Resolution - 2742 - Grant Application - HUD - Urban Homestead Program - 02_11_1988
Resolution #2742 February 11, 1988 Item 19 RESOLUTION WHEREAS, on January 19, 1988 the Neighborhood Redevelop- ment Commission of the City of Lubbock reviewed and recom- mended the Urban Homestead.Application to the City Council of the City of Lubbock; and WHEREAS, the purpose of the Urban Homesteading Program is to use existing housing stock to provide homeownership in selected neighborhoods and assisting in their preservation; and WHEREAS, the United States Department of Housing and Urban Development reserves appropriated Section 810 funds to reimburse the Secretary's Mortgage Insurance fund for any authorized federally owned properties which may be turned over to the City's designated Local Urban Homesteading Agency for use in the Lubbock Homestead Program; and WHEREAS, the City of Lubbock is desirous of participat- ing in the U.S. Department of Housing and Urban Development Urban Homesteading Program; and WHEREAS, it is in the best interest of the citizens of the City of Lubbock to apply for the Urban Homesteading Program; NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: Section 1. THAT an Urban Homesteading Application and all related documents are hereby authorized to be filed on behalf of the City of Lubbock with the U.S. Department of Housing and Urban Development. Section 2. THAT the Urban Renewal Board of the City of Lubbock be and is hereby designated the Local Urban Home- steading Agency. Section 3. THAT the Target Area designated on the attached Urban Homestead Map be and is hereby declared the official Urban Homestead Area for the City of Lubbock. Section 4. THAT the City Council directs and designates the Mayor as the City's Chief Executive Officer and Autho- rized Representative to act in all matters in connection with this application and the City's participation in the Urban Homesteading Program. VR49iij_ Resolution #2742 CERTIFICATION (1) the governing body has duly adopted or passed an official act, resolution, motion or similar action authorizing the filing of the application, including all understandings and assurances contained in these certifications; (2) it possesses the legal authority to carry out the local urban homesteading program described in its application in accordance with this part including the specific program requirements described in 590.7(b'); (3) it has an adequate administrative organization capable of carry- ing out the program in a timely and effective manner; (4) it has developed procedures for selecting and accepting property suitable for homesteading and rehabilitation as required by 590.7(b)(10); (5) it has developed equitable procedures for selecting homesteaders as required in 590.7 (b)(2); (6) it has developed a form for conditional conveyance to the home- steader; (7) it has developed an homesteader's agreement as required by 590.7(b)(5); (8) it has developed procedures for monitoring the homesteader agree- ment and revoking a conditional conveyance upon material breach of the agreement as required by 590.7(b)(5); (9) it has developed procedures for conveying fee simple title to the residential property received from HUD and VA without a substantial consideration to the homesteader upon his or her full compliance with the agreement required in 590.7(b)(5); (10) it has, prior to submission of an application, developed a plan for a coordinated approach toward neighborhood improvement as required by 590.7(a); (11) it has provided citizens are adequate opportunity to express pref- erences about the proposed location of the urban homesteading neigh- borhood(s) and to comment on the plan for a coordinated approach toward neighborhood improvement; Certification Page 2 (12) it will comply with the requirements of Title VI of the Civil Rights Act of 1964, Executive Order 11063; Title VIII of the Civil Rights Act of 1968; Section 504 of the Rehabilitation Act of 1973; and the Age Discrimination Act of 1975, which prohibits discrimination on the basis of sex, race, creed, religion, color, national origin, hand- icap, or age in any program or activity under this part; (13) it will employ affirmative marketing procedures in the advertis- ing of homesteading properties; (14) it will comply with the lead based paint procedures set forth in 24 CFR Part 35, agreeing to assure the elimination of immediate lead - based paint hazards in federally owned property transferred under this part and notifying potential homesteaders of the hazards of lead -based paint poisoning in residential units constructed before 1950; (15) it will submit any information HUD requests for the purpose of meeting HUD's responsibilities under the National Environmental Policy Act of 1969; Executive Order 11988 on Flood Plain Management; Execu- tive Order 11990 on Protection of Wetlands; the Flood Disaster Protec- tion Act of 1973, the National Historic Preservation Act of 1.966 and the Preservation of Historic and Archaeological Data Act of 1974, including the procedures prescribed by the Advisory Council on Historic Preservation in 36 CFR part 800, and Executive Order 11593 on Protection and Enhancement of the Cultural Environment; (16) it will give HUD and the Comptroller General, through their authorized representative, access to and the right to examine all records, books papers, or documents related to the local urban home- steading program; (17) it will maintain in writing and on file a description of its approved local urban homesteading program for public information and review; (18) it will assist in arranging, or will itself undertake, rehabili- tation financing for residential property conveyed to homesteaders.
