That the Mayor of the City of Lubbock is hereby authorized and directed to execute for and on behalf of the City of Lubbock a Standard Utility Agreement with the Texas State Department of Highways and Public transportation, account No. 9005-27-13, CSJ No. 0067-07-063 for Interstate Highway 27 Project in Lubbock, Texas for relocation and ad- justment of water and sewer lines from Harvard Street North to Loop 289 north and relocation of water lines at the Broadway underpass, attached herewith, which shall be spread upon the minutes of the Council and as spread upon the minutes of this Council shall constitute and be a part of this Resolution as if fully copied herein in detail. Attached is one executed copy of the approved agreement for the adjustment of that portion of the City of Lubbock's water and sewer line facilities between North Loop 289 and Itasca Street and at Broadway Avenue on the above captioned section of IH 27. You are hereby authorized to begin work to accomplish the adjustments as detailed in the Agreement. Work should be scheduled for completion by April 29, 1985. Prior to or at the time of final billing we will need the following information in order for our records to be in compliance with Federal and State requirements: Notification of starting and completion dates in writing. Four executed copies of Form D-15-80A, Utility Joint Use Agreement. One executed Form D-15-30, Quiticaim, covering the City's utility easements within IH 27 right of way where your lines have been moved or abandoned. Copies of the bids and notification of bid awards. We would like to stress that at all times proper safety measures be employed to protect the traveling public as may be required by your policies or as directed by the State's inspector. V - 73 Z3 CSJ NO. 0067-07-063 PARTY OF THE FIRST PART: State of Texas, acting by and through the State Department of Highways and Public Transportation, hereinafter called the STATE. PARTY OF THE SECOND PART: City of Lubbock hereinafter called the OWNER, acting by and through its duly authorized representative. WHEREAS, the STATE has deemed it necessary to make certain highway improvements on the Interstate System as designated by the State and approved by the Federal Highway Administration generally described as. follows: County Lubbock Highway I-27 located from Loop 289 North South to 19th Street and WHEREAS, the STATE will participate in the costs of relocating and adjusting certain facilities to the extent as may be eligible for State participation under Art. 6674w-4, V.A.C.S., and which costs are eligible for Federal participation; and WHEREAS, the STATE will request Federal participation in payment of the costs incurred in the adjusting of OWNER'S facilities under the provisions of Policy and Procedure Memorandum 30-4, issued by the U. S. Department of Transportation Federal Highway Administration on June 29, 1973, and amendments thereto, and WHEREAS, execution by the STATE will constitute approval for the Federal Highway Administration under authority of Paragraph 16 of Policy and Procedure Memorandum 30-4, and WHEREAS, this proposed highway improvement will necessitate the relocation or adjust- ment of certain facilities of OWNER as indicated in the following statement of work: Relocation and adjustment of water and sewer lines from Harvard Street north to Loop 289 North and relocation of water lines at the Broadway underpass. and such work is shown in more detail in OWNER'S preliminary plans, specifications and cost estimates which are attached hereto and made a part hereof, and which are prepared in form and manner required by Policy and Procedure Memorandum 30-4, and amendments thereto, and State Department of Highways and Public Transportation Form D-15-35 Page 2 of 4 Rev. 3-82 WHEREAS, the STATE desires to implement the relocation or adjustment of OWNER'S facilities by entering into an agreement with said OWNER as soon as possible, NOW, THEREFORE, BE IT AGREED: The STATE will pay to the OWNER the costs incurred 1h relocating and adjusting OWNER'S facilities up to the amount said costs may be eligible for State parti- cipation and which costs are eligible for Federal cost participation. The OWNER has determined that the method to be used in developing the relocation or adjustment costs shall be as specified for the method checked and described hereafter; (7 (1) Actual direct and related indirect costs accumulated in accordance with a work order accounting procedure prescribed by the applicable Federal of State regulatory body. (2) Actual direct and related indirect costs accumulated in accordance with an established accounting procedure developed by the OWNER and approved by the STATE. (J (3) An agreed lump sum of $ , as supported by the analysis of estimated cost attached hereto. (Note: This method is not applicable where the estimated cost of the proposed adjustment exceeds '$25,000,) If costs are developed under procedure (1) or (2) as before specified, the STATE will, upon satisfactory completion of the relocation or adjustment and upon receipt of final billing prepared in form and manner as prescribed by Policy and Procedure Memorandum 30-4 and amendments thereto, make payment in the amount of 90% of the eligible costs as shown in the final billing prior to the required audit and after such audit shall nake final payment in an amount so that the total payments will equal the amount found eligible for State reimbursement by the final audit. When requested, the STATE will make intermediate payments at not less than monthly intervals to OWNER when properly billed and such payments will not exceed 80% of the eligible cost as shown in each such billing. Intermediate payments shall not be construed as final payment for any items included in the intermediate payment. If costs are developed under procedure (3) as before specified, the STATE will, upon satisfactory completion of the relocations and adjustments and upon receipt of a billing prepared in acceptable form, make payment to OWNER in the agreed amount. Upon execution of this agreement by both parties hereto, the STATE will, by written notice, authorize the OWNER to proceed with the necessary relocations or adjustments, State Department of Highways ` and Public Transportation Form D-15-35 Page 3 of 4 Rev. 3-82 and the OWNER agrees to prosecute such work diligently to completion in such manner as will not result in avoidable interference or delay in either the STATE'S highway construction or in the said work. Such authorization to proceed shall constitute a commitment on the part of the STATE that the utility relocation has been included in an approved program as an item of right of way acquisition or construction, that a project agreement which includes the work will be executed, and that the utility relocation will be required by the finally approved project agreement and plans. Form D-15-48 enclosed with OWNER'S preliminary estimates attached to this agreement, is approved as complying with Paragraph 6 of Policy and Procedure Memorandum 30-4 and OWNER is authorized, but not required, to contract such work. *The preliminary estimate will indicate the extent to which work is to be performed under each contract. Other work shall be contracted by OWNER only with approval of the STATE in accordance with Policy and Procedure Memorandum 30-4. The OWNER will carry out said relocations and adjustments, accurately record the costs, and retain such records in accordance with applicable rules, regulations and procedures and all other provisions of Policy and Procedure Memorandum 30-4, and the costs paid by the STATE pursuant to this agreement shall be full compensation to OWNER for all costs incurred by OWNER in making such relocations and adjustments. Bills for work hereunder should be submitted to STATE not later than 90 days after completion of the work. It is necessary to construct a new replacement facility. The replacement facility (will not) remain in useful service beyond the time when the existing utility facility would have remained in useful service or would be replaced; there- fore, a credit for expired service life (will not) be allowed against the cost of the project. (Where credit is not allowed, additional documentation supporting such determination may be required.) In the event it is determined that a substantial change from the statement of work contained in this agreement is required, re.imhursement therefor shall be limited to costs covered by a modification of this agreement or a written change or extra work order approved by the STATE. It is expressly understood that this agreement is subject to cancellation by the STATE at any time up to the date that work under this agreement has been authorized and that such cancellation will not create any liability on the part of the STATE. a State Department of Highways and Public Transportation Form D-15-35 Page 4 of 4 Rev. 3-82 The OWNER by execution of this agreement does not waive any of the rights which OWNER may legally have within the limits of the law. Concrete Driveway Cut and Repair, 6-inch 40.00 40,660.00 -------------- TOTAL OF BID ITEMS 1 THROUGH 52 -------------- $375,836.00 CITY OF LUBBOCK I-27 UTILITY ADJUSTMENTS SPUR 326 AND BROADWAY Schedule of Work: The work described by this utility agreement is scheduled as follows: a) Award construction contract December 20, 1984 or when utility agreement is approved by the State Department of Highways and Public Transportation; b) 1-ssue-notice--to proceed --to contractor within 35 calendar days following award of contract; c) Complete the project within 90 calendar days of notice to proceed. Description of Work shown on plans: General: Existing water lines within the project limits are either ductile iron or asbestos -cement pipe unless otherwise specified. Existing fittings are ductile iron. Existing water lines are class 150 or better. Proposed water lines can be either ductile iron or asbestos -cement pipe as bid by the contractor. These two types of pipe are competitive. The option of selecting the type of pipe from an approved list of types allows the contractor to furnish the pipe at the least possible cost. Proposed fittings are cast iron, and are paid for at the unit price bid per ton. Weights of the proposed fittings are determined by using standard weights for cast iron fittings as established by the American Water Works Association or American Standards Association. Existing sewer lines are vitrified clay sewer pipe unless otherwise shown. Proposed sewer lines will be vitrified clay sewer pipe unless shown as ductile. Ductile sewer pipe is required under roadways and railroads by design criteria. Existing Fire Hydrants are relocated to the proposed locations except where the existing fire hydrant relocation cost would exceed the cost of a new fire hydrant. Existing valves, fittings, pipe and other appurtenances will be aban- doned in place since cost of removal and salvage would exceed the salvage value. Pavement cut and repair and sidewalk and driveway cut and repair where shown is necessary to make permanent or temporary repairs of surfaces damaged during construction. Line 1-W: Proposed water line 1 W, sta. 421+00 to sta. 426+25 (Lt.) will replace the existing parallel water line sta. 420+50 to sta. 426+25 (Lt.). The proposed line will tie to the existing line at sta. 426+25 and to a pro- posed crossing at sta. 424+00. Line 2-W: Proposed water line 2-W, sta. 424+00 will replace the existing crossing at sta. 421+07. The proposed line will be in -casing underneath all proposed roadways and will tte to proposed parallel lines at the west and east R.O.W. lines. A 21-inch casing is required to accommodate the outside diameter of the 8-inch pipe fittings (13 1/3-inch) plus the skids (2-inch) necessary -to slide the pipe through .the casing. Line 3-W: Proposed parallel water line will replace the existing parallel Line 1-S: sta. 427+50 (Rt.) sta. 427+50 (Rt.). 427+50 (Rt.) and to Proposed sewer line 1-S, sta. 422+44 (Lt.) will be an extension of the existing crossing at sta. 422+44. Ductile iron sewer pipe is required under the proposed roadway. The proposed line will tie to a proposed parallel line at sta. 422+44 (Lt.). The existing crossing has an average depth below proposed roadway ditches of 5.5 feet. Line 2-S: Proposed sewer line 2-S, sta. 420+50 to sta. 426+25 (Lt.) will replace the existing parallel sewer line, sta. 420+50 to sta. 426+25 (Lt.). The` proposed line will tie to the proposed crossing extension at sta. 422+44 (Lt.) and to the existing sewer at sta. 426+25 (Lt.). Line 3-S: Proposed parallel sewer line 3-S, sta. 416+00 to 418+00 (Rt.) will replace the existing parallel sewer, sta. 416+00 to 418+00 (Rt.). The pro- posed sewer will tie to the existing sewer at sta. 416+00 (Lt.). Line 4-S: Proposed sewer line 4-S, in drainage channel easement, will replace the existing sewer line that crosses the channel easement. At the point where the existing sewer line crosses the proposed drainage channel, the flow line of the proposed channel is lower than the existing sewer pipe, an unacceptable situation. The proposed sewer line is so located that the proposed flow line of the drainage channel is slightly higher than the pro- posed sewer line. Because the clearances were less than required, the sewer line will be encased in concrete to protect it during construction of the drainage channel. Ductile iron is used in the segments under the drainage channel for hydraulic reasons. The State Department of Health has issued minimum recommended grades for sewer lines. Since this segment of the sewer line is flatter than the minimum, ductile iron pipe, a smoother wall pipe will be used to improve the flow conditions. Ductile iron is used in the segment under the railroad for extra strength. The use of duc- tile iron does not require a casing.; Line 5-S: Proposed parallel sewer line 5-S, sta. 403+50 to 410+20 (Lt.) will replace the existing parallel line sta. 403+50 to 410+20 (Lt.). The existing manhole, sta. 403+50 (Lt.) will be removed and replaced to accom- modate the proposed sewer line. Ductile iron will be used in the span under the proposed roadways. Anew drop manhole will be required to tie the existing dine, sta. 406+00 (Lt.). Line 4-W: Proposed water line 4-W in the Broadway R.O.W. between Avenue E and Avenue D will replace the existing water line in the same vicinity. The proposed location is out of the proposed Broadway reconstruction limits. The proposed line ties to the existing in Avenue E. Line 5-W: Proposed waterline 5-W along Broadway between Avenue B and Avenue A will replace the existing water line crossing Broadway. The proposed reconstruction of Broadway will not clear the existing crossing. The pro- posed location along Broadway to Avenue A then across Broadway in the Avenue A intersection is the most cost-effective relocation when con- sidering lines 6-W, and 7 W. The proposed line will tie into the existing line in the alley between Avenue A and Avenue B. Line 6-W: Proposed water line 6 W along Avenue A between Broadway and Main Street then along Main Street from Avenue A to Avenue B will replace the existing water line along the north side of Broadway between Avenue A and Avenue B. Reconstruction of Broadway and the proposed retaining walls will not accommodate additional water lines other than line 7 W. The cross sec- tions, Sta. 22+01.5, left side, show the proposed -face --of -theretaining-- wall. The width has not been determined but is estimated to be 2-feet. The remaining jwidth between the retaining wall and the R.O.W. will only accomodate the'': proposed 6-inch water adjustment (Line 7 W). The location shown for Line 6 W is the most cost effective route when considering existing utilities and consruction limitations. Line 6 W will tie to the existing water line and proposed line 5-W in the intersection of Broadway and Avenue A and in the intersection of Main and Avenue B. Line 7-W: Proposed water line 7 W along the north side of Broadway between Avenue A and Avenue B will replace the existing water line in the same vicinity. Reconstruction of Broadway and the proposed retaining walls force the existing line to be relocated next to the R.Q.W. line. The pro- posed line will tie to the existing near the intersection of Broadway and Avenue A. The cross sections, Sta. 22+01.5, left side, show the proposed face of the retaining wall. The width of the wall has not been designed but is estimated to be 2-feet. The remaining width between the retaining wall and the ROW will only accommodate the proposed 6-inch water adjustment (Lime 7 W).
