files for all
correspondence, reports of job conferences, shop drawings
and sample submissions, reproductions of original Contract
Documents including all addenda, change orders, field
orders, additional Drawings issued subsequent to the
execution of the Contract, ENGINEER's clarifications and
interpretations of the Contract Documents, progress
reports and other Project -related documents.
2) Keep a diary or log book, recording hours on the job site,
weather conditions, data relative to questions of extras
or deductions, list of principal visitors, daily
activities, decisions, observations in general and
specific observations in more detail as in the case of
observing test procedures. Send copies to ENGINEER.
3) Record names, addresses and telephone numbers of all
Contractors, subcontractors and major suppliers of
equipment and materials.
4) Advise ENGINEER whenever Contractor is not currently
maintaining an up-to-date copy of Record Drawings at the
site.
i. Reports
1) Furnish ENGINEER periodic reports as required of progress
of the Work and of Contractor's compliance with the
approved progress schedule, schedule of Shop Drawing
submissions and other schedules.
2) Consult with ENGINEER in advance of scheduled major tests,
inspections or start of important phases of the Work.
3) Submit to the OWNER weekly construction progress reports
containing a summary of the Contractor's progress, general
conditions of the work, problems, and resolutions or
proposed resolutions of problems.
j. Payment Requisitions
1) Review Applications for Payment with Contractor for
compliance with the established procedure for their

submission and forward them with recommendations to
ENGINEER, noting particularly their relation to the
schedule of values, work completed and materials and
equipment delivered at the site.
k. Guarantees. Certificates. Maintenance and Operation Manuals
1) During the course of the Work verify that guarantees,
certificates, maintenance and operation manuals and other
data required to be assembled and furnished by Contractor
are applicable to the items actually installed; and
deliver these data to ENGINEER for his review and
forwarding to OWNER prior to final acceptance of the
Project.

1) Before ENGINEER issues a Certificate of Substantial
Completion, submit to Contractor a list of observed items
requiring correction.
2) Conduct final inspection in the company of ENGINEER, OWNER
and Contractor and prepare a final list of items to be
corrected.
3) Verify that all items on final list have been corrected
and make recommendations to ENGINEER concerning
acceptance.
Limitations of Authority
Except upon written instructions of ENGINEER, Resident Project
Representative
a. Shall not authorize any deviation from the Contract Documents
or approve any substitute materials or equipment
b. Shall not undertake any of the responsibilities of Contractor,
subcontractor or Contractor's superintendent
C. Shall not expedite Work for the Contractor
d. Shall not advise on or issue directions relative to any aspect
of the means, methods, techniques, sequences or procedures of
construction unless such is specifically called for in the
Contract Documents
e. Shall not advise on or issue directions as to safety
precautions and programs s in connection with the Work
f. Shall not authorize OWNER to occupy the Project in whole or in
part
g. Shall not participate in specialized field or laboratory tests
or inspections conducted by others
h. Shall not assist Contractor in maintaining up-to-date copy of
Record Drawings.

7. Through the observations by such Project Representatives, ENGINEER
shall endeavor to provide protection for the OWNER against defects
and deficiencies in the Work, but the furnishing of such field
representation shall not modify the rights, responsibilities or
obligations of ENGINEER as described in this Agreement.
Operational Phase
After written authorization to proceed with the Operational Phase,
ENGINEER shall:
1. Prepare a set of reproducible record prints of Drawings showing
those changes made during the construction process, based on the
marked -up prints, drawings and other data furnished by Contractor to
ENGINEER.
2. Assist OWNER in developing systems and procedures for control of the
operation and maintenance of and recordkeeping for the PROJECT.
Assist the plant staff in starting new process systems and reaching
routine operation.
3. Compile, review and comment on operating, maintenance and staffing
manuals. Assist the plant staff in preparing the budget for the
upcoming year's operation and maintenance costs.
4. Assist OWNER in training OWNER's staff to operate and maintain the
PROJECT. Conduct two (2) operation and maintenance training sessions
on start-up and ongoing operation and maintenance of new equipment
an systems added as new construction. Develop and submit to OWNER a
general preventative and scheduled maintenance program. Advise
OWNER as to the requirements for the spare parts inventory, spare
parts inventory record system, and maintenance record system.
5. Evaluate the plant performance and operation after the plant has
started and attained routine operation. Revise the operation and
maintenance manual as necessary.
Other Additional Services
When required by the Contract Documents, ENGINEER shall perform the
following additional services:
1. Performing Services resulting from significant changes in the
general scope, extent or character of the PROJECT or its design
including, but not limited to, changes in size, complexity, OWNER's
schedule, character of construction or method of financing. Revising
previously accepted studies, reports, design documents or Contract
Documents when such revisions are required by changes in laws,
rules, regulations, ordinances, codes or orders enacted subsequent
to the preparation of such studies, reports or documents, or are due
to any other causes beyond ENGINEER's control. This includes those
services resulting from incorporating information required by
Paragraph 3.2 which is furnished to ENGINEER after the stated time
schedule.

2. Preparing documents of alternate, separate, or sequential bids or
providing extra services in connection with bidding, negotiation or
construction prior to the completion of the Final Design Phase, when
requested by the OWNER.
3. Providing any type of property surveys or related ENGINEERing
services needed for the transfer of interests in real property and
field surveys for design purposes and engineering surveys and
staking to enable Contractor to proceed with the Work; and providing
other special field surveys.
4. Providing the services of soils/geotechnical engineers or other
consultants (in addition to those furnished under Basic Services)
when such services are deemed necessary by ENGINEER. Such services
shall include without limitation, borings, probings and subsurface
explorations, hydrographic surveys, laboratory tests and inspections
of samples, materials and equipment, with reports and appropriate
professional recommendations.
5. Preparing applications and supporting documents (in addition to
those furnished under Basic Services) for private a governmental
grants, loans or advances in connection with the PROJECT, preparing
or reviewing environmental impact statements and assessments,
reviewing and evaluating the effect on the design requirements of
the PROJECT of any such statements and documents prepared by others
and assisting in obtaining the approval of authorities having
jurisdiction over the PROJECT.
6. Performing services to make measured drawings of, or to investigate
existing conditions or facilities, or to verify the accuracy of
drawings or other information furnished by OWNER.
7. Provide project scheduling services.
8. Providing renderings or models for OWNER's use.
9. Preparing documents for alternative proposals requested by OWNER for
Contractor's Work which is not executed or documents for
out -of -sequence work.
10. Conducting investigations and studies involving, but not limited to,
consideration of operations, preventative maintenance programs, and
maintenance and overhead expenses; providing value engineering
during the course of design; preparing feasibility studies, cash
flow and economic evaluations, rate schedules and appraisals;
assisting with obtaining financing for the PROJECT; evaluating
processes available for licensing and assisting OWNER in obtaining
process licensing; performing detailed quantity surveys of material,
equipment and labor; and conducting audits or inventories required
in connection with construction performed by OWNER.
11. Furnishing services of independent professional associates and
consultants for other than Basic Services.

12. Assisting the OWNER with bid protests, rebidding or renegotiating
contracts for construction, materials, equipment a services.
13. Preparing to serve or serving as a consultant or witness for OWNER
in any litigation, arbitration or other legal or administrative
proceeding involving the PROJECT.
14. Performing services in connection with work directive changes and
change orders to reflect changes requested by OWNER.
15. Making revisions to Drawings and Specifications occasioned by the
acceptance by OWNER of substitutions proposed by Contractor.
Performing services after the award of each contract to evaluate and
determine the acceptability of additional substitutions proposed by
Contractor beyond the listing of acceptable manufacturers in the
Specifications.
16. Performing services resulting from significant delays, changes or
price increases occurring as a direct or indirect result of
material, equipment or energy shortages.
17. Performing additional or extended services during construction made
necessary by (1) Work damaged by fire or other cause during
construction; (2) a significant amount of defective or neglected
work of any Contractor; (3) acceleration of the progress schedule
involving services beyond normal working hours, and (4) default by
any Contractor.
18. Performing services other than Basic Services during the Operational
Phase in connection with any partial utilization of the PROJECT by
OWNER prior to Substantial Completion.
19. Evaluating an unreasonable or extensive number of claims submitted
by Contractor or others in connection with the Work.
20. Providing assistance in the closing of any financial or related
transaction for the PROJECT.
21. Providing assistance in connection with the refining and adjusting
of any equipment or system.
22. Performing services required for equipment fit up and connection.
23. Visiting the PROJECT with OWNER, to observe any apparent defects in
the completed construction after acceptance by OWNER and assist
OWNER in consultations and discussions with Contractor concerning
correction of such deficiencies and make recommendations as to
replacement or correction of defective Work
24. Performing Additional Services in connection with level of detail
related to design of the PROJECT, which is above the level necessary
to secure bids but desired by the OWNER hr more detailed
instructions to Contractor(s) or for other use by OWNER's personnel.
These include, but are not limited to:

b. Conduit Run Plans and Routing Details
c. Termination Drawings
d. Electrical Elementary or Ladder Diagrams
e. Piping Fabrication Details
f. Reinforcing Steel Bar Schedule
g. Material Quantity Schedules
25. Performing additional Services in connection with the PROJECT,
including services which are to be furnished by OWNER in accordance
with Attachment C OWNER's Responsibilities, and services not
otherwise provided for in this Agreement.

TO
AGREEMENT FOR ENGINEERING SERVICES

Lubbock Water Treatment Plant
COMPENSATION
For the services covered by this Agreement, the OWNER agrees to compensate the
ENGINEER as follows:
A. For Basic Services, as described in Attachment A-1, at an hourly fee for
ENGINEER's personnel services as listed in Paragraph C. The maximum
billed for these ENGINEER's personnel services shall not exceed
$406,348.44 without further written authorization. Subcontract personnel
services shall be reimbursable expenses and shall be billed at cost. In
addition, ENGINEER's and subcontractor's non -labor costs shall be
reimbursable expenses and shall be billed at cost. Billings for
reimbursable expenses are estimated to be $450,440.
B. For Additional Services, as described in Attachment A-1, an hourly fee
for ENGINEER's personnel services as listed in Paragraph C, plus
reimbursable expenses and subconsultant billing at cost to ENGINEER. Each
item of Additional Services shall be established before the work is
started. The amount billed for each item of Additional Services as
described in Attachment A-1 shall not exceed the amount established for
it without further authorization.
C. Hourly fees listed herein for ENGINEERs personnel services will apply
until December 31, 1991 and shall be changed annually on January 1st for
the upcoming twelve (12) month period.

D. The following expenses are reimbursable:
1. Travel, subsistence, and incidental costs.
2. Use of motor vehicles on a monthly rental basis for assigned
vehicles and on a current mileage basis or rental cost basis for
vehicles used for short periods.
3. Telegraph costs, long distance telephone costs and project onsite
telephone costs.
4. Reproduction of reports, drawings, and specifications.
5. Postage and shipping charges for project related materials.
6. Computer time charges including program use charges.
7. Rental charges for use of equipment.
8. Cost of acquiring any other materials or services specifically for
and applicable to only this project.
9. Subconsultant personnel services and expenses.
E. The ENGINEER agrees to use its best efforts to perform the services as
defined in this Agreement within the billing limits stated above.
F. Monthly payments shall be made to the ENGINEER by the OWNER based on the
ENGINEER's statement. For hourly fee items, the statement shall be
itemized to indicate the amount of work performed and the associated
reimbursable expenses and subconsultant costs.
G. The uncontested amount of each statement shall be due and payable upon
receipt by the OWNER. Carrying charges of 1-112 percent per month from
the billing date, shall be due for accounts which are not paid within 60
days after the billing date.
H. It is understood and agreed that the maximum billings of each of the
above items are based on the start of the services being authorized not
later than July 31, 1991. If start of services is not authorized by date
given, it is understood and agreed that the upper billing limit will be
adjusted accordingly by a supplement to the Agreement.
I. That the ENGINEER shall start the performance of the services within ten
days of receipt of notice to proceed.
J. That the ENGINEER shall keep records on the basis of generally accepted
accounting practice for costs and expenses and which records shall be
available to inspection at reasonable times.

OWNER'S RESPONSIBILITIES
OWNER shall do the following in a timely manner so as not to delay the
services of ENGINEER:
A. Designate in writing a person to act as OWNER's representative with
respect to services to be rendered under this Agreement. Such person
shall have complete authority to transmit instructions, receive
information, interpret and define OWNER's policies and decisions with
respect to ENGINEER's services for the PROJECT.
B. Provide office desk space for the ENGINEER's personnel during preliminary
investigations.
C. Provide the services of at least one of the OWNER's employees or staff
who has the right of entry to, and who has knowledge of, the existing
facilities to aid ENGINEER in conduct of field reviews of existing
facilities.
D. Provide to ENGINEER existing data, plans, reports and other information
known to, in possession of, or under control of OWNER which are relevant
to the execution of ENGINEER's duties on the PROJECT. Also, provide all
criteria and full information as to OWNER's requirements for the PROJECT,
including design criteria, objectives and constraints, space, capacity
and performance requirements, flexibility and expandability, and any
budgetary limitations and furnish copies of all design and construction
standards which OWNER will require to be included in the Drawings and
Specifications.
E. Provide within thirty (30) days after authorization to proceed, specific
OWNER furnished Standard Details, Standard Specifications, or Standard
Bidding Documents which are to be incorporated into the PROJECT. The
OWNER agrees to bear total responsibility for technical accuracy and
content of OWNER -furnished documents.
F. Provide land surveys to include property, boundary, easement,
right-of-way, topographic and utility surveys; property descriptions,
zoning, deed or other land use restrictions.
G. Arrange for access to, and make all provisions for, ENGINEER or
ENGINEER's Subconsultants to enter upon public and private property as
required for ENGINEER and ENGINEER's Subconsultants to perform services
under this Agreement.
H. Examine all studies, reports, sketches, Drawings, Specifications,
proposals and other documents presented by ENGINEER, obtain advice of an
attorney, insurance counselor and other consultants as OWNER deems
appropriate for such examination and render in writing decisions
pertaining thereto within a reasonable time so as not to delay the
services of ENGINEER.
I. Provide, if necessary, Environmental Assessments, or Environmental Impact
Statements related to the PROJECT. Furnish approvals and permits from
all governmental authorities having jurisdiction over the PROJECT and
approvals and consents from others as may be necessary for completion of
the PROJECT.
J. Provide accounting, independent cost estimating and insurance counseling
services as may be required for the PROJECT, legal services as OWNER may
require or ENGINEER may reasonably request with regard to legal issues
pertaining to the PROJECT including any that may be raised by Contractor,
auditing service as OWNER may require to ascertain how or for what
purpose any Contractor has used the monies paid under the construction
contract, and inspection services as OWNER may require to ascertain that
Contractor is complying with any laws, rules, regulations, ordinances,
codes or orders applicable to his furnishing and performing the Work.
K. Advertise for proposals from bidders, open the proposals at an appointed
time and place, and pay for all costs incidental thereto.
L. Give prompt written notice to ENGINEER whenever OWNER observes or
otherwise becomes aware of any condition that affects the scope or timing
of ENGINEER's services, or any defect or nonconformance in the Work of
any Contractor.
M. Accept full technical/administrative and legal responsibility for any
OWNER furnished standard details, technical or general specifications,
test data, site data, record drawings, and similar items.
N. At no cost to ENGINEER, provide the above data and services and render
approvals and decisions as is necessary for the orderly progress of
ENGINEER's services. ENGINEER shall be entitled to rely upon the
accuracy and completeness of all information and services provided by
OWNER or at OWNER's direction.
