WHEREAS, the City of Lubbock, Texas, a Home Rule Municipality located
in Lubbock County, Texas, has determined and does hereby determine that the
public needs, safety and welfare demand and create a public necessity for
the acquisition of additional land for municipal public uses and purposes,
to -wit: for the Quirt Avenue and East 34th Street overpass project, and
this City Council of said City finds it in the public interest and for
public purposes and municipal purposes to proceed with the acquisition of
lands as needed for such purposes as aforesaid; NOW THEREFORE:
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT the fee simple title to the following described
tract of land located in Lubbock County, Texas, be acquired for public
purposes and municipal purposes as set forth in the preamble hereof,
to -wit:
A tract of land out of that certain tract situated in the City of
Lubbock, Lubbock County, Texas, being out of Lot 3, Block 40, Coronado
Addition, said property also being the same property described in a
Deed from the Southeast Lubbock Development Corporation to the Housing
Authority of the City of Lubbock, of the County of Lubbock, State of
Texas, dated September 27, 1968, recorded in Volume 1180, Pages
648-649 of the Deed Records of Lubbock County, Texas, being more
particularly described by metes and bounds as follows:
BEGINNING at a point in the existing west right-of-way line of Quirt
Avenue, said point being the most southerly corner of Lot 3 and South
2024144" West, a distance of 307.94 feet from the northeast corner of
Lot 3;
THENCE, North 37026'57" West along the existing property line, a
distance of 5.50 feet to a point in the proposed west right-of-way
line of Quirt Avenue;
THENCE, North 9003'10" East along the proposed west right-of-way line
of Quirt Avenue, a distance of 30.48 feet to a point in the existing
west right-of-way line of Quirt Avenue;
THENCE, South 2024'44" West along the existing west right-of-way line
of Quirt Avenue, a distance of 34.50 feet to the POINT OF BEGINNING.

SECTION 2. THAT the owners of said tract,.including the Housing
Authority of the City of Lubbock, BE offered through the Right -of -Way
Department of the City of Lubbock the amount of $100.00, which is the
amount appraised as the value and total damages for the fee simple title
and acquisition of said real estate hereinabove described, for the use and
benefit of the City of Lubbock, Texas, for the purposes herein stated, and
unless accepted forthwith, the City Attorney of said City of Lubbock is
hereby authorized and instructed to institute condemnation (eminent domain)
proceedings to acquire the fee simple title to said land as hereinabove
described for public purposes and municipal purposes.
