HomeMy WebLinkAboutResolution - 3036 - Right Of Way Offer-EZ Hogan Jr-Detroit Ave Widening, L9-12, B1, Maddox Addition - 02_09_1989Resolution # 3036 February 9, 1989 Item # 10 JWF:dw 1191111`iidkkil WHEREAS, the City of Lubbock, Texas, a Home Rule Municipality located in Lubbock County, Texas, has determined and does hereby determine that the public needs, safety and welfare demand and create a public necessity for the acquisition of additional land for municipal public uses and purposes, to -wit: for the widening of Detroit Avenue, and this City Council of said City finds it in the public interest and for public purposes and municipal purposes to proceed with the acquisition of lands as needed for such purposes as aforesaid; NOW THEREFORE: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the fee simple title to the following described tract of land located in Lubbock, Lubbock County, Texas, be acquired for public purposes and municipal purposes as set forth in the preamble hereof, to -wit: THAT PORTION OF the South 15 feet of Lot 9 and Lots 10 through 12, Block 1, Maddox Addition to the City of Lubbock, Lubbock County, Texas, being the proposed right-of-way for Detroit Avenue, being further described by metes and bounds as follows: BEGINNING at the original Southeast corner of Lot 12, Block 1, Maddox Addition to the City of Lubbock, Lubbock County, Texas, for the Southeast corner of this tract; THENCE N. 87030'32" W., along the South line of said Lot 12, and along the North line of Colgate Street, a distance of 32.91 feet to a 1/2" iron rod with cap marked "RPS 1974" for the Southwest corner of this tract; THENCE N. 02005'45" E. a distance of 90.00 feet to a 1/2" iron rod with cap marked "RPS 1974" for the Northwest corner of this tract; THENCE S. 87030'32" E. a distance of 33.43 feet to a point in the East line of said Lot 9, for the Northeast corner of this tract; THENCE S. 02029'28" W., along the East line of said Lots 9 through 12, a distance of 90.00 feet to the POINT OF BEGINNING. CONTAINS: 2,980.76 square feet SECTION 2. THAT the owners of said tract, including E. Z. Hogan, Jr., BE offered through the Right -of -Way Department of the City of Lubbock the amount of $29,700.00, which is the amount appraised as the value and total damages for the fee simple title and acquisition of said real estate hereinabove described, for the use and benefit of the City of Lubbock, Texas, for the purposes herein stated, and unless accepted forthwith, the City Attorney of said City of Lubbock is hereby authorized and instructed to institute condemnation (eminent domain) proceedings to acquire the fee simple title to said land as hereinabove described for public purposes and municipal purposes.
