HomeMy WebLinkAboutResolution - 1820 - Contract - City Of Slaton - Sale Of Library Goods - 09_13_1984Resolution 1820 September 13, 1984 Agenda Item #33 MH:js RESOLUTION BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the Mayor of the City of Lubbock BE and is hereby authorized and directed to execute for and on behalf of the City of Lubbock a Contract for Sale of Goods by and between the City of Lubbock and the City of Slaton, attached herewith, which shall be spread upon the minutes of the Council and as spread upon the minutes of this Council shall constitute and be a part of this Resolution as if fully copied herein in detail. ALA NRY, OR ATTEST: �, y Secretary AS TO CONTENT: jim Weston, uirector or community Facilities APPROVED AS TO FORM: Mi le ar , Assistant City Attorney Resolution 1820 CONTRACT FOR SALE OF GOODS THE STATE OF TEXAS § COUNTY OF LUBBOCK § This Agreement is made and entered into this 1S+1'1 day of See-krtw.,6c.-c , 1984, by and between the City of Lubbock, County of Lubbock, State of Texas, acting by and through Alan Henry, Mayor, thereunto authorized to do so, hereinafter referred to as Seller, and the City of Slaton, County of Lubbock, State of Texas, acting by and through Donald R. Sikes , Mayor, thereunto authorized to do so, hereinafter referred to as Buyer. Seller hereby undertakes to transfer and deliver to Buyer on or before September 30 , 19 84 , the following described goods: Library materials which consist of 10,427 volumes and the furniture and equipment listed on Appendix "A", attached herewith and incorporated by reference, hereinafter referred to as goods. II. Buyer hereby undertakes to accept the goods and pay for them in accordance with the terms of this Contract. It is agreed that identification of the goods shall not be deemed to have been made until both Buyer and Seller have agreed that the goods in question are to be appropriated to the perfor- mance of this Contract. IV. Buyer shall make payment of $21,627.00 for the goods in five (5) equal installments of $4,325.40 per year to the City of Lubbock. The Buyer shall deliver all payments to Robert Massengale, Assistant City Manager of Financial Services, on or before October 1 of each year in which payment is due beginning on October 1 of 1984 and each year thereafter until the total payment of $21,627.00 has been satisfied.
