RESOLUTION
WHEREAS, the City of Lubbock, Texas, a Home Rule Municipality located
in Lubbock County, Texas, has determined and does hereby determine that the
pubic needs and welfare demand and create a public necessity for the opera-
tion, improvement, expansion, extension, construction, reconstruction,
repair and maintenance of electrical transmission and distribution lines,
poles, braces and guy wires and necessary apparatus and appliances in con-
nection therewith necessary to the proper operation of the public elec-
trical utility system owned and operated by the City of Lubbock, Texas, all
of which requires the acquisition of title by said City to easements for
such public municipal purposes, together with rights of ingress, egress and
regress in said City to accomplish such purposes; NOW THEREFORE:
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT title to an overhead electric power line easement
and a downguy easement in, upon, over, along and across the hereinafter
described real estate located in the City of Lubbock, Lubbock County,
Texas, be acquired by said City for public purposes and municipal purposes
as set forth in the preamble, to -wit:
Overhead Electric Power Line Easement
BEGINNING at a point which bears S 0° 00' 27" W a distance of
approx. 51.5 feet from the Northwest corner of Section 6, Block
A. Same point also lies on the existing West property line of
property granted to John M. O'Haugherty by Warranty Deed (Vol.
1180, Pg. 399-400) on 4/25/68.
THENCE East a distance of approx. 343.52 feet to a point.
THENCE N 650 10' 30" ± a distance of approx. 82.07 feet to a
point on the East property line of property granted to John M.
O'Haugherty (Vol. 1180, Pg. 399-400).
THENCE South along the existing East property line of John M.
O'Haugherty a distance of approx. 11.02 feet to a point.
THENCE S 650 10' 30" W ± parallel to and N 24" 49' 30" W a dis-
tance of 33 feet from the existing N.W. Right -of -Way line of
the P. & S.F. Railroad for a total distance of approx. 79.64 to
a point.
THENCE West a distance of approx. 345.72 feet to a point on the
existing West property line of John M. O'Haugherty and the West
Section Line of Section 6, Block A.
THENCE N 00 00' 27" E along the West property line of John M.
O'Haugherty and the West Section Line of Section 6, Block A a
distance of 10 feet to the POINT OF BEGINNING.
Downguy Easement
BEGINNING at a point which bears South approx. 61.5 feet and
East approx. 343.16 feet from the Northwest corner of Section
6, Block A.
THENCE S 120 24' 45" E ± a distance of approx. 34.88 feet to a
point on the existing N.W. Right -of -Way line of the P. & S.F.
Railroad.
THENCE N 65° 10' 30" E ± along the existing N.W. Right -of -Way
line of the P. & S.F. Railroad a distance of approx. 5.12 feet
to a point.
THENCE N 120 24' 45" W ± a distance of approx. 33.79 feet to a
point.
THENCE S 650 10' 30" W ± parallel to and N 24° 49' 30" W ± a
distance of 33 feet from the existing N.W. Right -of -Way line of
the P. & S.F. Railroad for a total distance of approx. 2.56
feet to a point.
THENCE West a distance of approx. 2.56 feet to the POINT OF
BEGINNING.
SECTION 2. THAT the owner of the above -described tracts of land,
being John M. O'Haugherty, BE offered through the Right -of -Way Department
of the City of Lubbock the amount of $2,500.00, which is the amount
appraised as the value and total damages for the acquisition of title to
both of said above -described easements, for the use and benefit of the City
of Lubbock, Texas, for the purposes herein stated, and unless accepted
forthwith, the City Attorney of said City of Lubbock is hereby authorized

and instructed to institute condemnation (eminent domain) proceedings to
acquire title to said easements for public purposes and municipal purposes.
