RESOLUTION
WHEREAS, the City of Lubbock, Texas, a Home Rule Municipality located
in Lubbock County, Texas, has determined and does hereby determine that the
public needs, safety and welfare demand and create a public necessity for
the acquisition of additional land for municipal public uses and purposes,
to -wit: for the quirt Avenue and East 34th Street overpass project, and
this City Council of said City finds it in the public interest and for
public purposes and municipal purposes to proceed with the acquisition of
lands as needed for such purposes as aforesaid; NOW THEREFORE:
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT the fee simple title to the following described
tract of land located in Lubbock County, Texas, be acquired for public
purposes and municipal purposes as set forth in the preamble hereof,
to -wit:
A tract of land out of that certain tract situated in the City of
Lubbock, Lubbock County, Texas, being out of the South 210 feet of the
West 300 feet of Lot 2, Block 5, Nelson -Brown Addition, said property
also being the same property described in a Deed from Cleo H.
Wilkerson, Individually and as Independent Executrix of the Estate of
J. G. Wilkerson, deceased, and John Gordon Wilkerson, Jr. and Howard
C. Wilkerson, to D. C. Stotts, dated June 15, 1959, recorded in Volume
747, Pages 185-186 of the Deed Records of Lubbock County, Texas, being
more particularly described by metes and bounds as follows:
BEGINNING at a point in the existing west right-of-way line of Quirt
Avenue, said point being the southeast corner of the South 210 feet of
the West 300 feet of Lot 2, and South 87035'59" East, a distance of
300.00 feet from the southwest corner of the South 210 feet of the
West 300 feet of Lot 2, Block 5;
THENCE, North 87035159" West along the south line of the South 210
feet of the West 300 feet of Lot 2, Block 5, a distance of 40.39 feet
to a point on a curve of the proposed west right-of-way line of Quirt
Avenue;
THENCE, Northeasterly along said curve to the left, having a radius of
30.00 feet and a radial bearing of North 13048104" West, a distance of
37.85 feet, along said curve to a point in the proposed west right-of-
way line of Quirt Avenue;
THENCE, North 3054'09" East along the proposed west right-of-way line
of Quirt Avenue, a distance of 182.00 feet to a point in the north
line of the South 210 feet of the West 300 feet of Lot 2, Block 5;
THENCE, South 87035'59" East along the north line of the South 210
feet of the West 300 feet of Lot 2, Block 5, a distance of 14.00 feet
to a point in the existing west right-of-way line of quirt Avenue;
THENCE, South 2024'02" West along the existing west right-of-way line
of Quirt Avenue, a distance of 209.96 feet to the POINT OF BEGINNING.
SECTION 2. THAT the owners of said tract, including D. C. Stotts,
BE offered through the Right -of -Way Department of the City of Lubbock the
amount of $13,800.00 which is the amount appraised as the value and total
damages for the fee simple title and acquisition of said real estate
hereinabove described, for the use and benefit of the City of Lubbock,
Texas, for the purposes herein stated, and unless accepted forthwith, the
City Attorney of said City of Lubbock is hereby authorized and instructed
to institute condemnation (eminent domain) proceedings to acquire the fee
simple title to said land as hereinabove described for public purposes and
municipal purposes.
Passed by the City Council this 9th day of August 1984.
