HomeMy WebLinkAboutResolution - 1872 - Agreement - HDR - Resident Project Represenative, 34Th & Quirt Ave Project - 11_15_1984November 15, 1984 Agenda Item #10 Resolution #1872 JWF:js RESOLUTION WHEREAS, an Agreement between the City of Lubbock (as owner) and Henningson, Durham & Richardson, Inc., (as consulting engineers) for engineering services related to the 34th Street and Quirt Avenue Overpass Construction project dated May 28, 1983 authorized by Resolution No. 1374 of the City Council of said City in Section II-D(3) on Page II-5 of said Agreement requires authorization in writing from said City to said consult- ing engineers for the furnishing of services of Resident Project Represen- tative for continuous on -the -site observation of construction; and, WHEREAS, the City Council of said City has and now does determine that such written authorization should now be given to said consulting engineers to effectuate a more efficient administration of the construction of said project; NOW THEREFORE: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT Henningson, Durham & Richardson, Inc. is hereby authorized by the City of Lubbock to furnish the services of Resident Project Representative for continuous on -the -site observation of con- struction of the 34th Street and Quirt Avenue Construction project. SECTION 2. THAT the City Engineering Department is authorized to transmit a copy of this Resolution to Henningson, Durham & Richardson, Inc. which shall serve as written authorization as set forth in the preamble hereof. SECTION 3. THAT the Mayor of the City of Lubbock is hereby authorized and directed to execute for and on behalf of said City a Letter of Agreement to be entered into by and between said City and Henningson, Durham & Richardson, Inc. for providing services of a Resident Project Representative during the construction phase of the 34th Street and Quirt Avenue Overpass, attached herewith, which shall be spread upon the minutes of the Council and as spread upon the minutes of this Council shall 9, constitute and be a part of this Resolution as if fully copied herein in detail. Box 2000 Lubbock, Texas 79457 Re: City of Lubbock Quirt Avenue Overpass Dear Mr. Bertram: We are pleased to advise you that the resident project representative we are planning to assign to the referenced project is Mr. Robert J. Field. Mr. Field has been"involved in the heavy construction industry for more than thirty years. Mr. Field has served as resident project represen- tative, survey party chief, estimator and construction superintendent on numerous construction projects involving the construction of bridges, high- ways, streets, drains, sewers, reservoirs, water and wastewater improve- ments, airports and dams. Mr. Field's experience includes work in Massachusetts, Maine, New York, Illinois and Texas. Mr. Field was employed by Parkhill, Smith & Cooper, Inc. in April, 1982 and has served as resi- dent project representative on various water, wastewater, street and air- port construction projects in Lubbock and the surrounding area. Mr. Field's experience in construction of highway bridges and other heavy construction projects qualifies him to serve in the capacity of resident project representative on the Quirt Avenue Overpass, coupled with periodic site visits by a representative of the bridge design division of Henningson, Durham & Richardson. We also wish to advise you that we plan to use Wilson Surveying Co. for construction surveying needs. The construction contract requires the Contractor to furnish all surveys necessary to provide horizontal and ver- tical lines and grades to construct the work. Any construction period sur- veys performed by Wilson Surveying Co. for the City will be authorized through oar office, only for "spot-checking" the accuracy of staking and construction performed by the Contractor. The testing laboratory we plan to use is Terra Testing, Inc. The lab will only test materials delivered to the site and report results of material tests required to insure compliance with the project specifications. (HDR), hereinafter referred to as the Engineer, is pleased to submit to the City ofLubbock(City) the following proposal for providing additional professional services with regard to the Quirt Avenue Overpass project. The additional Special Services will include the following elements of work, all in accordance with our present Agreement for Engineering Services dated May 28, 1983, for design of improvements on Quirt Avenue, and Amendment No. 2 dated December 8, 1983. A. SCOPE OF ADDITIONAL SPECIAL SERVICES Section VII (17) - CONSTRUCTION OF OVERPASS "C-1" DESIGN CONCEPT Item 3. Furnish the services of Resident Project Architecture Engineering Respresentat i ves Planning Systems After written authorization by the City to proceed with the Sciences Construction Phase, the Engineer shall furnish additional special services as follows: Alexandria Austin Baton Rouge Furnish the services of Resident Project Respresentatives, Boston and other field personnel for continuous on -the -site Charlotte Chicago observation of construction. The authority and duties of Oallss such Resident Project Representatives are limited to Denver examining the material furnished and observing the work Gillette Grand Junction done, and to reporting their findings to the Engineer. San Francisco Seattle Texarkana Torrington White Plains City of Lubbock November 8, 1984 Page Two Failure by any Project Representative or other personnel engaged in on -the -site observation to discover defects or deficiencies in the work of the contractors shall not relieve the contractor for liability therefore or subject the Engineer to any liability for any such defect or deficiencies. The Resident Project Representative may request the services of the Resident Structural Project Representative as required with the concurrence of the City Engineer of the City of Lubbock. The Resident Project Representative may request, as required, materials and soils testing services to be performed by the soils testing laboratory under separate contract with the City of Lubbock. Charges for such tests shall be billed directly to the City of Lubbock by the soils testing laboratory, and shall not be subject to surcharges for subcontractor expense as noted in this contract. The Resident Project Representative may request, as required, surveying and construction project layout services to be performed by the surveyor under separate contract with the City of Lubbock. Charges for such surveying services shall be billed directly to the City of Lubbock by the surveyor, and shall not be subject to surcharges for subcontractor expense as noted in this contract. B. BASIS OF COMPENSATION For providing the Scope of Additional Special Services outlined above, we propose to be paid in accordance with Section VII of our contract dated May 28, 1983. Section VII covers special assignments and services not included in our basic compensation. For the above services rendered, the City shall pay HDR on an hourly basis in accordance with the schedule set forth in Section VII. As stipulated in our May 28, 1983 agreement, the compensation schedule as shown in Section VII of our contract dated May 28, 1983 shall be revised as follows for special services and basic services required after December 31, 1983. In addition, the City shall pay HDR for all non -labor expenses at cost plus fifteen percent (15%). The estimated manhours for providing additional special services are shown in the attached Exhibit A. Total estimated manhours for additional special services rendered shall be increased should the scope of services as noted in Exhibit A be increased. C. PERIOD OF SERVICE FOR ADDITIONAL SPECIAL SERVICES The provisions oftheProposal and the various rates of compensation for the Engineer's services provided herein have been agreed to in anticipation that the Construction Phase. will proceed immediately in an orderly and continuous manner. Each of the Engineer's services shall be completed as follows, after the City's written authorization to HDR to proceed with the work. Service Time of Completion Resident Project Representatives 420 calendar days City of Lubbock November 8, 1984 Page Four The time of completion stated above is inclusive of the time required for review and approval by the City and other affected utility companies. If the Engineer's services during construction are delayed or suspended in whole or in part by City for more than three months for reasons beyond Engineer's control, Engineer shall on written request to City (but without termination of this Agreement) be paid for services performed to date. If such delay or suspension extends for more than one year for reasons beyond Engineer's control, the various fees for compensation provided for elsewhere in this Agreement shall be subject to renegotiation. We are submitting this proposal in six (6) copies. This proposal shall constitute authorization to provide additional special services in accordance with Amendment No. 2 and the contract between HDR and the City of Lubbock dated May 28, 1983. If this proposal meets with your approval, please execute all copies in the space provided below and return three copies to this office. We certainly appreciate the privilege of performing these additional services for the City of Lubbock and stand ready to commence work at your direction.
