RESOLUTION
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the Mayor of the City of Lubbock BE and is hereby authorized and
directed to execute for and on behalf of the City of Lubbock a Professional
Services Agreement between the City of Lubbock and Texas Tech University,
attached herewith, which shall be spread upon the minutes of the Council
and as spread upon the minutes of this Council shall constitute and be a
part of this Resolution as if fully copied herein in detail.

THE STATE OF TEXAS
PROFESSIONAL SERVICES AGREEMENT
COUNTY OF LUBBOCK
THIS AGREEMENT entered into this day by and between City of
Lubbock, hereinafter called "City", and Texas Tech University,
hereinafter called "University";
WITNESSETH:
WHEREAS, the City desires to evaluate the physical fitness of its
fire fighters in order to enchance their job performance; and,
WHEREAS, the University has made available the necessary facilities
and staff to test the physical fitness of such fire fighters and prescribe
the necessary exercise programs for such fire fighters; and,
WHEREAS, the University has the requisite training and expertise to
assist in evaluating the City's fire fighters for the enchancement of
their job performance to the betterment of the general public and the
City; and,
WHEREAS, the City desires to engage the University to conduct a
physical fitness program for the City's fire fighters upon the terms
stated hereinafter:
I. FITNESS EVALUATION
The University shall conduct each of the following evaluations on
the necessary equipment, if any, on each fire fighter enrolled in said
physical fitness program pursuant to the terms of this Agreement.
A. Sub -Maximal, graded exercise test on a treadmill or stationary
bicycle. Oxygen consumption shall be measured with a Beckman
Metabolic Measuring Cart and continuous heart rates shall be
recorded with a Cardiotachometer.
B. Body Composition. Such composition shall be evaluated with
underwater weighing to determine percent body fat, lean muscle
mass and ideal weight.
C. Muscular strength and flexibility. Muscular strength of the
low back, shoulder and arm region and upper leg region shall
be evaluated using the cable tensiometer testing device.
Flexibility of the upper back, lower back, hamstrings and
shoulders shall be assessed with standard flexibility measuring
devices.
D. Nutritional Analysis. As requested by any individual fire
fighter or fire fighters, a three-day analysis of caloric

intake and food consumption shall be taken. Based upon these
data a nutritional analysis shall be produced to assist the
individual fire fighter with caloric intake suggestions and
food group alterations.
E. Blood Work. A blood sample shall be taken at the Texas Tech
University Health Sciences Center (TTUHSC) and the values for
triglyceride, hemoglobin, cholesterol, potassium and a lipid
profile shall be produced.
F. Physical Exam. If any fire fighter enrolled in this fitness
program does not bring from a licensed physician the results
of a physical exam performed within the last month from the
date of his evaluation under this program, then a physical
exam shall be required. This exam may be conducted in the
Family Practice Department of Texas Tech University School of
Medicine (TTUHSC).
G. Diagnostic Stress Test. Fire fighters over 35 years of age or
fire fighters under 35 years of age who exhibit severe cardiac
risk tendencies shall be scheduled for a 12-lead diagnostic
stress test in the cardiopulmonary lab supervised by a member
of the Cardiology Division of the Internal Medicine Department,
Texas Tech University School of Medicine.
H. Six -Month Follow-up. All individuals still participating in
the program at the end of a six month period shall be retested
on items A through E, with the City's option to retest them
under F and G, to determine effectiveness of the program and
to give additional feedback to program participants.
STAFF REQUIREMENTS
A. The physical fitness evaluation testing program and exercise
prescriptions as set forth in this Agreement shall be prepared,
conducted, approved, evaluated, supervised and otherwise
performed upon the City's fire fighters by the staff within
the Exercise Science Division of the Department of Health,
Physical Education and Recreation of the University, and/or
the staff of the Health Sciences Center of the University and
Lubbock General Hospital.
B. Such staff shall be qualified and otherwise competent to
perform such testing and prescribing as set forth in this
Agreement.
C. All testing conducted at the Health Sciences Center of the
University or Lubbock General Hospital shall be conducted and
otherwise performed and supervised by cardiologists and/or
medical specialists using standard, competent protocols and
accepted medical standards.
III. AVAILABLE FACILITIES
The University shall make available at reasonable business hours
the following facilities to conduct the test and evaluations as set
forth in this Agreement:
A. The following equipment and apparatus which is currently
housed in the Men's Gym of the University:
(1) exercise physiology laboratory
(2) underwater weighing tank
(3) respirometer
(4) treadmill
(5) bicycle ergometer
(6) Cybex muscle testing equipment
(7) flexibility monitoring equipment
(8) computer back-up
(9) hand grip dynomometer
(10) back and leg dynomometer
(11) Harvard physiography
(12) Beckman Metabolic Measurement Cart
B. Other equipment and/or facilities may be substituted for the
items set forth in this Agreement so long as such equipment
and/or facilities substantially comply with the purposes and
intent of this Agreement.
IV. INDIVIDUAL EXERCISE PRESCRIPTION
A. A computerized exercise prescription shall be developed by the
University for each individual fire fighter enrolled in this
program based upon data derived from the fitness evaluation as
performed pursuant to.this Agreement.
B. Graduate students of the University shall be made available by
the University at reasonable, designated hours to assist in
the development and motivation of such individual exercise
prescriptions.
C. The continued performance of such exercise prescriptions shall
be voluntary on the part of any individual fire fighter and
the University shall not be held responsible for the subsequent
success or failure of such exercise prescriptions.
V.
TERMS OF PAYMENT
A. The following fee schedules and terms of payment shall govern
this Agreement and no other fees or charges shall be requested
by the University or its facilities or by Lubbock General
Hospital for tests conducted or work performed pursuant to
this Agreement.
B. The University shall bill and City shall pay within thirty
(30) days from the date of billing any fees or payments or
other costs consistent with the terms of this Agreement. All
costs shall be billed to: City of Lubbock, Fire Department,
P. 0. BOx 2000, Lubbock, Texas 79457.
C. The following fee schedules are in effect pursuant to this
Agreement and the University shall be paid according to such
fee schedules:
(1) All testing performed at two separate visits on any
individual fire fighter who is under 35 years of age,
asymptomatic, and possess the results of a physical exam
performed by a licensed physician within the last month
from the date of his evaluation under this program. FEE:
$145.00
(2) Any additional testing for fire fighters with suspected
risk factors, regardless of age. Fee includes a required
physical exam at the Family Medicine Department of the
University and a stress test. FEE: $290.00
(3) All testing performed at two separate visits on any
individual fire fighter who is over 35 years of age. Fee
includes a required physical exam at the Family Medicine
Department of the University and a stress test. FEE:
$290.00
VI. GENERAL
A. University shall keep full and complete records of its progress
under this evaluation program in forms agreeable to City,
which forms shall be available to City after the evaluation of
any individual fire fighter.
B. University shall not assign any interest in this Agreement and
shall not transfer any interest in this Agreement, whatsoever,
without prior consent of the City.
C. University shall save and hold harmless the City from all
suits, actions or claims brought on account of any activities
engaged in by University pursuant to this Agreement, only
insofar as such is allowed by the Constitution and laws of the
State of Texas.
D. City shall assist University by making available to University
all applicable records and data on file as allowed by law that
will assist University in the discharge of its duties under
this Agreement.
E. This Agreement may be extended or amended only upon written
agreement between the parties hereto.
F. The term of this Agreement shall be for one year from the date
of execution hereof by all parties.
G. This Agreement may be terminated by either party during its
course by delivery of 30 days written notice of intent to the
other party at the following addresses:
