WHEREAS, the City Of Lubbock, Texas and Parkhill, Smith & Cooper, Inc., have entered into an agreement for engineering services, dated March 25, 1982, as amended by Amendment No. 1, dated March 22, 1984. WHEREAS, The City of Lubbock, Texas desires to proceed with the design and construction of additional improvements of Lubbock International Airport in accordance with Item 5 in the RECITALS of the Agreeement. THIS AMENDMENT WITNESSETH: A. In the RECITALS, as amended, the following shall be inserted after Item 12: 13. To rehabilitate and upgrade portions of the airfield lighting system. This includes the following: a. Lighting for Taxiways M, S, N and portion of F. b. Lighting for Taxiways J, K, G and portion of R. c. Lighting for Taxiways A, B, C, D and portion of F. d. Lighting for portions of Taxiways R and F and terminal apron perimeter taxiway. e. Modifications for lighting vault. f. Runway distance remaining signs for Runways 17R-35L and 8-26. g. Manholes and partial cable replacement for lighting on Runways 17R-35L and 8-26. h. Runway pavement sensor system. j. Rehabilitation of airport rotating beacon. AMENDMENT NO. 2 Page 1 of 9 14. To reconstruct west cargo apron. 15. To construct new runway end connector taxiways as follows: a. Connector taxiway between Taxiway M and Runway 17R. b. Connector taxiway between Taxiway M and Runway 35L. 16. To construct new taxiways and extend and widen existing taxiways as follows: a. New angled connector taxiway between Taxiway A and Runway 17R. b. Extend Taxiway •J to Runway 17R-35L and through to Taxiway C. c. Widen Taxiway F west of Runway 17R-35L. 17. To construct an angled exit taxiway between Runway 17R-35L and Taxiway M. 18. To construct new taxiways as follows: a. Extend Taxiway L north to Taxiway A. b. New connector taxiway between Runway 17R-35L and Taxiway A and between Taxiway A and Taxiway L extension. Work in Items 13 through 18, as above listed, is presented in the PREAPPLICATION FOR FEDERAL ASSISTANCE AT LUBBOCK INTERNATIONAL AIRPORT, as updated April 15, 1988. B. The Engineer shall, upon authorization, proceed with the DESIGN PHASE, as specified in Section II-C of the Agreement, for Items 13 and 14 as described in the RECITALS. Construction work for Item 13, airfield lighting system rehabilitation, is to be included in a single set of bidding and contract documents. Construction work for Item 14, Reconstruction of West Cargo Apron, is to be included in a single set of bidding and contract documents. AMENDMENT NO. 2 Page 2 of 9 C. The Engineer shall, upon authorization for each item, proceed with the BIDDING PHASE and CONSTRUCTION PHASE, as specified in Section II-D and Section II-E of the Agreement, for Items 13 and 14 as described in the RECITALS. D. In Section III, AUTHORIZATION OF SERVICES, the following shall be inserted following the last paragraph of Section III, page III-1, as amended: "The Engineer shall be authorized to proceed with the Design Phase services for Items 13 and 14 as described in the RECITALS upon execution of Amendment No. 2 to this Agreement. The Owner's written authorization shall be obtained prior to proceeding with each sub- sequent phase of services." E. In Section IV, PERIOD OF SERVICE the following shall be inserted after.the sixth paragraph of Section IV, page IV-1, as amended: "It is agreed the authorization to proceed with the Design Phase for Item 13 and Item 14 in the RECITALS will be given upon execution of Amendment No. 2 to this Agreement. The Design Phase for Item 13 will be completed within 180 calendar days from the date of execution and the Design Phase for Item 14 will be completed within 120 calendar days from the date of execution." F. In Section VI-C, DESIGN PHASES, the following shall be inserted after the sixth paragraph of Section VI-C, page VI-2, as amended: "Payment for services in the Design Phases shall be made to the Engineer in the lump sum amount of Fifty -Eight Thousand Three Hundred Forty -Four Dollars ($58,344.00) for the Design Phase for Item 13 in the RECITALS. AMENDMENT NO. 2 Page 3 of 9 Payment for services in the Design Phase shall be made to the Engineer in the lump sum amount of Sixty -One Thousand Three Hundred Twenty -One Dollars ($61,321.00) for the Design Phase for Item 14 in the RECITALS. Payment for services in the Design Phases shall be made to the Engineer in a lump sum amount of (to be negotiated whenever the Owner desires to proceed with the Design Phase)for the Design Phase for Items 8, 11 and 15 through 18 in the RECITALS." G. In Section VI-D, BIDDING PHASES, the following shall be inserted after the fourth paragraph of Section VI-D, page VI-3, as amended: "Payment for services in the Bidding Phases shall be made to the Engineer in a lump sum amount of Three Thousand Eight Hundred Thirty -One Dollars ($3,831.00) for the Bidding Phase for Item 13 in the RECITALS. Payment for services in the Bidding Phases shall be made to the Engineer in a lump sum amount of Three Thousand Eight Hundred Eighty -One Dollars ($3,881.00) for the Bidding Phase for Item 14 in the RECITALS. Payment for services in the Bidding Phases shall be made to the Engineer in a lump sum amount of (to be negotiated whenever the Owner desires to proceed with the Bidding Phase) for the Bidding Phase for Items 8, 11 and 15 through 18 in the RECITALS." H. In Section VI-E, CONSTRUCTION PHASES, the following shall be inserted after the fourth paragraph of Section VI-E, page VI-3, as amended: "Payment for services in the Construction Phases shall be made to the Engineer in a lump sum amount of Seventeen Thousand Six Hundred Forty -Three Dollars ($17,643.00) for the Construction Phase for Item 13 in the RECITALS. AMENDMENT NO. 2 Page 4 of 9 Payment for services in the Construction Phases shall be made to the Engineer in a lump sum amount of Twenty -Two Thousand Three Hundred Ninety -Eight Dollars ($22,398.00) for the Construction Phase for Item 14 in the RECITALS. Payment for services in the Construction Phases shall be made to the Engineer in a lump sum amount of (to be negotiated whenever the Owner desires to proceed with the Bidding Phase) for the Construction Phase for Item 8, 11 and 15 through 18 in the RECITALS." I. In Section VII, page VII-3, the following shall be inserted after paragraph VII (24): "(25) Preparation of application, reimbursement and other forms for the Federal Aviation Administration for grants or for payment of grants for the various phases of the Project or Projects. (26) Attendance at or presentations for City Council or Airport Board meetings." J. In Section VII, pages VII-3 and -4, the following shall be inserted in place of the rate schedule shown in the agreement: "For Special Services rendered under paragraphs VII(1) through VII(26), the Owner shall pay the Engineer in accordance with the following schedule: Principal Engineer Project Engineer Design Engineer Electrical Engineer $78.00 per hour 56.00 per hour 51.00 per hour 60.00 per hour AMENDMENT NO. 2 Page 5 of 9 Engineer -in -Training 40.00 per hour Chief Drafter 40.00 per hour Drafter III & IV 29.00 per hour Drafter I & II 24.00 per hour Grants Coordinator 44.00 per hour Typist 24.00 per hour Resident Project Representative 39.00 per hour Engineer or RPR Travel 0.31 per mile Engineer or RPR per diem 55.00 per day Reimbursable Expense At Cost K. In Section VII, page VII-4, as amended, under "Subcontract Expense" the following shall be inserted after Item g: h. L. In Section VII, page VII-4, the paragraph setting forth the adjust- ments for changes in the Consumer Price Index shall be revised to read as follows: "The above rates of compensation for Special Services are based on salaries, salary overhead, administrative overhead and direct cost estimated to be in effect until December 31, 1988. For any Special Services authorized after December 31, 1988, the above rates of compensation shall be adjusted in accordance with the following formula: c ARC -.IRC x 347.8** Where ARC - Adjusted Rate of Compensation IRC - Initial Rate of Compensation c - Consumer Price Index on which salaries are based at the time Special Services are furnished after December 31, 1988. AMENDMENT NO. 2 Page 7 of 9 **Above schedule of rates are based on Consumer price Index of 347.8 Payments to the Engineer for authorized services not included in Basic Charges will be made monthly, by the Owner, upon presen- tation of monthly statements by the Engineer of such services." M. Section IX, page IX-1, shall be revised to read as follows: 1VCrPTTAU TV REUSE OF DOCUMENTS All documents including Drawings and Specifications prepared by Engineer pursuant to this Agreement are instruments of service in respect of the Project. They are not intended or represented to be suitable for reuse by Owner or others on extensions of the Project or on_any other project. Any reuse without written verification or adaptation by Engineer for the specific purpose intended will be at Owner's sole risk and without liability or legal exposure to Engineer; and Owner shall indemnify and hold harmless Engineer from all claims, damages, losses and expenses including attorney's fees arising out of or resulting therefrom."
