HomeMy WebLinkAboutResolution - 2252 - Joint Election - LISD - 04_05_1986 - 02_13_1986Resolution #2252 February 13, 1986 Agenda Item #40 DGV:js JOINT ELECTION RESOLUTION WHEREAS, the City of Lubbock and Lubbock Independent School District are both required by law to conduct elections on April 5, 1986; and WHEREAS, Sec. 271.002 of the Texas Election Code provides for joint elections when an election is required upon the same day by two or more political subdivisions occupying all or part of the same territory; and WHEREAS, it is deemed to be in the best interests of the citizens voting in said elections to combine such elections into a joint election in order to reduce expenses and to minimize confusion; NOW THEREFORE: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK AND THE BOARD OF TRUSTEES OF THE LUBBOCK INDEPENDENT SCHOOL DISTRICT ACTING JOINTLY: THAT a joint election of the City of Lubbock and the Lubbock Indepen- dent School District be held on April 5, 1986, under the provisions of the Texas Election Code and other applicable law and in accordance with the following agreed terms: 1. That common precinct boundaries shall be designated by each governing body so far as is practical and expedient. 2. That common voting places shall be designated by each governing body. 3. That each candidate for office shall be required to file his candidacy with the appropriate political subdivision for the elective office sought not later than 5:00 p.m. on February 19, 1986 for City candidates; and 12:00 midnight March 5, 1986 for school candidates. 4. That a single set of election officers shall be agreed upon and designated by both governing bodies for the conduct of the elec- tion. Such officers may include those qualified to serve for either individual political subdivision. 5. That the election shall be administered by the City Secretary of the City of Lubbock and that Mr. Bob Wyett will serve as assis- tant election officer. 6. That a "drawing for place on the ballot" shall be conducted by each political subdivision at the location and time of its choice. 7. That a joint ballot shall be used listing all candidates by category within each respective political subdivision, except such precincts as may contain voters residing outside the juris- diction of one of the political subdivisions. In such precincts, voters residing within a single jurisdiction shall be given a ballot containing only the names of those candidates for whom they are qualified to vote. Write in votes shall be cast on the stub of the punchcard ballot. 8. That there be joint absentee balloting conducted at the Office of the City Secretary to be conducted using separate paper ballots. 9. That the preparation of election supplies, contacting of ap- propriate officials, publication, posting of election notices, maintaining of records, except maintenance of campaign contri- bution records, and all other routine matters shall be the responsibility of the City Secretary of the City of Lubbock. 10. That the tabulation of the election returns shall be a joint effort utilizing the computer facilities of the Lubbock County Computer Center. 11. That the official canvassing of ballots and announcement of results shall be individually by each governing body as required by law. 12. That if a runoff election is required by only one governmental subdivision, it shall have sole responsibility to conduct that election. If a runoff election is required of both governmental subdivisions, such runoff election may be conducted as a joint election under these same rules, law permitting. 13. That all costs of the election shall be divided equally between the City of Lubbock and Lubbock Independent School District. Passed by the City Council this 13th day of February, , 1986. MONTE HASIE, PRESIDENT THE STATE OF TEXAS COUNTY OF LUBBOCK CITY OF LUBBOCK ORDER AND NOTICE OF SPECIAL CITY ELECTION ELECTION ORDER I, Alan Henry, Mayor of the City of Lubbock, Texas, by virtue of the authority vested in me by law, and according to the Charter of the City of Lubbock, the Texas Election Code and an ordinance heretofore passed by the City Council setting a Special City Election for Charter Amendment, do hereby order that a Special Election for Charter Amendment be held in the City of Lubbock, Texas, on the 5th day of April, 1986, such day being the first Saturday of said month, for the purpose of considering the proposed amendments to the Charter of the City of Lubbock set forth in the Ordinance attached hereto as Exhibit A and made a part hereof for all intents and purposes. The date for holding said Special Election is not less than thirty (30) days nor more than ninety (90) days from the final passage of the Ordinance calling said Special Election, attached hereto as Exhibit A. Said Special Election shall be held at the places in the City of Lubbock hereinafter designated as voting precincts and voting and places on Exhibit B hereto and made a part hereof for all intents and purposes. Polling places shall be open from 7:00 A.M. to 7:00 P.M. and all electors shall vote in the precinct of their residence unless such precinct shall be consolidated with another precinct as provided herein in Exhibit B. Electronic voting machines shall be used for this Special Election, except that absentee voting shall be by paper ballot. Said Special Election shall be conducted as a joint election with Lubbock Independent School District and Lubbock County. The persons set forth in Exhibit C attached hereto and made a part hereof for all intents and purposes are hereby appointed Judges and Alternate Judges to hold said Special Election on April 5, 1986. Each presiding Judge so named is authorized to appoint not less than two (2) clerks nor more than six (6) clerks. The Alternate Judges shall serve as presiding Judges in the event that the regularly appointed Judge is unable to serve and the Alternate Judge shall be appointed by the presiding Judge to serve as one of the clerks in the event that the election is conducted by the regularly appointed presiding Judge. Absentee balloting shall be conducted at the office of the City Secretary on weekdays during the absentee voting period, except that such office shall be closed on Good Friday, March 28, 1986, and the hours of voting shall be the regular hours of business of such office, which is from 8:00 A.M. to 5:00 P.M. NOTICE The City Secretary is hereby order to cause publication of this Order and Notice of Special City Election for Charter Amendment on the same day in each of two successive weeks, with the first publication to be not less than fourteen (14) days prior to April 5, 1986, the date set for the Special Election. Such notices shall be published in a newspaper of general circulation within the City, and such notices shall include a substantial copy of the proposed Charter amendments. The City Secretary shall serve a duly certified copy of this Election Order and Notice upon each of the presiding Judges named in Exhibit C hereto not later than the seventh day after the signing of this Election Order and Notice or the 15th day before the Special Election, whichever is later. In the event of approval of such proposition, then:lrhapter 1, Article I, Section 4, of the Charter shall be amended to replac6 the word "Mayor" therein with the words "City of Lubbock." PROPOSITION NO. 3 "SHALL the requirement of notice of a claim against the City of Lubbock being filed within thirty (30) days of the time such` -cause of action arose be extended to six (6) months?" In the event of approval of such proposition, then Chapter 1, Article I, Section 8, shall be amended to remove the words "within 30 days" and to substitute therefor the words "within six (6) months." PROPOSITION NO. 4 "SHALL therCity Charter of the City of Lubbock be amended to provide that the interest rate on assessments be such rate as is authorized by State law?" In the event of approval of such proposition, then Chapter 1, Article II, Section 15, Paragraph (a), Subparagraph "Terms of Payment," shall be amended/to remove the words "at any rate not exceeding eight percent (8°0) per annum" and to substitute therefor the words "at the maximum rate permitted by the laws of the State of Texas." PROPOSITION NO. 5 "SHALL the requirement for utilities seeking street use franchises to publish the entire proposedfranchise ordinance once a week for three (3) consecutive weeks be reduced to once a week for two (2) consecu- tive weeks?" In the event of approval of such proposition, then Chapter 1, Article II, Section 18, shall be amended to remove the words "once a week for three (3) consecutive weeks" and to substitute therefor the words "once a week for two (2) consecutive weeks." PROPOSITION NO. 6 "SHALL the City Charter of the City of Lubbock be amended to provide that the interest rate on special assessments be such rate as is authorized by State law?" In the event of approval of such proposition, then Chapter 1, Article II, Section 18, shall be amended to remove the words "at any rate not exceeding 8% per annum," and to substitute therefor the words "at the maximum rate permitted by the laws of the State of Texas." PROPOSITION NO. 7 "SHALL the City Charter of the City of Lubbock be amended to reflect current State law with regard to Municipal Court of Record penal- ties?" In the event of approval of such proposition, then Chapter 1, Article II,. Section 23, Paragraph "Penal ordinances; penalty," shall be amended to remove the words "not :to exceed two hundred ($200.00) dollars" and to substitute therefor the words "not to exceed the maximum fine permitted by State law." PROPOSITION NO. 8 "SHALL the Charter of the City of Lubbock be amended to conform with the provisions of V.T.C.A., Government Code, Chapter 30, Subchapter A, which established a Municipal Court of Record for the City of Lubbock?" In the event of approval of such proposition, then Chapter 1, Article III (Judicial) shall be amended by deleting all current sections and substituting therefor the following: "The Lubbock Municipal Court of Record shall operate in confor- mance with the provisionst`of V.T.C.A., Government Code, Chapter 30, Subchapter A, and applicable ordinances, resolutions, and rules." PROPOSITION NO. 9 "SHALL the Charter of the City of Lubbock be amended to reflect current State law with regard to requirements for petitions submitted under initiative and referendum procedures?" In the eventt'of approval of such proposition, then Chapter 1, Article IV, Section 1, paragraph "Petition; signatures; affidavit," shall be amended by adding to the first sentence, the followinq words, "and, in addition, such other information as may be required by State law, such as his or her printed name, voter registration, `number and date of signing." =S' - PROPOSITION NO. 10 "SHALL the Charter of the City of Lubbock be amended to provide that petitions for recall of an elective officer be signed by at least thirty percent (30,%) of the qualified voters residing within said elective officer's District of'election?" In the;'event of approval of such proposition, then Chapter 1, Article IV, Section 2, paragraph "Petition for recall," shall be amended to remove the second sentence thereof and substitute therefor the following sentence: "Such petition for the recall of any such elective officer or officers shall be signed by at least/thirty percent (30%) of the qualified voters of the officer's elective District, to be determined by the number of votes cast in his or her elective District in the last regular municipal election: at least one -tenth (1/1,0) of those signing the petition shall certify that at the election;"at which the officer or officers was or were elected, they voted for the election of such officer or officers proposed to be recalled." PROPOSITION NO. 11 "SHALL the City Charter of the City of Lubbock be amended to reflect that State law referendum provisions supersede Charter provisions with regard/to initiative and referendum matters?" In the event of approval of such proposition, then Chapter 1, Article IV, Section 1, shall be amended by adding the following paragraph thereto: "Election provided by State law. In the event that a referendum is provided by State law upon some matter, such asfthe issuance of revenue bonds, then such referendum provision shall supersede the provisions of this Charter pertaining to initiative and referendum and the Charter's provisions shall not be effective." PROPOSITION NO. 12 "SHALL the Charter of the City of Lubbock be amended to reflect current State law with regard to requirementsfor petitions submitted 'under recall procedures?" In the event of approval of such proposition, Chapter 1, Article IV, Section 2, paragraph "Signatures on petitions," shall be amended by adding to the first sentence, the following words, "and, ;in addition, such other information as may be required by State law, such)as his or her printed name, voter registration number and date of signing." PROPOSITION NO. 13 "SHALL the Charter of the City of Lubbock be amended to require occupation tax licenses to be issued by the City Manager or his designee rather than by the Tax Assessor -Collector?" In the event of approval of such proposition, Chapter 1, Article VI, shall be amended by removing all references to the "Assessor and Collector of Taxes" and replacing such words with the term "City Manager or his designee." PROPOSITION NO. 14 f "SHALL the Charter of the City of Lubbock be amended to remove the requirement that all occupation tax receipts be countersigned by the Mayor?" In the event of approval of such proposition, Chapter 1, Article VI, Section 3, shall be amended by deletion of the last sentence of said paragraph. PROPOSITION NO. 15 "SHALL the Charter of the City of Lubbockgbe amended to conform Chapter 1, Article VII, to the requirements of the Texas Property Tax Code?" In the event of approval of such proposition, Chapter 1, Article VI, shall be amended by deleting all current sections and substituting therefor the following: "All procedures pertaining to taxation and finance shalllbe in accordance with provisions of the Texas Property Tax Code; and other applicable State law, and ordinances, resolutions and rules of the City Council." PROPOSITION NO. 16 "SHALL the Charter of the City of Lubbock be amended to provide that the maximum interest rate on City issued bonds may -'exceed the current Charter limit of six percent (60) per annum?" In the event of approval of such proposition, Chapter 1, Article VIII, Section 1, shall be amended by removing the words, "to bear interest not to exceed six percent (60) per annum, payable annually or semiannually." PROPOSITION NO. 17 "SHALL the Charter of the City of Lubbock be amended to conform with the provisions of the final judgment in Jones v. City of Lubbock, CA-5-76-34, U.S. District Court, Northern District of Texas, Lubbock Division?" In the event of approval of such proposition, Chapter 1, Article,fIX, shall be amended by substituting the following named sections for the same sections currently contained in the Charter. "Sec. 1. Municipal Government; governing body. The Municipal Government of the City of Lubbock shall consist of the City Council, which shall be composed of a Mayor and six (6) Councilmembers."/ "Sec. 2. Term of Office. The Mayor shall serve for a term of two (2) years, and each Councilmember shall serve for a term of four (4) years, and until their successors are elected or qualified, unless sooner removed from office as herein provided. Initial terms for Councilmembers from Districts/1, 3 and 5 shall be two (2) years, commencing in 1984, and four (4) years thereafter." "Sec. 4. (qualifications of Mayor, Councilmembers, officials and employees. The Mayor and each Councilmember shall be a resident citizen of the City of Lubbock and have the qualifications of electors therein. The Mayorl'and all Councilmembers shall be bona fide residents within the City and within the applicable District at the time of filing for office and must continue to reside within the City and the applicable District during the term of his; or her office. The Mayor, Council - members and other officers andlemployees shall not be indebted to the City; shall not hold any public office of emolument and shall not be interested in the profits or emoluments of any contract, job, work or service for the municipality or interested in the sale to the City of any supplies, equipment, material or!articles purchased; nor shall either of them be the owner in any public utility or public service corporation within the City, nor in the employ of any owner of stock in any public utility or public service corporation. Any officer or employee of the City who shall cease to possess/any of the qualifica- tions herein required shall forfeit his office or position, and any contract in which any officer or employee shall or may become inter- ested may be declared void by the Council. No officer or employee of the City shall accept any frank, free ticket, passes, or service, or� anything of value, directly or indirectly from any person, firm or corporation, upon terms more favorable than are granted to the public, and any violations of this section shall be a misdemeanor, and on conviction hereof, such office or employment shall be forfeited." "Sec. 5. Elections; designation of Councilmembers. Thelpgoverning body of the City shall consist of a Mayor and six (6) Councilmembers; the Councilmembers other than the Mayor shall be elected from geographical districts and shall be designated Council - member, District 1; Councilmember, District 2; Councilmember, District 3; Councilmember, District 4; Councilmember, District.5; and Council - member, District 6;/each of whom shall be elected to the office for which he or she is a candidate by a majority of the qualified voters of his or her District; and the Council shall be the judge of the election and qualifications of its members. Councilmember Districts shall contain such City:fVoting Precincts as are assigned to such Districts by Ordinance enacted by the City Council." "Sec. 12. Mayor Pro Tempore. The members of the City Council shall elect a Mayor Pro Tempore from among its members and Such election shall be held at the first regular meeting of the CitylCouncil after newly elected members have qualified and taken their seats on the City Council following a regular municipal election." "Sec. 15. Legislative Procedure; quorum; voting; excused from voting. Any four (4) members of the Council shall constitute Ia quorum for the transaction of any business, and the affirmative votetof any four (4) members.of the Council shall be sufficient and necessary to adopt or repeal any ordinance or resolution. The vote upon the passage or repeal of any ordinance or resolution shall be taken by "Yea",,and "Nay" vote, and entered upon the journal. All members of the�`Council shall vote upon every question, ordinance or resolution, provided that not more than one (1) member of the Council may be excused from voting by a vote of the other six (6) members, which shall be entered upon the journal. Any Councilmember refusing to vote unless so excused shall:'be entered on the journal as voting in the affirmative. Mayor to sign; secretary to attest; ordinances, etc. Every ordinance or resolution passed by the Council shall be signed by the Mayor, and attested by the person acting as City Secretary, and the seal of the City impressed thereon within/two (2) days after its passage." PROPOSITION NO. 18 "SHALL the Charter of the City of Lubbock be amended to provide a means for calling a special election to fill vacant City Council positions in the event that the Mayor or a quorum of the City Council is unavailable toi�call such election due to mutual catastrophe or other reason?" In the event of approval of such proposition, Chapter 1, Article IX, Section 3, shall be amended to add the following language: "If, due to mutual catastropfe or other reason, neither the Mayor nor a quorum of the City Councillis available to call said special election, then such election shall be called by the City Manager or his Deputy." PROPOSITION NO. 19 "SHALL the Charter of the City of Lubbock be amended to provide for a One -Hundred Dollar ($100.00) filing fee for City district positions or a Twenty,? ive (25) signature petition for candidacy for all City elected positions?" ii In the event of approval of such proposition, Chapter 1, Article IX, Section 5, paragraph "Candidates; official ballot" shall be amended to read as follows: "Candidates; official ballot; filing fee. Each candidate for a City elective office shall request �n writing to have his or her name placed upon the official ballot, which request shall be filed along with the appropriate filing fee with the person exercising the duties of City Secretary at least thirty (30) days before the upcoming election. Candidates for Councilmember shall indicate upon their writte drequest which District in which he or she desires to become a candidate. The filing fee shall be Fifty Dollars ($50.00) for district positions and One Hundred Dollars ($100.00) for at -large positions." PROPOSITION NO. 20 "SHALL the Charter of the City of Lubbock be amended to reflect the current/Texas Election Code provision with regard to the canvass of election returns?" In the event of approval of such proposition, Chapter 1, Article IX, Section 6, shall be amended to remove the words "and in any event within five (5) days," and to substitute therefor the words, "and in anyi`event not earlier than the second or later than the sixth day." PROPOSITION NO. 21 "SHALL the Charter of the City of Lubbock be amended to reflect the current Texas Election Code provision with regard to the timing of run-off elections and canvassing the returns of run-off elections? In the event of approval of such proposition, Chapter, 1, Article IX, Section 6A, shall be amended to remove the words "shall be held on the fourth Tuesday following the preceding election," and "and in any event within five (5) days," and substitute for each respective phrase the following,phrases, "shall be held not earlier than the 20th day or later than the �Oth day after the date of canvass of election returns for the main election," and "and in any event not earlier than the second day or later than the sixth day." PROPOSITION NO. 22 "SHALL the Charter of the City of Lubbock be amended to remove the duty of the City Council to appoint a City Marshall and a City Tax 40- Assessor -Collector and to allow up to four (4) year terms for City board members?" In the event of approval of such proposition, Chapter 1,J Article IX, Section 10, shall be amended to remove the words "City Marshall, the City Tax Collector and Assessor," and to add to Section 10 the following sentence: "The City Council may appoint members to City Boards and Commissions for terms of office up to four (4) years in length." PROPOSITION NO. 23 "SHALL the Charter of the City of Lubbock be amended to allow the Mayor to appoint the City Manager or Deputy City Manager as his agent to sign some types of routine City documents on his behalf?" In the event of approval of such proposition, Chapter 1j Article IX, Section 11, shall be amended by adding thereto in second sentence following the word "documents" the following words "except that he or she may dele- gate the signing of designated routine documents to the City Manager or Deputy Manager by means of a written instrument approved by the City/' Council and filed with the City Secretary." PROPOSITION NO. 24 "SHALL the Charter of the City of Lubbock be amended to reduce the required number of publications for penal ordinances from once a week for two (2) consecutive weeks to once within ten (10) days of final passage. In the,,event of approval of such proposition, Chapter 1, Article IX, Section 18, will be amended to read as follows: "Sec. 18. Publication of ordinances, effective date. All ordinances carrying a penalty shall be published once in a newspaper of general circulation within the City of Lubbock within ten (10) days"of final passage, and such ordinances shall take effect following the tenth day after final passage, except that emergency measures shall take effect according to their terms. Publication may 'be accomplished by publishing the descriptive caption of such ordi- nances as an alternative means of publication." PROPOSITION NO. 25 "SHALL the!Charter of the City of Lubbock be amended to conform to the State law pertaining to minimum contract amounts requiring competitive bids?" In the event of approval of such proposition, Chapter.1, Article IX, Section 27, shall be amended to remove the words "exceeding an expenditure of Two Thousand Dollars<1($2,000.00) shall be let on sealed competitive bids, all other contracts of similar kind and character for less than Two Thousand Dollars ($2,000.00)," and to substitute therefor the words "exceeding the minimum dollar amount requiring competitive bids,by State law shall be let on sealed competitive bids, unless exempted by some provision of law, and all other contracts of similar kind and ckaracter requiring an expenditure of less than the amount requiring competitive bids by State law. PROPOSITION No. 26 "SHALL the Charter of the City of Lubbock be amended to delete Section 29 of Chapter 1, Article IX, with,eregard to "Hours of Labor upon public works" and to renumber the remaining sections of Chapter 1, Article IV" In the event of approval of such proposition, Chapter 1, Article IX, shall be amended by removing therefrom Section 29 and renumber current Sections 30 and 31 as Sections 29 and, 30, respectively. PROPOSITION NO. 27 "SHALL the Charter of the City of Lubbock be amended to delete the reference to the "City Tax Collector" found in Chapter 1, Article IX, Section 30?" In the event of approval of such proposition, Chapter 1, Article IX, Section 30, shall be amended t 'delete the words "City Tax Collector." PROPOSITION NO. 28 "SHALL the Charter of the City of Lubbock be amended to provide the City Manager with authority to sign designated routine documents on behalf of the f1ayor?" In the. event of approval of such proposition, Chapter 1, Article X, Section 4,.shall be amended by adding a new subsection g thereto, which shall reads as follows: "(g) Sign certain routine documents on behalf of the Mayor pursuant to a written instrument designating such documents filed with ` the City Secretary." PROPOSITION NO. 29 "SHALL the Charter of the City of Lubbock be amended to clarify the duties of the Board of City Development?" d In the event of approval of such proposition, Chapter 3, Article I, Section 1, shall be amended to read as follows: "Sec. 1. Board of City Development. The Council shall appoint what shall be known and designated as a "Board of City Development," which shall be composed of fifteen (15) members, who shall serve without compensation, and may prescribe the qualifications and duties of such board, including the allocation of funds received hereunder, and shall annually appropriate three -tenths of a mill on the One Dollar ($1.00) valuation oV the taxable property in the City of Lubbock from the general fund of said City." PROPOSITION NO. 30 "SHALL the Charter of the City of Lubbock be amended to conform the terms of office of the members of the Board of City Development to the Texas Constitution?" In the event.of approval of such proposition, Chapter 3, Article I, Section 2, shall be amended to read as follows: "Sec. 2. Membership; term; vacancies; appointment; employees. The members of the aforesaid board shall hold office for such terms as may be determined by the Council at the time of appointment, which terms shall not exceed the maximum terms provided by this Charter or applicable limitations contained in the Constitution or general laws of this State. The Council may provide for over -lapping terms for members of the board and to this end shall designate the individual term for each member when appointed. All said members are to hold office until their successors are qualified unless a removal is made by the City Council for inefficiency or unattention to the duties of said office. In case of a vacancy on the board by resig- nation or otherwise the City Council shall fill said/vacancy by appointment. The Board may secure the services of such individuals, corporations or other entities as appropriate to the performance of their duties, but no such individuals shall become employees of the City by such relationship." PROPOSITION NO. 31 `"SHALL the Charter of the City of Lubbock be amended/ Ito clarify the reporting requirements for the Board of City Development?" In the event of approval of such proposition, Chapter 3, Article I, Section 4, shall be amended to read as follows: "Sec. 4. Reports to Council. PROPOSICION NUM. 1 "DEBERA la Carta Municipal de la Ciudad de Lubbock ser enmendada para reponer palabras de genero masculino con palabras de genero masculino y genero feminino?" En caso de la aprobacion de tal proposicion, entonces Capitulo 1, Articulo I, Seccion 4, de la Carta Municipal debera ser enmendada para reponer la palabra "Alcalde" alli dentro con las palabras "Ciudad de Lubbock". PROPOSICION NUM. 3 "DEBERA el requisito de una noticia de una reclamacion encontra la Ciudad de Lubbock siendo registrada dentro treinta (30) dias del tiempo que tal causa paso ser extendida a seis (6) meses?" En caso de aprobacion de tal proposicion, entonces Capitulo 1, Articulo I, Seccion 8, debera ser enmendada para reponer las palabras "dentro treinta (30) dias" y sustituir alli dentro las palabras, "dentro seis (6) meses". PROPOSICION NUM. 4 "DEBERA la Carta Municipal de la Ciudad de Lubbock ser enmendada para designar que el tipo de interes en volaraciones sea tal tipo como autorizado por ley del Estado?" En caso de aprobacion de tal proposicion, entonces Capitulo 1, Articulo II, Seccion 15, parrafo (a), subparrafo "Termino de Pago," debera ser enmendada para reponer las palabras "a cualquier tipo no excesivo de ocho por ciento (8%) por ano" y sustituir alli dentro las palabras "al tipo maximo permetido por las leyes del Estado de Texas." -4- PROPOSICION NUM. 5 "DEBERA el requisito para utilidades buscando licencias para usar las calles publicar la total proponida ordenanza licenciada una vez por semana para tres (3) semanas consecutivas ser reducido a una vez por semana para dos (2) semanas consecutivas?" En caso de aprobacion de tal proposicion, entonces Capitulo 1, Articulo II, Seccion 18, debera ser enmendado para reponer "una vez por semana para tres (3) semanas consecutivas" y sustituir alli dentro las palabras "una vez por semana para dos (2) semanas consecutivas." PROPOSICION NUM. 6 "DEBERA la Carta Municipal de la Ciudad de Lubbock ser enmendada Para designar que el tipo de interes en volaraciones especiales ser tal tipo Como es autorizado por la ley del Estado?" En caso de aprobacion de tal proposicion, entonces Capitulo 1, Articulo II, Seccion 18, debera ser enmendado para reponer las palabras "a cualquier tipo no excesivo de ocho por ciento (8%) por ano", y sustituir alli dentro las palabras "al tipo maximo permitido por las leyes del Estado de Texas". PROPOSICION NUM. 7 "DEBERA la Carta Municipal de la Ciudad de Lubbock ser enmendada para ensenar la ley corriente del Estado con respecto a la Corte Municipal de Registros de Multas?" En caso de aprobacion de tal proposicion, entonces Capitulo 1, Articulo II, Seccion 23, parrafo "Ordenanzas penal; multa", debera ser enmendada para reponer las palabras "que no exede Dos Cientos Dolares ($200.00)" y sustituir alli dentro las palabras "que no exede la multa maxima permitida por la ley del Estado." PROPOSICION NUM. 8 "DEBERA la Carta de la Ciudad de Lubbock ser enmendada para conformar con las proviciones de V.T.C.A., Codigo de Gobierno, Capitulo 30, Subcapitulo A, cual establicio una Corte Municipal de Registros para la Ciudad de Lubbock?" En caso de aprobacion de tal proposicion, entonces Capitulo 1, Articulo III (Judicial) debera ser enmendado por quitando todas secciones corrientes y sustituiendo alli dentro to siguiente: -5- "La Corte Municipal de Registro de Lubbock debera operar en conformidad con las proviciones de V.T.C.A., Codigo de Gobierno, Capitulo 30, Subcapitulo A, y ordenanzas pertinentes, resoluciones, y reglas." PROPOSICION NUM. 9 "DEBERA la Carta Municipal de la Ciudad de Lubbock ser enmendada para ensenar la ley corriente del Estado con respecto a los requisitos para peticiones sumitidas bajo de procedimientos de iniciacion y referendums." En caso de aprobacion de tal proposicion, entonces Capitulo 1, Articulo IV, Seccion 1, parrafo "Peticion; firmas; declaracion", debera ser enmendada por anadiendo a la primer frase, las palabras siguientes: "y, en adicion, tal otra informacion como sea requirido por la ley del Estado, tal como el nombre escrito de el o ella, numero de registro de votacion y la fecha que se firmo." PROPOSICION NUM. 10 "DEBERA la Carta Municipal de la Ciudad ser enmendada para designar que las peticiones para retirar un oficial elegido sea firmado por siquiera treinta por ciento (30%) de los votantes calificados teniendo residencia dentro dicho Distrito de eleccion del oficial elegido?" En caso de aprobacion de tal proposicion, entonces Capitulo 1, Articulo IV, Seccion 2, parrafo "Peticiones para retirar", debera ser enmendada para reponer la segunda frase alli dentro y sustituir alli dentro la siguiente frase: "Tal peticion para la retiracion de cualquier oficial eligido o oficiales debera ser firmada por siquiera treinta por ciento (30%) de los votantes calificados en el Distrito del oficial eligido, que sea determinado por el numero de votos lanzados en Distrito elijido de el o ella en la ultima y regular eleccion municipal; siquiera un decimo (1/10) de los que firmaron la peticion deberan certificar que en la eleccion en cual el oficial o oficiales fueron eligidos, ellos votaron para la eleccion de tal oficial o oficiales proponidos para retirar." PROPOSICION NUM. 11 "DEBERA la Carta Municipal de la Ciudad de Lubbock ser enmendada para ensenar las proviciones de referendum de la ley del Estado que sobrepongan las proviciones de la Carta Municipal con respecto a asuntos de iniciacion y referendum?" En caso de aprobacion de tal proposicion, entonces Capitulo 1, Articulo IV, Seccion 1, debera ser enmendada por la adicion de el siguiente parrafo alli dentro: Na "Eleccion designada por ley del Estado. En caso que un referendum es designado por ley del Estado tocante algun asunto, tal como emision de bonos de ingreso, entonces tal provision referendum debera sobreponer las provisiones de esta Carta Municipal perteneciendo a iniciacion y referendum y las provisiones de la Carta Municipal no seran efectivas." PROPOSICION NUM. 12 "DEBERA la Carta Municipal de la Ciudad de Lubbock ser enmendada para ensenar la ley corriente del Estado con respecto a requisitos para peticiones sumitidas bajo procedimientos retirados?" En caso de aprobacion de tal proposicion, Capitulo 1, Articulo IV, Seccion 2, parrafo "Firmas en peticiones", debera ser enmendada por adicion a la primera frase, las siguientes palabras, "y, en adicion, tal otra informacion como sea requirido por la ley del Estado, tal como el nombre escrito de el o de ella, numero registrado de votar, y la fecha de firmarse." PROPOSICION NUM. 13 "DEBERA la Carta Municipal de la Ciudad de Lubbock ser enmendada para requirir licencias de impuestos de ocupacion que sean emitidos por el Administrador de la Ciudad o su representante mas bien que por el Recaudador-Impuestos de Circulacion?" En caso de aprobacion de proposicion, Capitulo 1, Articulo VI, debera ser enmendada para reponer todas referencias al "Recaudador-Impuestos de Circulacion" y reponiendo tal palabras con el "Administrador de la Ciudad o su representante". PROPOSICION NUM. 14 "DEBERA la Carta Municipal de la Ciudad de Lubbock ser enmendada para reponer el requisito que todos los recibos de impuestos de ocupacion sean contrafirmados por el Alcalde?" En caso de aprobacion de tal proposicion, Capitulo 1, Articulo VI, debera ser enmendada por quitando todas secciones corriente y sustituiendo alli dentro to siguiente: "Todos procedimientos perteneciendo a impuestos y financia deberan estar en acuerdo con las provisioner del Codigo de Impuestos de Propiedad del Estado de Texas; y otras leyes del Estado que sean pertinente, y ordenanzas, resoluciones y reglas del Consejo Municipal." -7- PROPOSICION NUM. 15 "DEBERA la Carta Municipal de la Ciudad de Lubbock ser enmendada para conformar Capitulo 1, Articulo III, a los requisitos del Codigo de Impuestos de Propiedad del Estado de Texas?" En caso de aprobacion de tal proposicion, Capitulo 1, Articulo VI, Seccion 3, debera ser enmendada por tachando todas secciones corrientes y sustituiendo to siguiente: "Todos procedimientos perteneciendo a impuestos y financia debera estar en acuerdo con proviciones del Codigo de Impuestos de Propiedad del Estado de Texas; y otra ley del Estado que sea aplicable, y ordenanzas, resoluciones y reglas del Consejo Municipal." PROPOSICION NUM. 16 "DEBERA la Carta Municipal de la Ciudad de Lubbock ser enmendada para designar que el maximo honorario de interes en bonos emitidos por la Ciudad pueden exedir el corriente limite de la Carta Municipal que es seis por ciento (6%) por ano?" En caso de aprobacion de tal proposicion, Capitulo 1, Articulo VIII, Seccion 1, debera ser enmendada por reponiendo las palabras "para tener interes que no exiga seis por ciento (6%) por ano, pagable por ano o semestralmente.'" PROPOSICION NUM. 17 "DEBERA la Carta Municipal de la Ciudad de Lubbock ser enmendada para conformar con las proviciones de la opinion final en Jones V. Ciudad de Lubbock, CA-5-76-34, la Corte Distrito de los Estados Unidos, la Corte del Distrito del Norte de Lubbock?" En caso de aprobacion de tal proposicion, Capitulo 1, Articulo IX, debera ser enmendada por sustituiendo las siguientes secciones nombradas para las mismas secciones contenida corrientemente en la Carta Municipal. "Sec. 1. Gobierno Municipal; organismo de gobernar. E1 Gobierno Municipal de la Ciudad de Lubbock debera consistir del Consejo Municipal, cual sera componido de un Alcalde y seis (6) Miembros del Concilio." "Sec. 2. Termino de Oficina. E1 Alcalde debera servir un termino de dos (2) anos, y cada Miembro del Concilio debera servir un termino de cuatro (4) anos, y hasta que su sucesor sea eligido o calificado, a menos que sea mas pronto reponido de "Sec. 12. Alcalde Temporalmente. Los Miembros del Consejo Municipal elegiran un Alcalde Temporalmente entre ellos mismos y tal eleccion se llevara acabo en la primera junta regular del Consejo Municipal despues que los nuevos Miembros elegidos sean calificados y tomen sus asientos en el Consejo Municipal despues de una eleccion municipal y regular." "Sec. 15. Procedimiento Legislativo; quorum; votacion; excusado de votar. Cualquiera cuatro (4) Miembros del Consejo Municipal que constituien un quorum para la transaccion de cualquier negocio, y el voto afirmativo de cualquiera cuatro (4) Miembros del Consejo Municipal sera suficiente y necesario para adoptar o revocar cualquiera ordenanza o resolucion. El voto al aprobacion o revocacion de cualquiera ordenanza o resolucion sera tomada por votando "Si" o "No", y marticulado en el diario. Todos los Miembros del Consejo Municipal votaran en cada pregunta, ordenanza o resolucion, designando no mas que un (1) Miembro del Consejo Municipal puede ser excusado de votar por votacion de los otros seis (6) Miembros, cual sera marticulado en el diario. Cualquier Miembro del Consejo Municipal que rechaze votar menos que sea excusado sera marticulado en el diario como si votara en to afirmativo. Alcalde para que firme; secretaria para que atestigue; ordenanzas, etc. Cada ordenanza o resolucion aprobada por el Consejo Municipal sera asignada por el Alcalde, y atestiguada por la persona que sea Secretaria Municipal, y el sello de la Ciudad estampado consiguiente dentro dos (2) dias despues de su aprobacion." PROPOSICION NUM. 18 "OESERA la Carta Municipal de la Ciudad de Lubbock ser enmendada por medio de llamando una eleccion especial para llenar posiciones vacancias en el Consejo Municipal en caso que el Alcalde o un quorum del Consejo Municipal no sea posible para llamar tal eleccion por causa de catastrofe mutuo o otra razon?" En caso de aprobacion de tal proposicion, Capitulo 1, Articulo IX, Seccion 3, debera ser enmendado para anadir el lenguaje siguiente: "Si, por causa de catastrofe mutuo o otra razon, ni el Alcalde ni un quorum del Consejo Municipal sera posible para llamar dicha eleccion Especial, entonces tal eleccion sera llamada por el Administrador de la Ciudad o su representante." -10- su oficina como aqui dentro designado. Los terminos iniciales para Miembros del Concilio de Distritos 1, 3 y 5 debera ser dos (2) anos, empezando en 1984, y cuatro (4) anos alli despues." "Sec. 4. En caso de la aprobacion de tal proposicion, Capitulo 1, Articulo IX, Seccion 10, sera enmendado para reponer las palabras "Mariscal de la Ciudad, Recaudador-Impuestos de Circulacion de la Ciudad" y sustituir alli dentro la siguiente frase: "El Concejo Municipal puede nombrar miembros para mesas directivas de la Ciudad y Comisiones para terminos de oficina hasta cuatro (4) anos de largo." PROPOSICION NUM. 23 "DEBERA la Carta Municipal de la Ciudad de Lubbock ser enmendada para permitir al Alcalde que permita al Administrador de la Ciudad o su representante que firme unos tipos de documentos rutinos en nombre del Administrador de la Ciudad?" En caso de la aprobacion de tal proposicion, Capitulo 1, Articulo IX, Seccion 11, debera ser enmendada por anadiendo a eso la segunda frase siguiendo la palabra "documentos" las siguientes palabras: "con excepcion que el o ella puede delegar su firma a designado documentos rutinas al Administrador de la Ciudad o su representante por la manera de un instrumento escrito aprobado por el Concejo Municipal y registrado con la Secretaria Municipal de la Ciudad." En caso de una vacancia en la mesa directiva por resignation o de otra manera el Consejo Municipal ha de llenar dicha vacancia por nombramiento. La mesa directiva puede asegurar los servicios de tal individuos, corporaciones o otras personas como sea apropriado al desempeno de sus obligaciones, pero no tal individuos podran ser empleados de la Ciudad por tal relacion." PROPOSICION NUM. 31 "DEBERA la Carta Municipal de la Ciudad ser enmendada para aclarar los requisites de reportar para la Mesa Directiva de Desarrollo de la Ciudad?"
